Lemuel C. Rice wrote on 08/04/13: I just wanted to give a testimony to your website. My wife and I finally got a final loan modification from BOA. We have been trying to get a loan modification since 2007. The first time my wife lost her job in 07 we tried working with NACA but we didn’t has any success so that process took 2 years. Then my wife finally found work and her income was less than what she was making so I tried getting a modification on my own but with success. We stop applying because we were able to make our payments but in 2012 we had difficulty again because my wife lost her job in July of 2012. In October of 2012 BOA put us on a 6 months forbearance. At the end of that forbearance we had to pay all that money back. After the 6 months forbearance we couldn’t pay the money back because my wife was unemployed and we didn’t have the money. In may of 2013 BOA decided to to stop servicing our loan and give it to another servicing company while we were still trying to get a modification. With little hope I happen to be searching the Internet and I stumble onto your website and I did exactly what you said to do and within a day or 2 we got a call from BOA expressing that they wish to help us with a modification. Within a week or 2 we had a trial modification. As of today we made our last trial modification and we received our papers to sign and return to make it a permanent modification. Our payments are lower with an adjustable interest rate that won’t exceed 4.25% of the loan. We are very satisfied with the modification and we are happy we can keep our home. I just to say thanks to your website and the information that you made available we are very happy to keep our home.

Thank you so much for your website.

Tina Marsh and Maria Radatus wrote on 02/05/13:  Hello John — Just a real quick update. Maria did get the mod. I really think Martin helped as it was done I think on Tuesday. Her payment was within about 50$ of what the REST report showed. Maria is planning on giving you at least $50 on your blog at least. God bless and thanks so much for the referral. — Tina Marsh and Maria Radatus

testimonial1Another Email sent also to Martin:  Hello Martin, Well, thanks again to you and I have to praise the Lord as well as John, your friend who connected me to you in such an incredible manner I just wanted to say that Maria is saving money for her deductible of an aneurysm operation she will need. She has been missing some work as she has been preparing for this operation. She was able to give you $92.00. I sent it in last week. Would any type of a testimony be helpful for you? I know you did an amazing thing with your contacts/knowledge and I sincerely know that you are an answer to prayer of many.

Thank God!!

Thanks,

Nancy Frost wrote on 09/24/12:  To John’s blog today: YES! It is true, I had to be pinched in order to make sure I wasn’t dreaming when I received my call from John and Martin Andelman about Bank of America saving our home!!!!

If anyone feels this is too good to be true, I can understand because let’s face it, we had believed everyone who claimed they could help us and will do what they promise only to find out they had no intentions of doing anything! I am that homeowner! It is true! Our home was sold out from under us by Fannie then on a Friday night I get a knock on my door to get out of my home in 72 hours from posting of the eviction by our county Sheriff! I don’t know about you all but there was no way I could pack up everything in 72 hours without prior warning! Our home had been foreclosed! So there I was left at the door of my home I didn’t own anymore by myself. It’s amazing how your mind starts to work under a shock like that! I didn’t call my husband who was on the road long hauling cross country (his new career he had to learn after 30 plus years of being in construction), instead, I called John. John knew I wasn’t kidding when I called, you see, John and I have been on this journey together with BofA basically from the very start with piggybankblog.com, I was one of his very first followers. We have shared our ups and downs, he even gave me my own section on piggybankblog to blog my own experiences on. I was in the fight right with him and with all the other helpless homeowners out there! John never hearing me ever be upset knew exactly what to do and got on the phone to Martin, the three of us discussed my situation then Martin took the bull by the horns and wrangled this bull to the ground! He was able to on a Friday night get someone at BofA to get started on saving our home! It was like being at the rodeo where the Cowboy and his horse ropes the bull while Martin jumps off his steed to take the steer down to the ground and tell BofA (the bull) they had to take action and take action NOW! And BofA did! By that week while John was on his Jury Duty assignment (John even worked through his summons to help), Martin contacted John with details what BofA was doing for us. Talk about a dream come true, both John and Martin personally called me to tell me the good news about how BofA was able to stop the 72 hour eviction, reverse the foreclosure AND give us a REAL TRUE LOAN MODIFICATION, our home is saved! From what I understand Bank of America had to take our loan over from Fannie, that means BofA had to fight back for us! BofA didn’t just fight back to stop the eviction on us they even worked to give us the modification that really and truly works for us! Bank of America worked with us through Martin who worked through John! This did not cost us any legal fees to fight in saving our home, none! Neither Martin or John gained a cent in this but what they did gain, was the satisfaction of helping a homeowner keep their home and not be kicked out on the streets becoming homeless by our United States of America Government!
.
This is my testimony and one I will never stop talking about! Anyone out there who is under the same situation with BofA as I was, don’t stop and collect your $200, get John and Martin and stop being evicted or foreclosed on and collect you life back!! As far as Brookstone? I have nothing positive to say about them so I won’t say anything, obviously.
.
Homeowners, please don’t wait any longer for help, contact John, let him know what is happening to you especially if you have a government loan because I can tell you first hand, our government doesn’t care about the homeowner! Who does care are John and Martin, if you want action, these are the men who can not only take action but follows through with their actions!!! These men are stronger than E.F. Hutton!!! When they speak, BofA LISTENS!!
.
True Story God as my witness!
.
Nancy Frost and she fought back with help from her friends!!!!
.
Thank you John and Martin, God bless you Both!
.
AND thank you Bank of America for taking responsibility of our loan and saving our home!

On 06/04/11 Stephanie wrote: John, I can’t thank you enough for your assistance you provide other B of A mortgage holders. Because of the information your site provides, our family was able to get a fixed loan at 2% for the first 6 years and it ramps for the next 4, capping at 4.875%. We had been in the process since Jan 15th of 2010, and because of you our process was escalated so rapidly. If I can offer anyone advice, know that when customers contact the CEO’s office, you will receive the best customer care B of A could provide. They have an entire division devoted to people who write to him! Another big key for us that you always need to be sure that your mortgage stands in the same division to avoid being tossed from dept to dept. Meaning, if you are current, stay current. If you are 30 days behind, never pass to the 31st day or they will transfer your paperwork to a different department.

Thanks again!

I JUST WANTED TO THANK YOU FOR ALL YOUR EFFORTS ON YOUR BLOGS AND THE TREMENDOUS INFORMATION THAT YOU PUT ON THERE, I CAN TESTIFY THAT I BENEFITED FROM THIS INFO AND IT HAS HELPED ME TO STAY IN MY HOUSE, IT WAS THE LAST HOPE FOR ME, I GOT A GREAT RATE – 2% for the first 5yrs, 3% year six and by 7th yr, its 4.78 for the remainder term of the loan, I don’t think I can beat that anywhere.

Also, I like to thank some bank of America employees, those that listen to people concerns and respond in a timely manner, some are very rude on the phone, but the majority of them treated me with respect and sympathizes with me.

AGAIN, THANK YOU SO MUCH AND REMAIN BLESSED.

Please feel free to use my testimony on your blog/site.

I read your site last week with the suggestion of writing the CEO and explanning the situation. I wrote a stinging email and asked him if he condoned and approved the current tacits being used. This was on Friday. Today I received a call , in fact two calls from BOA from a very nice and courteous lady and she went out of her way to help me. She will asign a case Mgr. to me by Friday of this week and also call me back She gave me her private line so I could call her.

I used the headings you suggested in the letter and received a reply and contact in two business days

Just thought you might like to know your suggestion worked.

On December 28th, 2010 Michael Lee: John, I just received a call from Richard Lara at BOA and they are going to refund every cent they charged me. He was super nice and I thanked him, kind of shocked that it actually happened. This would not have been possible without your help and you standing up for us that have loans with BOA. I think you are a great person for taking your own time to help people like me after many many calls to BOA that left me angry and defeated. I am huge fan of yours now.

Kristin Potter wrote on 12/19/10: I contacted you a long time ago as I was in the same boat as you, and just wanted to let you know that after nearly a year and a half Bank of Screwing America FINALLY modified our loan. It took a lot of phone calls, emails and letters to BofA, it’s CEO, my senators and state reps, but we got it. BofA continues to send us monthly statements with the old payment on it, which is a testament to their laziness and unwillingness to follow through on anything. How this bank is still in existence is beyond me. They’re the most incompetently run business I’ve ever had to deal with.

To everyone else fighting these theives to save their homes, DON’T GIVE UP. It’s exhausting and beyond frustrating, but keep on BAC until they modify your loans. Call them and email them every day if you have to. But don’t ever let them make you feel powerless.

Kamala Harris, if you’re reading this I ask that your first action after being sworn in as California’s Attorney General be joining Nevada and Arizona in filing suit against Bank of America for crimes committed against the citizens of this state.

My Name is Kristin Potter Ramirez, and I will continue to fight back.

Testimonial on 02/10/11: I wanted to thank you for the advice to email BofA’s CEO. I emailed BofA on 2/7/2011. I received a call from BofA’s president’s office a day later, telling me that the bee’s hive had been stirred. I received a phone call from a manager in the modification department the same day; she apologized for the lack of customer service. She told me she would call me back in a couple of hours and let me know what they could do for me. I received a call back within an hour with an offer to modify my loan. I couldn’t believe it. We just got done what has taken me 10 months to get done with one email. WOW!! I start my trial period next month and have contact info for the direct decision makers for my file now. I will keep you posted, any advice from this point would be appreciated :-) Words can’t explain how thankful me and my family are to you. You are making dreams come true one person at a time. Keep up the good work God Bless!!!!!!!!!

Testimonial November 30th, 2010 by Kimberly Greenwade: Attention PiggyBankers, do email the CEO it does produce results…

I’m proud to say that I received my permanent mod docs yesterday after waiting for a year.

I emailed the CEO in mid September and received a call the next day. It did take 2 more months to get final approval, but what the hell I had already been waiting for 10 months.

Never thought it would happen, but I tell ya one thing it wouldn’t have happened without PiggyBankBlog!

John Wright,

you the man

Testimonial November 20th, 2010: John, You are providing a great service to people. I emailed the address you provided and received a call the next day and was assigned a Sr. adjuster in two days. Things seem to be moving forward after a year of the same run around described but the others on this site. To anyone reading this, the email address is legit and following Johns format gets results. Happy Holidays John and many thanks. ill let you know what the outcome is.

Testimonial November 15th, 2010: Hi John, Just wanted you to know the progress of my loan modification and what BofA has decided to do. They just recently sent me a new modified proposal. I am shocked. They changed my interest rate from 6.35% to 4.5% which lowers my payments by $200. The $5,000 in fees etc, will be tacked on to the end of the loan. I requested they corrected the all the lates on my credit reports which they did. I don’t think I would have gotten this new modification without your input, info and supporting you in your fight…..so I thank you.

Some of my friends have jumped on the “Produce the Deed”, “Forensic Auditing” and Robo Signing procedures to stop their foreclosures. I pray for them and everyone else in modified/foreclosure predicaments. I’ll keep you posted as I’m still waiting for the final paperwork of this new proposed modification.

Thank you again,

Desheila

Testimonial October 28th 2010:  John…thank you for your most insightful information provided on this website…my house was under foreclosure after a year of going back and fourth about the modification process, I was tired of not getting straight answers. I emailed the ceo as you suggested and I got a call a day later from a loan negotiator saying my modification was approved. Ihad and agent assisting me from a non profit organization and he couldn’t believe how quick it happened…I’m almost certain after my email someone had to thoroughly review my file..no more run around signed the papers and got my mod!! THANK YOU SOOO MUCH!!

Testimonial October 21st 2010: Dear John, On October 15, 2010 we received a letter informing us that our house was in foreclosure, It hit us like a bucket of ice cold water and dealing with the B of A has been a nightmare. Every time we called it would be a different answer to the same questions. Since April 2010 we had been told that our file was with the underwriter for review on our loan modification to keep checking in and continue doing the trail payments. According to their records we were denied on June 10, 2010 and the letter of denial did not have a reason for the denial. Called in and was told that it had been sent out by mistake, it had been computer generated to a lot of people, like myself, and who were also calling in. So, disregard letter and continue with trial payment. Which we did, so when we received letter of foreclosure we were very surprised and confused. Not knowing what to do and not getting straight answers from B of A, I took to the website and found yours. Now, I have to admit that at first I was very skeptical thinking sending an email to the CEO had to be a hoax and to think that if in fact it was an excising email account, he would not get back to us. But low and behold, we have gotten a call from a representative for the CEO who has now flagged our file and move to presidential level! Will have a senior negotiator assigned to us and will only be dealing with that person from now on. Wow! Needless to say we are relieved to have our file in review once again and hopefully get the answer we’re hoping for. Thank God and bless you for giving us the information we desperately needed to head in the right direction. Regular Joe’s like us have no idea where to head after a big bully like B of A tries to take advantage but you helped tremendously. And I have been passing your website to whoever I know needs help. Thank you again,

Testimonial on September 20,2010:  I was in the same boat as most people, applied for MHA and in the trial period for 9 months, lost paperwork, credit ruined and also recently a notice of intent to accelerate….Well I came across this site and took Mr. Wright’s advice and emailed the CEO of B o A yesterday (9/19/10) Well lo and behold at 3 pm this afternoon, I was contacted by an account executive from BofA who will be overseeing my case. She said she needed 24 hours to go over everything, but would call back tomorrow and go from there… In 10 months, no on from Bank of America has ever called me.. I don’t know where this will lead, but it’s a start.

Thanks John Wright!!

.

Testimonial on September 15th, 2010- John, Just wanted to THANK YOU for you’re website and the info about contacting the CEO and other B of A staff. After doing this, I am ecstatic to say I “immediately” got an approval for a loan modification after getting the run around for the MHA loan, which I was never qualified for. Thank God for you this was able to happen and I will be forever grateful! I am recommending you’re website to everyone that I know that needs help! Thanks again and may God continue to bless you!!!!

Testimonial on 09/16/10- So since sending my letter to the CEO my loan is now being serviced by the “office of the president” which is probably just a different set of cubicles but I seem to be getting somewhere FINALLY!!!! Once I talk to the loan negotiator hopefully tomorrow and get a final solution I will update you. I a grateful that I found your website, it seems to be the only thing that has helped me so far! The one good piece of news is that they have removed the sale date so I can at least sleep now!

Also, you were right, after I emailed Brian last week within a few days I received a call from Bank of America…imagine that…amazing after 10 months and no response, my very first call from BofA.

I received a call from their adversary group. He not only called once, he called 3 times and He left a full name, telephone# and extension. We spoke today, He reviewed my file and said he would assist me. I emailed him the same documents I have been sending all along that he stated were still not up to date in my file. We corresponded this afternoon.

So I have to thank you John for being an answer to prayer. I am not sure what will happen with BofA but at my lowest point of giving up, I found your blog and then you responded. I emailed to the contacts you told me to and FINALLY a real person has phoned and now exchanged emails with me. Just to have a person to speak to directly at BofA is a miracle.

I will keep you posted as I am fighting back and am going to WIN!

I have to tell you, I was skeptical about sending the email but decided to go forward with it. I mean really, what did I have to lose? I sent the email and the very next day received an email response back from CEO of B of A. Within 1 more day I was contacted by a B of A advocate and was told I was going to be refunded all the overdraft fees! My heart dropped and it felt like 10,000 lbs had been lifted off my shoulders. I could not believe what was happening. I cannot thank you and piggybankblog.com enough for the help and information you gave me. You are truly a blessing to everyone who is fighting the ongoing B of A battle! You saved me and my family from total financial doom and I will never be able to thank you enough!!

Testimonial – Since your August 5th response to my housing issue applying for a Modification Loan through Bank of America. Today we received a call from our Negotiator from B of A offering us an In House Loan instead of a HAMP Modification. This In House Loan gave us a much better interest rate and it is a fixed 30 year loan. We were surprised B of A took the time to work with us so we can save our home. Though we are unsure of our future with employment, we are holding on to what ever hope we can as so million other homeowners to stay employed or just get employed. Our hope now is to maintain the new payments without incidents and stay in our beautiful town of Alpine we love so much. As far as the John Wright vs Bank of America, I am very happy that you are taking time from your schedule to monitor John’s situation on the piggybankblog.com. He was a big help to us. His guidance was valuable and he isn’t doing this for any money, just because he wants to. His misfortune with B of A needs to turn around. Our hope is that B of A will take the time to give John Wright the help he deserves and all of the other deserving homeowners across the states.

Just a humorous update….I have given up on refinancing or modifying my loan because it just became overwhelming and ridiculous. So I have taken the approach many others are and just paying when I can. Today I was going to catch up my payments and called to make a payment over the phone and was told it would cost $20 to process!! When I asked if there was a cheaper way to do this, she offered the address so I could “overnight” my check. Really? Honestly? She didn’t offer to waive the fee or make any attempt to help me. What was I thinking? The reason I was paying over the phone is b/c BofA won’t allow you to make late payments online. They want to make sure to collect all the fees they can. I don’t have any faith that change will be in the future, but applaud all those people that have the time and energy to fight back!!! Good luck!!!!

Well, I rec’d a phone call from a Christy with BAC Friday. It was not an 800 # so curious what they have to say. I called and left a message today. My house was sold on 9/7/10 in auction even though on 8/31/10 I was told they made errors and would correct it and that I was not in foreclosure at this time. Should be interesting to see what they say.

  6. Jill says:

This TOTALLY works!!! I rec’d a phone call from the Office of the President of Bank of America today and they have escalated my case due to my complaints I emailed (including to the Federal Trade Commission) and they are reviewing my file as we speak! I’ll let you know the results.

I just was pretty much forced to sign a modification which raised my payment from 800.00 to 1123.00 What a great modification from Bank Of America. Applied in September 2009 denied due to improper paperwork in April 2010 after making all seven trial mortgage payments on time. They are the biggest bunch of liars and cheats I have ever dealt with. They first asked for my divorce papers, which I never have been divorced. Then they asked for my child support papers, I have never had any children and answered no to all these questions 5 months prier to this. Then they asked me about my job and for new check stubs!!! I had recently been laid off and was told if I was not working and could not prove I would get 9 months of unemployment there was nothing they could do!!!!! After I already had been in the process of qualifying for almost 9 months. I have stacks of papers from calling and being transferred from this person to that person. My credit is destroyed my house was in threat of foreclosure (until I signed this new agreement which I did not want to d. I have given up because their is nothing anyone small can do!!! They will always win unfortunately

  8. KEITH DOWNEY says:

My family has made every effort know to try a1nd get our mortgage modified. We signed our mortgage Dec. 1 of 2006. We were promised through countrywide that this would not be a problem. Here it is 2010 and we are about to loose our home.
We have sent hardship letters, we have used 3 so called home modification agencies.
    1. The mason Group – 1500 dollars
    2. US Loan assist – 1500 dollars
    3. Hays law center 1500 and still paying.

We dont know what to do, Bank of America has given us run around after another. We love our home and want to keep it.
It didn’t have to come to this, so why do they let it. We were asking for help years ago and never got it, just faulse promises.

  9. Perly says:

Please, very please! I have written to the “supposed” CEO, President and Director of Bank of America not once, but three times, and I am still waiting for the man to have the courtesy of an answer, if not answering the facts of my letter, at least to send me to hell, but in writing.
In my book, he is not a man. He lacks two little things to make him a man.

  10. Sherry Rossie says:

John, I want to thank you for the information you have shared and I wish I had as much fight left in me as you seem too. I did e-mail the CEO of BOfA and just like you said, I had a phone call coming in from a representative shortly after. I was so relieved that after a year I was finally going to get straight answers. The caller was simply calling to let me know I was assigned specifaclly to someone in the CEO’s office. They supplied me with a name and number and were extremly nice. I anxiously hung up and dialed the number given and I received a voicemail which kindly said “I will do my best to call you back today but it will be no longer than one business day”. I should know better than to let BofA lie and fool me again but I left a message. Gave courtesy of 72 hrs and called again. This time the vm message states” I will be out of the office but will return on Monday.” So, here we go! In the mean time I receive calls from the same people trying to say they havent been able to reach me. I told them they had and then gave them the contact info back that they gave me in the first place. Uggg! Then the mail comes and it’s a lovely letter from BofA stating they are sorry they cant reach me but here is the contact person for my case. (Same Person I have been leaving messages for) So, I try again and again and again. Still no call back. BUT low and behold I receive a Fedex pack with approval modifaction papers to sign and send back. For real! After a year? Still no call backs? Still cant get anyone to answer my questions about the papers I received! I dont just want to talk to anyone because apparently they will say anything to get yu off the phone! I want to talk to the chosen one from the CEO office who was “assigned” to me. Then I get a call from a third party telling me about a program I need to apply for since I am now no longer approved for a modification! WHAT? Which is it? All of these people seem nice, for the most part educated, and sincere but it always changes!

I have struggled through this process for almost a year now. All because I wanted to keep a roof over my childs head but I am constantly stressed, have tons more doctor bills, from Chiropractor, to Neurologists. I have seen them all! I am so surprised I even have a job after all of the time I have spent on the phone with these people. TRYING to get a straight answer!!!! They have changed the quality of life my daughter and I have experienced and I hope you stop them!! Sign me up! Im done!

    Sincerely Pissed off!

John…thank you for your most insightful information provided on this website…my house was under forclosure after a year of going back and fourth about the modification proccess, I was tired of not getting straight answers. I emailed the ceo as you suggested and I got a call a day later from a loan negotiator saying my modification was approved. I had and agent assisting me from a non profit organization and he couldnt belive how quick it happened…I’m almost certain after my email someone had to thoroughly review my file..no more run around signed the papers and got my mod!! THANK YOU SOOO MUCH!!

    9,000

I emailed the CEO in mid September and received a call the next day. It did take 2 more months to get final approval, but what the hell I had already been waiting for 10 months.
Never thought it would happen, but I tell ya one thing it wouldn’t have happened without PiggyBankBlog!

I had the same problems with BAC. Started the HMA in Febuary and still to this day had not heard anything other than my loan payment went from $2533 to $4932 after adding escrow. They told me to pay this until I get a decision. Credit went down the tubes, added stress, Notice of Intent, Etc. So, I called The State of Connecticut, Dept. of Banking to file a complaint. Now when I call BAC I speak to a customer advocate from the Office of the President. He got me a negotiator since one was not assigned to me. The negotiator can’t understand why I was assigned to him since I am not more than 4 months past due. Not really sure whats going on with this anymore. I am almost ready to give up and have my loan stay at 6 1/4%.

    Dear John,
I feel to lucky to have found your blog, lots of information and insite. We have been battling this monstrosity BOA for over a year. After reading through much of your blog I decided to write a letter to Mr. CEO at BOA, I forwarded you a copy. We will see what happens this time. Will keep you posted.

  19. Donald & Stephanie Tillman says:

    John,
just wanted to give you a quick update, already received a phone call from BOA after I shot off my e-mail lastnight. However, Mrs. Nicholas did once again request financials, stubs, bank statements, financial work sheet, this will be our 3rd time having to submit paperwork which they already have, so maybe this is just another attempt at “buying time” thus causing us to fall even further behind. We will see what happens

  20. Like many people on this website I am also going through BOA not responding to my approved loan modification. I spoke with 2 reps and about my loan modification stating that i would still be struggling to pay this new payment on time. I have stressed to both of them was this the best possible program for me. I requested for my loan modification to be reviewed again for lower payments. I was told to sign to the documents and send it in. I did and I also sent a letter stressing that i would still be struggling to make these payment on time. I was told that they would send my request to the litigation dept and the underwriter for my request. I was told by both reps that it would take over 48 to 72 hours before I would hear from them and they would call me back personally.

I have yet to receive a phone call from both reps. I called and left messages and no one returned my call. This is really getting my pressure up and I take a high dose of high blood pressure medicine. This not good for my health. I stresed to them that I am living from pay check to pay check trying to make ends meet. I am so tapped out of money. I can go on but I need help with this.

High enlightened readers of John’s wonderful website. If you were a Countrywide mortgage holder , you should read Title 12, chapter 28 U.S.C. 2506. This law is required. Who owns your mortgage? Maybe no one. Does B of A really own your mortgage?

  22. Maria Marrero says:

Another update…in october 2010, i sent an email to Mr. CEO…got a call from people in his office that they were going to assign my account with an analyst..Ms Khodayari from his office even sent me a gift card to Target apologize for lack of communication…it was to shut me up…I have tried to contact these people since before the holidays, I have called everyday, left messages, and no one has returned my phone calls. The analyst, Todd Blazey said he would call me in a week because the negotiators should have an answer about my modification…this was a week before Xmas! Jessica Letto, from the CEO office, said she would contact him to check status for me…i havent heard anything from anyone. This bank is the biggest scammers! i cannot believe how just because i emailed them, they called me to shut me up for a few months…

    Sorry, it didnt work…

I just sent a second email to Mr CEO to complain about the people in his own office!!! I am so upset and wish that I dealt with another bank like Citimortgage…they call people back and record their messages and keep tabs on their conversations with people!
    Sooooo upset!! GRRRRR!

I decided to write an email to the CEO late last night, since I wasn’t able to sleep well ever since fri 1-28 when this whole ATM “ate my money” ordeal started. The feeling of helplessness and unjust dampen my spirit and I can’t stop thinking about it. I kept asking myself what the heck did I do wrong for this to happen..

and then I saw a ray of sunshine when I got a call from sweet Anna R.-J. this morning! Although, nothing much had actually changed, it gave me some consolation knowing that someone cares n that I’m making some progress. just wanted to keep ya’ updated

hopefully I’ll have more good news to share with yall soon.

I wanted to thank you for suggesting that we email the CEO of B of A. I received a phone call two days later. The CEO assistant left voice mail messages, telling me that my case had been reassigned to Shari. Netiher one of them ever answers the phone. I also contacted my senator and emailed the white house on the same day.

Since my email to the CEO, I received a phone call from someone in the HAMP modification dept. He said he would fax docs two days ago. He told us over the phone what the docs were, so if I don’t receive anything by Friday, I will fedex the docs to his attention anyway.

We are applying under the HAMP Unemployment program. Thanks again for the info. I will keep you posted of the outcome.

    Dear John,

thanks for giving ” we the people ” a chance to voice our frustrations to the president of Bank of America. I still can’t believe it, but someone from BOA called me today. Her name was Mina Lauv, said she was the Aide to the Director of the Mortgage Division. She said she was looking at my file and noticed that I did not qualify for the making home affordable modification, but offered me other options and that she was assigning me a case worker who would be looking into my case a liitle deeper. She gave me her direct line if I had any more questions I wanted to ask. Hopes are a little higher today, but I can’t fall for the first response. I hope my case worker calls me back and that they really interested in helping me……..it’s a step, baby steps, but it’s something…….Thanks for the encouragement John……Courtney

I wanted to thank you for the advice to email BofA’s CEO.

Re: Bank of America Denied My Loan Modification – Loan # 872026361

The official MHA denial notice mentioned that I have 30-days to appeal. I would like to appeal the MHA decision and request that BOA review my finances once again. In the mean time I will be placing the property for sale. With no help in sight I will be forced to sell or let the property go into foreclosure. I am one of the victims of predatory lending violation loan programs during the housing market peak which have caused this country to be in a mess in the first place. We will certainly stand to loose both as borrower and lender.
I have been denied for a loan modification long before the unfortunate message was delivered to me. BOA kept me waiting at least 90 days before delivering the message.

As of today no one has given me a proper explanation as to why I was denied.

    1. What is wrong with my finances?
    2. What MHA guidelines caused me to be denied for a modification?
    3. What guidelines caused me to be denied for an in-house modification?

The Obama new modification programs main goal is to help reduce home owners’ monthly payment in order for the payment to not exceed 31% of the borrower’s gross monthly income. The guidelines to be met are listed below.

    * The property must be your primary residence
    * Your loan amount can not exceed a balance more than $729,750
    * You must have got the loan prior to January 1,2009
    * Your current monthly payment must be over 31% of your gross monthly income.

    4. Which one of the above guidelines have I failed? What criteria do I have to be met?

I am so confused about why you say I don’t qualify when according to Mutual Housing for New York I do? Long before all theses fraudulent and illegal denials, I have been consistently getting bumped around from several different customer service agents. I have taken several pay cuts at my current job. Utilized my retirement funds to stay afloat and yes you are fully aware that my current mortgage is over 31% of my income.

Bank of America doesn’t care about giving anyone a loan modification. It looks like the bank is going to get my house… thanks Bank of America. Bank of America is the worst lender to work with when it comes to doing a loan modification. They have no respect for their clients in hardship situation.

Bank of America have not given me any hope.

March 10 : Saw the BOA was taking out a higher payment on the 1st.Called and was told that I gave them the Ok over the phone.Went to the branch of BOA in Bloomfield Ct,spoke to the branch V.P. She was told by HAMP I gave the ok over the phone.I talked to them and thought am 2 months into a trial go ahead and place me in the program.Went home signed all the paper work and sent it out. My payments went higher because I did not have a escrow with this loan because my work is seanonal .
May 10 : phone call stating I am missing paper
    work,sent out my taxes.
June 10 : wrong paper work again.
july 10 : wrong paper work again.
Sept 10 : wrong paper work.
Oct 10 : Told I was declined, I never was sent a letter stating this.Three days later I get a letter saying ” When we talk on March 5th 2010 you did not want to take part in this program ” When asked why they kept taking the escrow out ( $623.76 per month, taxes & Ins ) They said they paid my taxes for me.
    Nov 10 : I stopped paying them.

Aug 11 : went to hire a lawyer
Dec 11 : Got a mod for my loan with FM and a saving of $128.00 ( big deal )
It the time in which this all took place my health declined,I dropped 20lb down to 140lb, had RLS.The stress of this have turned my life upside down.I stopped talking to BOA all together. They would call asking for a payment, asked if I could get money from friends,savings,401k and had one person ask me to get a part time job to earn more money. I work 60hr aweek 6 days aweek.
I now have looked into how the whole thing started.BOA in 07 over priced a investment home wjich I took money out to by this home for my wife ( now ex ).I have asked for the appraiseal which they said they dont have .
I am now having a lawyer draft up a suit on my behalf and hope to file next week.BOA also sold off one of the loans to another bank.I now have to sell my investment home which is under water.
This is my life. You can take my home but you can’t take my PRIDE !

Hi, I want you to hear my story. My husband and I were in Bankruptcy 13 and was discharged in Nov. of 2009. We received a letter from Bank of America saying that they sold our mortgage so I called the people in the letter and said that we could pay them over the phone and would be free,so we started paying BOA in Dec. of 2009 ,we paid 2 payments. In Jan.2010 a payment and Feb. payment and Mar.a payment. then received a call from BOC or Bank of America telling me I was 6 months behind in our mortgage, I told them that they made a Big mistake and said that they were right and I said this is impossible because our Bankruptcy just end in Nov. 2009 and we were current, there is NO WAY we are behind. I asked them if they ever gotten a payment from our bankruptcy trustee and they said no and I told them let me talk to the bankruptcy dept. Well I did same answer never received a payment, than I called my trustee and they said that they did get all their money and I have checks to prove that. Long story short.I had gotten all the checks from my trustee and went to the branch at Bank Of America which they said they didn’t do mortgages any more, which I knew that but they still called for me and let them know I have all the checks were paid by my trustee. They did not want them. It figured, why not,all they wanted was my house.I stopped paying when they told me all I was getting was $43.00 on my principle of my loan. I was so upset, angry and my husband was too.I tried to get a modification on our home and never spoke twice to the same person.I did this all of 2010 and 5 months of 2011. I was on the internet and saw this attorney and called him and he answered and said he could help me.My husband and I finally were relieved of so much pressure. We were looking at a foreclosure But I called BOA and asked them for copies of my deed and guess what happen they dropped the foreclosure proceeding. All I asked this attorney was to get my 6 months that I should get credit back and if he could and he said he could get us a mortification. He had a fee of $3500.00 I asked him if we could pay half and the other next month. I told him we are on a fixed income. That we were both on disability, My husband had a great job operations manager and he flipped a four wheeler. He had 3 operations. So he said that would be OK. Well we had to scrap for the money but he got it all. Months went by and he was doing what I had done in 2010 and part of 2011 . He called us up for more money and I told him you told us all we needed was $3500.00. He said no I did not. well $3500.00. down the drain . Time went

  31. Lynnie says:

I will finish. I must of hit the wrong button. Time went on and on and I received another foreclosure and we did’t know what to do. When I had gotten that attrorney. I failed to tell you that the first person who answered the phone was this guy who would get people for him. Then he gave me his number. Now being despite I called these people back and told them what happened between him and us.They told us that they could help us and just do the math work and get our modification. Going to the clerk of courts office, they said there would fax me a paper for a continuous and they did and we got one,but we paid $500.00 for that and wants $375.00 each month until they get that modification. Now we were desperate
but not that desperate. I thinking how we should get our money back from that attorney. Well I went on line and saw attorney general office. I called and they connected me to an officer and I told him what happen and he said they scammed us and he told me to file a complaint to him and that all the money I paid I would get it back. I was shocked and he also gave me a number to call for help and I did and it does not cost nothing. He told me how many people are like me and also PRESIDENT OBAMA PUT THIS LAW 2 YEARS AGO IN PLACE FOR EVERYONE THAT IS IN THE SAME SITUATION AS MY HUSBAND AND I. ALL YOU NEED TO DO IS CALL YOUR ATTORNEY GENERALS OFFICE AND THEY WILL GUIDE YOU FROM THERE. WE HAVE A DATE TO APPEAR WITH A
ATTORNEY FOR FREE AND IS GOING TO TAKE OUR CASE.
PLEASE PASS THIS ON TO SOMEONE THAT NEEDS HELP JUST LIKE WE DID.

I believed it to be a deposit made from a business partner. I contiually asked the bank rep if everything is good on his end he said yes, the money was spent on my family and bofa says its all my fault theyve ruined my credit and I cant have an account anywhere, please let me know what I can do. thanks

      Hi Josh!
      .
I am not an attorney. So please do not take anything I am saying right now as any kind of legal advice. However — with that being said — you should contact an attorney in the event that you do need legal advice.
      .
It is my understanding that there is not much you can do. This is even though it was their mistake on their end. It is sort of a money in and money out kind of thing. We should always be able to account for what we have deposited and what we have not deposited. The bank making a mistake on accounting will not mean that it will be considered free money to spend on your end. They will feel that you should have put the money to the side if you knew it did not come from you. Or — at the very least — be able to pay it back when they found their mistake.

Although my problem wasn’t nearly as dire as the ones I’m reading about and I didn’t find this website until I found the magic solution, I did want to confirm that directly emailing the CEO works wonders. My issue was an accidentally doubly deposited (ATM to BoA and by mobile app to my husband’s bank) check for $400 from my mother in law made out to my husband. (She’d written us each one in the same amount and I grabbed the wrong one.) We’d deposited them both on the same day (12/31/12), and I realized my error five days later (1/4/13) when I saw the check made out to me on the table. I immediately called BoA to tell them of the error and thus began a 7 1/2 month long ordeal. In short, my husband’s bank took the money from his account in late January, BoA took it from my account on Feb. 8, and then…the $400 disappeared. It didn’t go back to my mother in law’s bank, it was NOWHERE. Then there were months of a series of multiple phone calls, letters, visits to the bank, my husband and mother in law having to visit their banks multiple times, more phone calls, etc., etc. I can’t even estimate how many hours on our part this took all of us to work on this–enough to add up to a week, I’d imagine, and am not exaggerating. And while my husband’s bank and mother in law’s bank could provide documentation stating that they didn’t have the money, BoA, naturally, couldn’t–they claimed that the documents were “proprietary.” Two weeks ago–seven months after this all started, I was told by my local BoA agent to write a formal letter–because he’d concluded that BoA had the money–requesting the money back and got a letter back from BoA stating that they agreed with their original investigation–that they didn’t have the money–and to have my mother in law’s bank call them. They did and were told, nope, *I* had to call them, and I lost my $hit. I was advised to write letters to all BoA execs and found a website recommending to email the CEO. I did last Wednesday, got a call from his office on Thursday, and the money was returned to my account yesterday. Insane. I’m thrilled that it’s over but incensed that this is what it took. But, long story short: EMAIL THAT ADDRESS. IT WORKS WONDERS! And as an aside, I am moving all my accounts to PNC now that this has been resolved. Screw BoA.
