On 06/04/11 Stephanie wrote:   John, I can’t thank you enough for your assistance you provide other B of A mortgage holders.  Because of the information your site provides, our family was able to get a fixed loan at 2% for the first 6 years and it ramps for the next 4, capping at 4.875%.  We had been in the process since Jan 15th of 2010, and because of you our process was escalated so rapidly.  If I can offer anyone advice, know that when customers contact the CEO’s office, you will receive the best customer care B of A could provide.  They have an entire division devoted to people who write to him!  Another big key for us that you always need to be sure that your mortgage stands in the same division to avoid being tossed from dept to dept.  Meaning, if you are current, stay current. If you are 30 days behind, never pass to the 31st day or they will transfer your paperwork to a different department.

On December 28th, 2010 Michael Lee:  John, I just received a call from Richard Lara at BOA and they are going to refund every cent they charged me. He was super nice and I thanked him, kind of shocked that it actually happened. This would not have been possible without your help and you standing up for us that have loans with BOA. I think you are a great person for taking your own time to help people like me after many many calls to BOA that left me angry and defeated. I am huge fan of yours now.

Kristin Potter wrote on 12/19/10: I contacted you a long time ago as I was in the same boat as you, and just wanted to let you know that after nearly a year and a half Bank of Screwing America FINALLY modified our loan. It took a lot of phone calls, emails and letters to BofA, it’s CEO, my senators and state reps, but we got it. BofA continues to send us monthly statements with the old payment on it, which is a testament to their laziness and unwillingness to follow through on anything. How this bank is still in existence is beyond me. They’re the most incompetently run business I’ve ever had to deal with.

Testimonial on 02/10/11: I wanted to thank you for the advice to email BofA’s CEO.  I emailed BofA on 2/7/2011. I received a call from BofA’s president’s office a day later, telling me that the bee’s hive had been stirred.  I received a phone call from a manager in the modification department the same day; she apologized for the lack of customer service. She told me she would call me back in a couple of hours and let me know what they could do for me. I received a call back within an hour with an offer to modify my loan. I couldn’t believe it. We just got done what has taken me 10 months to get done with one email. WOW!!  I start my trial period next month and have contact info for the direct decision makers for my file now. I will keep you posted, any advice from this point would be appreciated :-) Words can’t explain how thankful me and my family are to you. You are making dreams come true one person at a time. Testimonial November 15th, 2010: Hi John,    Just wanted you to know the progress of my loan modification and what BofA has decided to do. They just recently sent me a new modified proposal. I am shocked. They changed my interest rate from 6.35% to 4.5% which lowers my payments by $200.  The $5,000 in fees etc, will be tacked on to the end of the loan. I requested they corrected the all the lates on my credit reports which they did.  I don’t think I would have gotten this new modification without your input, info and supporting you in your fight…..so I thank you.     

 Some of my friends have jumped on the “Produce the Deed”, “Forensic Auditing” and Robo Signing procedures to stop their foreclosures. I pray for them and everyone else in modified/foreclosure predicaments.  I’ll keep you posted as I’m still waiting for the final paperwork of this new proposed modification.

Testimonial October 21st 2010:Dear John, On October 15, 2010 we received a letter informing us that our house was in foreclosure, It hit us like a bucket of ice cold water and dealing with the B of A has been a nightmare.  Every time we called it would be a different answer to the same questions.  Since April 2010 we had been told that our file was with the underwritter for review on our loan modification to keep checking in and continue doing the trail payments.  According to their records we were denied on June 10, 2010 and the letter of deniel did not have a reason for the denial.  Called in and was told that it had been sent out by mistake, it had been computer generated to alot of people, like myself, and who were also calling in.  So, disregard letter and continue with trial payment.  Which we did, so when we recived letter of foreclosure we were very surprised and confused.  Not knowing what to do and not getting straight answers from B of A, I took to the website and found yours.  Now, I have to admit that at first I was very skeptical thinking sending an email to the CEO had to be a hoax and to think that if in fact it was an excisting email account, he would not get back to us.  But low and behold, we have gotten a call from a representative for the CEO who has now flagged our file and move to presidential level! Will have a senior negotiatior assigned to us and will only be dealing with that person from now on. Wow! Needless to say we are relieved to have our file in review once again and hopefully get the answer we’re hoping for.  Thank God and bless you for giving us the information we desperatley needed to head in the right direction. Regular Joe’s like us have no idea where to head after a big bully like B of A tries to take advantage but you helped tremendously.  And I have been passing your website to whoever I know needs help. I received a call from their adversary group.He not only called once, he called 3 times and He left a full name, telephone# and extension. Since your August 5th response to my housing issue applying for a Modification Loan through Bank of America. Today we received a call from our Negotiator from B of A offering us an In House Loan instead of a HAMP Modification.  This In House Loan gave us a much better interest rate and it is a fixed 30 year loan.  We were surprised B of A took the time to work with us so we can save our home. Though we are unsure of our future with employment, we are holding on to what ever hope we can as so million other homeowners to stay employed or just get employed.  Our hope now is to maintain the new payments without incidents and stay in our beautiful town of Alpine we love so much.   As far as the John Wright vs Bank of America, I am very happy that you are taking time from your schedule to monitor John’s situation on the piggybankblog.com. He was a big help to us.  His guidance was valuable and he isn’t doing this for any money, just because he wants to.  His misfortune with B of A needs to turn around.  Our hope is that B of A will take the time to give John Wright the help he deserves and all of the other deserving homeowners across the states.

    Just a humorous update….I have given up on refinancing or modifying my loan because it just became overwhelming and ridiculous. So I have taken the approach many others are and just paying when I can. Today I was going to catch up my payments and called to make a payment over the phone and was told it would cost $20 to process!! When I asked if there was a cheaper way to do this, she offered the address so I could “overnight” my check. Really? Honestly? She didn’t offer to waive the fee or make any attempt to help me. What was I thinking? The reason I was paying over the phone is b/c BofA won’t allow you to make late payments online. They want to make sure to collect all the fees they can. I don’t have any faith that change will be in the future, but applaud all those people that have the time and energy to fight back!!! Good luck!!!!

    Got a call from my loan executive and (of course) I was turned down from HAMP but they offered me an
    “In House” Loan
    Terms: 30 year 1st 5 years at 2%, 6th at 3% and 7th at 4.25% and staying there fixed Payment -500 from original

    Subject ot final approval of “Upper Management” at BofA. Was told that Fannie had already approved…
    Not holding my breath, but I’m still shocked. After 9 months of nothing..
    Will update whenever I get a Final Approval or Denial

    Well, I rec’d a phone call from a Christy with BAC Friday. It was not an 800 # so curious what they have to say. I called and left a message today. My house was sold on 9/7/10 in auction even though on 8/31/10 I was told they made errors and would correct it and that I was not in foreclosure at this time. Should be interesting to see what they say.

    This TOTALLY works!!! I rec’d a phone call from the Office of the President of Bank of America today and they have escalated my case due to my complaints I emailed (including to the Federal Trade Commission) and they are reviewing my file as we speak! I’ll let you know the results.

    I just was pretty much forced to sign a modification which raised my payment from 800.00 to 1123.00 What a great modification from Bank Of America. Applied in September 2009 denied due to improper paperwork in April 2010 after making all seven trial mortgage payments on time. They are the biggest bunch of liars and cheats I have ever dealt with. They first asked for my divorce papers, which I never have been divorced. Then they asked for my child support papers, I have never had any children and answered no to all these questions 5 months prier to this. Then they asked me about my job and for new check stubs!!! I had recently been laid off and was told if I was not working and could not prove I would get 9 months of unemployment there was nothing they could do!!!!! After I already had been in the process of qualifying for almost 9 months. I have stacks of papers from calling and being transferred from this person to that person. My credit is destroyed my house was in threat of foreclosure (until I signed this new agreement which I did not want to d. I have given up because their is nothing anyone small can do!!! They will always win unfortunately

    My family has made every effort know to try a1nd get our mortgage modified. We signed our mortgage Dec. 1 of 2006. We were promised through countrywide that this would not be a problem. Here it is 2010 and we are about to loose our home.
    We have sent hardship letters, we have used 3 so called home modification agencies.
    1. The mason Group – 1500 dollars
    2. US Loan assist – 1500 dollars
    3. Hays law center 1500 and still paying.

    We dont know what to do, Bank of America has given us run around after another. We love our home and want to keep it.
    It didn’t have to come to this, so why do they let it. We were asking for help years ago and never got it, just faulse promises.

    Please, very please! I have written to the “supposed” CEO, President and Director of Bank of America not once, but three times, and I am still waiting for the man to have the courtesy of an answer, if not answering the facts of my letter, at least to send me to hell, but in writing.
    In my book, he is not a man. He lacks two little things to make him a man.

    John, I want to thank you for the information you have shared and I wish I had as much fight left in me as you seem too. I did e-mail the CEO of BOfA and just like you said, I had a phone call coming in from a representative shortly after. I was so relieved that after a year I was finally going to get straight answers. The caller was simply calling to let me know I was assigned specifaclly to someone in the CEO’s office. They supplied me with a name and number and were extremly nice. I anxiously hung up and dialed the number given and I received a voicemail which kindly said “I will do my best to call you back today but it will be no longer than one business day”. I should know better than to let BofA lie and fool me again but I left a message. Gave courtesy of 72 hrs and called again.This time the vm message states” I will be out of the office but will return on Monday.” So, here we go! In the mean time I receive calls from the same people trying to say they havent been able to reach me. I told them they had and then gave them the contact info back that they gave me in the first place. Uggg! Then the mail comes and it’s a lovely letter from BofA stating they are sorry they cant reach me but here is the contact person for my case. (Same Person I have been leaving messages for) So, I try again and again and again. Still no call back. BUT low and behold I receive a Fedex pack with approval modifaction papers to sign and send back. For real! After a year? Still no call backs? Still cant get anyone to answer my questions about the papers I received! I dont just want to talk to anyone because apparently they will say anything to get yu off the phone! I want to talk to the chosen one from the CEO office who was “assigned” to me. Then I get a call from a third party telling me about a program I need to apply for since I am now no longer approved for a modification! WHAT? Which is it? All of these people seem nice, for the most part educated, and sincere but it always changes!

    I have struggled through this process for almost a year now. All because I wanted to keep a roof over my childs head but I am constantly stressed, have tons more doctor bills, from Chiropractor, to Neurologists. I have seen them all! I am so surprised I even have a job after all of the time I have spent on the phone with these people. TRYING to get a straight answer!!!! They have changed the quality of life my daughter and I have experienced and I hope you stop them!! Sign me up! Im done!

    I am still in review and now I am told that my payment will go up $2000 in November for escrow… I have always paid my taxes separate and every time I went to pay them at
    the town borough I was told my mortgage company paid them… who asked them to?? I know in the end they will probably deny my modification and now I have to dish out

    I had the same problems with BAC. Started the HMA in Febuary and still to this day had not heard anything other than my loan payment went from $2533 to $4932 after adding escrow. They told me to pay this until I get a decision. Credit went down the tubes, added stress, Notice of Intent, Etc. So, I called The State of Connecticut, Dept. of Banking to file a complaint. Now when I call BAC I speak to a customer advocate from the Office of the President. He got me a negotiator since one was not assigned to me. The negotiator can’t understand why I was assigned to him since I am not more than 4 months past due. Not really sure whats going on with this anymore. I am almost ready to give up and have my loan stay at 6 1/4%.

    we bought our home in calif for 455.000 it is now worth 255.000, we bought in 2005, and are on an interst only loan, we got behind due to an illenss in the family, we have been modifying for 2 years now, and hired an attorney 2 years ago, how ever even though she claims the underwriter has had it for a month now, we still havent heard a word, we are barely making it with these high payments, yet attorney said dont be late keep paying were almost there?? we need to file a bank rupsy, but im told we cant right now, even though our bills exceed what we make , any suggestions? desperate!!!

I spoke with 2 reps and about my loan modification stating that i would still be struggling to pay this new payment on time. I have stressed to both of them was this the best possible program for me. I requested for my loan modification to be reviewed again for lower payments. I was told to sign to the documents and send it in. I did and I also sent a letter stressing that i would still be struggling to make these payment on time. I was told that they would send my request to the litigation dept and the underwriter for my request. I was told by both reps that it would take over 48 to 72 hours before I would hear from them and they would call me back personally.

    I have yet to receive a phone call from both reps. I called and left messages and no one returned my call. This is really getting my pressure up and I take a high dose of high blood pressure medicine. This not good for my health. I stresed to them that I am living from pay check to pay check trying to make ends meet. I am so tapped out of money. I can go on but I need help with this.

    High enlightened readers of John’s wonderful website. If you were a Countrywide mortgage holder , you should read Title 12, chapter 28 U.S.C. 2506. This law is required. Who owns your mortgage? Maybe no one. Does B of A really own your mortgage?

    Another update…in october 2010, i sent an email to Mr. CEO…got a call from people in his office that they were going to assign my account with an analyst..Ms Khodayari from his office even sent me a gift card to Target apologize for lack of communication…it was to shut me up…I have tried to contact these people since before the holidays, I have called everyday, left messages, and no one has returned my phone calls. The analyst, Todd Blazey said he would call me in a week because the negotiators should have an answer about my modification…this was a week before Xmas! Jessica Letto, from the CEO office, said she would contact him to check status for me…i havent heard anything from anyone. This bank is the biggest scammers! i cannot believe how just because i emailed them, they called me to shut me up for a few months…

    I just sent a second email to Mr CEO to complain about the people in his own office!!! I am so upset and wish that I dealt with another bank like Citimortgage…they call people back and record their messages and keep tabs on their conversations with people!
    Sooooo upset!! GRRRRR!

    OMG ,B O America actually cares,
    I decided to write an email to the CEO late last night, since I wasn’t able to sleep well ever since fri 1-28 when this whole ATM “ate my money” ordeal started. The feeling of helplessness and unjust dampen my spirit and I can’t stop thinking about it. I kept asking myself what the heck did I do wrong for this to happen..

    and then I saw a ray of sunshine when I got a call from sweet Anna R.-J. this morning! Although, nothing much had actually changed, it gave me some consolation knowing that someone cares n that I’m making some progress. just wanted to keep ya’ updated

    hopefully I’ll have more good news to share with yall soon.

    Hello John,

    I wanted to thank you for suggesting that we email the CEO of B of A. I received a phone call two days later. The CEO assistant left voice mail messages, telling me that my case had been reassigned to Shari. Netiher one of them ever answers the phone. I also contacted my senator and emailed the white house on the same day.

    Since my email to the CEO, I received a phone call from someone in the HAMP modification dept. He said he would fax docs two days ago. He told us over the phone what the docs were, so if I don’t receive anything by Friday, I will fedex the docs to his attention anyway.

    We are applying under the HAMP Unemployment program. Thanks again for the info. I will keep you posted of the outcome.

    thanks for giving ” we the people ” a chance to voice our frustrations to the president of Bank of America. I still can’t believe it, but someone from BOA called me today. Her name was Mina Lauv, said she was the Aide to the Director of the Mortgage Division. She said she was looking at my file and noticed that I did not qualify for the making home affordable modification, but offered me other options and that she was assigning me a case worker who would be looking into my case a liitle deeper. She gave me her direct line if I had any more questions I wanted to ask. Hopes are a little higher today, but I can’t fall for the first response. I hope my case worker calls me back and that they really interested in helping me……..it’s a step, baby steps, but it’s something…….Thanks for the encouragement John……Courtney

    I wanted to thank you for the advice to email BofA’s CEO. I emailed BofA on 2/7/2011. I received a call from BofA’s president’s office a day later, telling me that the bee’s hive had been stirred. I received a phone call from a manager in the modification department the same day; she apologized for the lack of customer service. She told me she would call me back in a couple of hours and let me know what they could do for me. I received a call back within an hour with an offer to modify my loan. I couldn’t believe it. We just got done what has taken me 10 months to get done with one email. WOW!! I start my trial period next month and have contact info for the direct decision makers for my file now. I will keep you posted, any advice from this point would be appreciated :-) Words can’t explain how thankful me and my family are to you. You are making dreams come true one person at a time. Keep up the good work God Bless!!!!!!!!!

    The official MHA denial notice mentioned that I have 30-days to appeal. I would like to appeal the MHA decision and request that BOA review my finances once again. In the mean time I will be placing the property for sale. With no help in sight I will be forced to sell or let the property go into foreclosure. I am one of the victims of predatory lending violation loan programs during the housing market peak which have caused this country to be in a mess in the first place. We will certainly stand to loose both as borrower and lender.
    I have been denied for a loan modification long before the unfortunate message was delivered to me. BOA kept me waiting at least 90 days before delivering the message.

    As of today no one has given me a proper explanation as to why I was denied.

    1. What is wrong with my finances?
    2. What MHA guidelines caused me to be denied for a modification?
    3. What guidelines caused me to be denied for an in-house modification?

    The Obama new modification programs main goal is to help reduce home owners’ monthly payment in order for the payment to not exceed 31% of the borrower’s gross monthly income. The guidelines to be met are listed below.

    * The property must be your primary residence
    * Your loan amount can not exceed a balance more than $729,750
    * You must have got the loan prior to January 1,2009
    * Your current monthly payment must be over 31% of your gross monthly income.

    4. Which one of the above guidelines have I failed? What criteria do I have to be met?

    I am so confused about why you say I don’t qualify when according to Mutual Housing for New York I do? Long before all theses fraudulent and illegal denials, I have been consistently getting bumped around from several different customer service agents. I have taken several pay cuts at my current job. Utilized my retirement funds to stay afloat and yes you are fully aware that my current mortgage is over 31% of my income.

    Bank of America doesn’t care about giving anyone a loan modification. It looks like the bank is going to get my house… thanks Bank of America. Bank of America is the worst lender to work with when it comes to doing a loan modification. They have no respect for their clients in hardship situation.

    Bank of America have not given me any hope.

    John, This is my story in a nut shell.

    Nov. 09 : Called HAMP to ask about the program.
    Dec 09 : Was sent a package from HAMP,did not like what I saw and never singed or sent in any paper work.
    March 10 : Saw the BOA was taking out a higher payment on the 1st.Called and was told that I gave them the Ok over the phone.Went to the branch of BOA in Bloomfield Ct,spoke to the branch V.P. She was told by HAMP I gave the ok over the phone.I talked to them and thought am 2 months into a trial go ahead and place me in the program.Went home signed all the paper work and sent it out. My payments went higher because I did not have a escrow with this loan because my work is seanonal .
    May 10 : phone call stating I am missing paper
    work,sent out my taxes.
    June 10 : wrong paper work again.
    july 10 : wrong paper work again.
    Sept 10 : wrong paper work.
    Oct 10 : Told I was declined, I never was sent a letter stating this.Three days later I get a letter saying ” When we talk on March 5th 2010 you did not want to take part in this program ” When asked why they kept taking the escrow out ( $623.76 per month, taxes & Ins ) They said they paid my taxes for me.
    Nov 10 : I stopped paying them.
    Nov 10 : wrote the CT AG’s office.
    Dec 10 : Got a call from AG’s office stating they will look into this and I would hear from BOA.That night BOA called and told me they would look into this.
    Jan 11 : Got a letter from BOA the CEO’s office telling me everything is my fault and I ” did not make timely payment for the trial period ” BOA took the money out on the 1st of each month,how could I be late ?
    Feb 11 : Started sending out e-mails too the White House,each e-mail was not the same.
    Aug 11 : Got a call from the Department of Treasury stating they will look into this.
    Aug 11 : went to hire a lawyer
    Dec 11 : Got a mod for my loan with FM and a saving of $128.00 ( big deal )
    It the time in which this all took place my health declined,I dropped 20lb down to 140lb, had RLS.The stress of this have turned my life upside down.I stopped talking to BOA all together.They would call asking for a payment,asked if I could get money from friends,savings,401k and had one person ask me to get a part time job to earn more money. I work 60hr aweek 6 days aweek.
    I now have looked into how the whole thing started.BOA in 07 over priced a investment home wjich I took money out to by this home for my wife ( now ex ).I have asked for the appraiseal which they said they dont have .
    I am now having a lawyer draft up a suit on my behalf and hope to file next week.BOA also sold off one of the loans to another bank.I now have to sell my investment home which is under water.
    This is my life.You can take my home but you can’t take my PRIDE !
