I work for the hope team and we are supposed to be helping people with the documents that BOA requires for the Home Mods all I can say is that they are so wrong with the way they ask for the same information over and over again I am at my ropes end and I have to keep my job because there are no other jobs in my area but I could bury them for you I have so much exposure to the asking over and over for the same documents and this is even with us being able to veiw the documents right on the system we can call BOA for the Borrower and tell the straight out that the documents are in and they will still tell people they have to send them again if you need to talk to me or need my insite leave an email on this site for me and I will send you mine.

Donald Reed wrote CEO: John, I sent the following to Bank of America today: In August, 2009, BAC Home Loans assumed my Taylor, Bean and Whitaker VA mortgage. TBW was to stop receiving mortgage payments on August 5 when the note was transferred to BAC. Unfortunately, BAC didn’t send the notification letter until August 23. Unaware that there was a change, I made my payment to TBW, which they accepted. Since I paid TBW after the loan was transferred to BAC, my August 2009 payment wasnot applied to my account. To this date it has still not been applied.
Consequently, as far as BAC is concerned, I am one month behind. Beginning in September, I made repeated attempts to clear this up with BAC. Initially they indicated they were aware that many customers were in the same position as I, and that they will apply the payments to the accounts as soon as they get the money from BAC, which should be by mid October. October came and went and my payment still wasn’t applied. I called again and got a new story about the funds being delayed, but it should be cleared up soon. Well, here we are in April of 2010 and my payment still has not been applied. In March I provided evidence of the payment to TBW. I was then informed that wasn’t sufficient. I was then instructed to produce cancelled checks and bank statements for ALL months from August until now. It is clear to me BAC has no intention of making this right any time soon, and are simply asking me to jump through hoops to buy time. I find the request for all my bank records unnecessary, excessive and unacceptable. I provided BAC with evidence of my August payment to TBW, and a simple glance at my transaction history is sufficient to see it wasn’t applied to my account. I know from my research there are numerous other people with experiences that mirror mine, and they also have had no resolution. Surely the conduct of BAC is not in the public interest.

LEAH SCHOOLER – WROTE CEO: This is a complaint that I have verbalized multiple times over the past several years regarding my morgage…since BoA took over my CountryWide mortgage. every month for some reason my electronic payment is not accepted and on the off chance that it is accepted it is never posted to my acct. Mysteriously my acct always remains 3 months past due. Imagine that! How convenient that you have managed to destroy my credit. JACOB AND THERESA LOERA WROTE CEO: I called B of A May of 2009 was told what to send them to do a loan mod was told they’d get back to me within 30 days a lie I called was told if i called in in would delay things waited nothing called again was told the same thing. In August of 2009 I was contacted for updated info sent it immediatedly was told again will be contacted in 30 days didn’t happen finally i hired Nationwide Financial to help us they put a finicial package together sent it out immediatedly they kept in contact with B of A and was told it was being reviewed then they were told less than 7 days before that there was to be a sherriffs sale they asked for it to be cancelled and was told ok they asked for written confirmation they were told they would have it by 5 p m on february 4th didn’t happen on the morning of feb 5th at 9:30 a m they were told if we didn’t western union $13,000 by ten a m to bad we were at work there was no way Joe Bohlin from Nationwide asked them to give us a week and they refused we were evicted and now were displaced we make $77,000 a year since I (Theresa) Moved in Last April to help my son straighten things out They never reviewed a thing they strung it along till they could foreclose. Nice way to do business and help people by lying to them. You’ve displaced a family who was trying to straighten things out. I have a hndicapped daughter we took along with me who has lost weight & now weighs 62lbs and is 5’2 because of the uoheavel and upset. Hope you people are happy we’ve put so much money for storage and rent to people that it’s not funny you guys should be happy with yourselves for what you do to familys who are lied to by your company. We want our house back and will go to anyone do everthing we can to make sure this kind of crap stops. i’ve contacted the attorney General the President the media and i’m not stopping till this is made right. I’ve gotta big mouth and a lot of determination to do whats right for my family. Phuong N. Tran wrote CEO: Dear CEO Brian Moynihan, I know this is a long shot but I am going to try anyway, sir. I’m writing to express my stressful situation and disappointment toward Bank of America Lost Mitigation Department. I bought my house in 2005 with my ex-partner. However, I am on the loan by myself. With the advice of my real estate agent at the time and the promise to help securing a loan with a large amount of down payment, around $300,000 from my 1031 exchange, I and my partner made what turned out now is an ill-advised purchase. Now the real estate market had crashed and the value of this house has decreased by at least 40%. My partner had probably foreseen the future of the weak real estate market so he abruptly walked away from his mortgage commitment leaving me a single mother of two struggling with a large mortgage bill. In addition to this, I also got hit with a salary reduction from my employment. As a result, I have drained all my savings just to keep up with the mortgage. I also got financial help from my immediate family members, and I had to cut down on all unnecessary spending including pulling my kids out of day care and sold my only car, however, the financial help was a temporary fix and there is nothing else that I can think of to cut, and as a result I am still overwhelmed. Since purchasing this house I have been very responsible on paying my mortgage. I have never late on a single mortgage payment before April of 2009. However, after the real estate crashed down and my partner of 5 years walked away from his obligation around November of 2008, I assumed sole responsibility and still paid my mortgage bill on time up to April of 2009, however, I could not keep up with my mortgage any more as of early April of 2009 because I have drained all my resources. After the first month that I fell behind on my mortgage, I tried in vain contacting Bank of America Lost Mitigation Dept. and filing an application to request for a loan modification right away. The whole process was painful one. And through out the process until now, very time I call I got the run around and different information from different associates and as a result this has been dragging out for over a year without an answer. I’ve been calling them every other week. No one could give me the answer of what my loan modification status is. I am now constantly living in fear of losing my home to foreclosure. I would like Bank of America and its’ CEO know that my house means a lot to me and my two kids. I have been working very hard to get my American dream home for my kids to grow up in with. To us this is our first permanent home which we would like to stay in it for long time. They got used to their school and the neighborhood they are in now. They involved in with many activities in the local area and they enjoyed each of the parks in the area. I can’t put in words how much my kids love this home and the neighborhood that we live in. If we are going to loose this home to foreclosure it would be a heart-broken for us and especially my kids. In the past few months, we have been living in nervous, fear, distress, and very uncertain. We pray to god every night that our loan would get modified so we can move on with our lives. We love this house, its’ neighbor and the area. My kids will be very disappointed if we can’t keep this house. And I can’t imagine how chaos our lives would be if this house is going to be foreclosed. Especially being a single mother and trying to maintain a good environment for my children. Our future is in your hand so please help a responsible home owner. Please help us to remain in our only home with a loan modification. I feel that a loan modification would benefit us both. Currently my house is only worth around $754000 according to Zillow.com web site. The home’s value is way below what we owe. This value is only for the area. I believe the internal value of the house is even lower because of the way it was built and the materials that were used to build it with. Although this house was new when I purchased it, but now according to experts and general contractors, the house was not properly built. The builder used cheap materials to build this house and as a result this house is falling a part slowly and we have to play catch up as far as fixing it as we go. We have been calling the builder to fix thing around this house since we moved in. We fixed the leaking roof. Kitchen’s tile floor needs to be replaced. Many tiles on the main entrain also need replacement. Our living room windows are still leaking until this day which also damaged the hardwood floor with water coming in during raining season. The pluming inside the wall in our basement was leaking and damaged all the dry walls. Stains are still visible. Sewage clogged up every now and then and overflow in our garage create a very toxic smell. In addition, there is a major problem with this property which is the underground water that runs from our back yard through the underneath the foundation since this piece of property is sitting on a down hill lot. Even during the summer, the underground water still comes up in our backyard. During raining season the excessive rain water and underground water rush into our basement and deposit in the garage. With all these problems we are still willing to work with Bank of America to keep this house. Currently my family members are willing to help me financially in fixing up all the problems in this house to bring it up to its’ standard, but we can’t go on since we don’t know the future of this house. My family members are willing to help us with the cost of repair but they won’t do that until they know if we are going to be in this house. We would appreciate it very much if Bank of America can work with us to lower our payment and principle if possible so we can keep our home. Bharathi B. Devi,Ph.D.wrote CEO: To CEO Brian Moynihan: Here is my very recent experience with BOFA and it is almost similar to what Mr. Johns Wright has written in Complaints Board.Com. I requested for loan modification via HUD in July 2009 when I was unemployed. Afterwards, I would get a call, once in a while, assuring that they were working on my case. In February this year, without informing me the reason, they suddenly included escrow with my interest only mortgage. When I called, they told me that it is because I would be getting the loan modified and I would receive a reduced payment coupon within a few days..
But, instead, on March 19th they mailed me a package, requesting my financial information, to be completed and returned by April 17th. I mailed it back promptly in their prepaid FedEX envelope on the 29th which they received on March 30th, and for which I have all the proof. When I called in the middle of April to enquire about the status of my application, they could not find any information about my returned papers anywhere in their system. When I told them that they had received it on the 30th of March, they told me that they had received it and a loan officer was working on that. I called again on 27th April and I was tossed from department to departmentin the three hours time, including a debt collection department where they told me I was current on my payment. One person told me that I was declined as they could not go any lower than the interest ceiling. Another told me that I was declined before they sent the package and now they were freshly looking at my papers and I need to call during the first week of May. The person who was supposed to handle my account told me that she did not have any info about my application and if I was interested in the Loan modification, then I should contact HUD!

Finally, we reached a representative who told us that my request for Home Affordability was declined on March 20th (the very next day of their mailing me the package, which happens to be Saturday). When I asked what happened to the package that I had mailed, she not only did not have the information, but told us that a separate department decided to decline based on the earlier financial information that I had given to them over the phone, which I simply do not recall as they never called me to collect my financial status at all. So, she told us, if I was interested in the Loan Modification, I need to apply again. I applied again. When enquired how long it would be before I hear from them, she told us that she was not sure as they were swamped with applications.
My HUD representative realized the arrogance of BOFA within one session itself that, she recommended that I contact the Attorney General of California, which I did.

I have always been regular in payment. But, I am currently under employed, with my home payments reaching nearing 40% of my salary when my I/O mortgage will reset in August. If you do not do the modification my only choice is default. I support John Wright vs. BofA Lawsuit! I may even join him, if I can.

Update: Bharathi wrote on 07/08/10: Hi John, That is the new BOFA specific requirement (as it is not the federal requirement) that will rule out many federally eligible homeowners! In the last two calls, they have added this BS! But, even when they say they would mail me the application within ten days, they have not done that!

Randy Silva wrote CEO: Brain: My name is Randy Silva. I’m writing this email to you to inform you that like others I SUPPORT John-Wright vs. BofA. I have experienced nothing but problems with your bank ever since Country Wide sold you my mortgage. It’s been a year now that we have tried to get things right. We have gotten letters saying we were back in payments. I filed all the necessary papers to modify my loan. Then we made contact with someone in your bank and if you need to know I have all of the letters and dates that we have made contact and TRIED to get BofA to help us. “We were back in payments”, we got letters saying to catch up or we will face foreclosure. We tried to get a loan only to find out that YOU BofA gave us a bad score, and our credit report got shot down from a very high 750 down to a low 550. We went through our life savings to catch up on our mortgage. All this time we kept making contact with agents of your bank. All we got was a lot of BULL. They told us that we qualify for the reduction and that papers would be sent to us and to make sure that we send the paper work back. Because we live in Hawaii some way you got it a little past the required deadline. Did you check the stamped date? I guess not. It was sent to you before the closing date. We argued about that too. Only to be declined and reapply. We did that too. Again trying to make contact with your departments. But like others put on hold, and made false promises. Again we qualified! We have been in contact with several operators of yours and they tell us we qualified. I said so what’s next? Again, “we will be sending you a package with the required documents and you need to feel it out and send it back.” Up to this day we have got nothing but the same problem, getting bigger. Why I say that is this. We got a letter which I hold saying thanks for catching up with your payments and we will try to assist you now. The very next month after taking out all of our monies and catching up with this payments we get our statements saying we are again back in payments. YOUR bank is more confused then any business that I’ve dealt with. I can’t get anyone there to complete my reduction in mortgage. All I get is “you qualify, we’ll review your account and send you another package with the reduction payments”. That has never happened. I too like John Wright will seek whatever means I need to somehow settle this with you. Randy Silva.
Update 06/09/10 Randy wrote: Sergio, I simply can’t believe how unorganized BofA is. Matrece Thorton contacted me today and is again requesting us to fax our pay stubs to her. I told her we just sent 19 pages to you guys just last month. I really don’t want to go through this again. When we first started this with Robert Purcell as our negotiator, and did everything that was asked of us, He then said that we were approved for a modification and, he also said that we even qualified for the Home Retention too. Now I ask what’s changed? Did I get a raise? NO. Did my wife get a raise? No. If anything another Furlough day has been added to my position. By now we should have already been enrolled in some kind of plan. Robert Purcell, talked to us about the government reduction program and said that we were in the computer and ready to start. This was on March 17,2010. Not even three months have gone by and BofA is still playing games with us. This is even more stressful because we have to keep trying, and not with the same negotiator too. Always someone else. 1 yr and 3 months later, we still didn’t get anywhere with this. John Wright has it exactly right! Bank of Destroying America is exactly what BofA should call itself. When we were with Country Wide we had no problem. It’s when BofA TOOK over our mortgages that the whole thing went hay wire.

Update: Randy Silva wrote on 07/07/10: Brian I felt that I should update you on what’s been happening since my first email on May 6, 2010. Well the first guy that was assigned to us Sergio, he was totally upset with us for asking if he got the faxed paper work. 19 pages that he requested and so he probably assigned Matrece to us. She was nicer then Sergio and tried to help us. She too however wanted us to again send more paper work to her. That really made me wonder what’s going on, and if I can trust anyone there. Well we worked things out to where she made me an offer that sounded good. 2% for five years then 1% increments every year after the fifth.She said she was going to send out the paper work for us to look over and never did. She went on leave. So she assigns someone else to handle what she started with me. Philip! Now Philip calls me and from no where comes out and say’s Matrece asked me to contact you and work out the modification with you. We are offering you 4.5% for the first 5 yrs,which we will have to up your monthly payments and then give you a 1% interest raise every year after. I said hold on, what happen to my offer with Matrece. “Oh she’s on leave and asked that I take over”. I said “no way. I’m only going to talk to Matrece and find out what’s really going on.” I want you to have Matrece explain this to me. I’m having a hard time to make ends meet right now and you want to raise my payments. What kind of help are you giving me? That’s not all. My wife got a call. From Patrick. He tells her that Matrece told him to contact her and work this modification with him. How many more agents, or negotiators, or members of your bank am I going to have to deal with. There should be no excuse for someone like me and my wife to have to send our paper work so many different times. I’ve explained to them and showed them how our pay checks have hurt us with furloughs and no overtime. I’m making so much less now then ever before. You can read my hardship letter, if you can find it. Like others that face hardships with their mortgages and hardships working with your bank, I have to look up to a man like John Wright and the United Law group. I’m certain you have read all of the letters on the piggybankblog.com. I mean we are humans we need help. We need banks that got paid to help us by the President of the United States to use that money to help us. I’m not asking much. All I’m asking is assistance in making my home affordable at a bad time in everyones life. I’m certain that it could be worked out. Matrece Thornton and I had agreed to the 2% for now and it should be honored. Randy

Sherry Wheeler wrote CEO: Mr. Moynihan, I emailed you in April concerning this file and the lack of response I had received. April 15th I received a call & email from Chris Flynn. I have also been in contact with Theresa Cuhu. I’m asking for your help again. I’m in no better shape on this file. Everyone seems to be passing this to someone else with no follow up. Mr Flynn sent the following: “Unfortunately the $135,000 is the benchmark for when we issue the Seller’s authorization to participate in the program. As 30 day increments pass based on that date that document is issued out net amount we need to receive reduces slightly, but certainly not to the point where in 30 days we could accept $110,000 so I can see why that verbiage doesn’t really help when referring to the bottom line on this one. That said if you send me the documents as you mentioned I will include this email and send the appraisal back tot he vendor for review and we can see what happens from there.”

I contested the appraisal. The appraiser called and told me he had been contacted to review the file. He told me he sent an email back agreeing to my fair market value of $110,000 as stated in his original appraisal. His appraisal stated that “due to deferred maintenance” this property should sell at $110,000. This documentation was ignored and a fair market value of $135,000 was placed on the property. This is a major over site on these properties and why many do not sell prior to auction. Then you lose thousands of dollars at the auction vs a short sale.

When placing the fair market value on properties, your employees do not document the written comments concerning these properties – only what is completed on the form portion of the appraisal. Unfortunately the form has no line for these issues. If you could take a look at the appraisal on this property you can easily see the problem. The appraiser agreed this is a major problem when submitting appraisals on the properties. The processors need to add a line to accommodate these issues so you do not lose so much money!
Please see the attached email I received Saturday from my negotiator. A month from my first plea for help to you. I have called & emailed Mr. Flynn and Ms. Cuhu trying to get an update on the appraisal issue and neither will respond. I replied to the email Marcus sent Saturday requesting the results of the contested appraisal.
