And that even if I made $15,000 less this year (as I will) I still will be making too much money. So I was declined a Loan Mod. even with my letter of hardship and the upside down loan I am in. They said I would have to be 90 days behind in payments before they could help. (help themselves to kicking me out)Even though I was approved over a month ago as eligible due to the amount of money I have left every month (zero)I am now officially declined.

What a joke.

I am writing to you today in regards to some alarming happenings that have occured in the Making Homes Affordable Program. Almost two years ago our household income went from being $90,000 a year to $55,000 a year this occured for two reasons first my husband like so many other Americans works with a company affiliated with GM and when the company fell so did his salary and second our oldest son was diagnosed with Autism and because of the lack of services which insurance is willing to provide I had to leave my job as a teacher to take care of his needs. In December of 2008 we realized we could no longer keep up on our mortgage which we previously had never even had a late payment on. We contacted bank of america and were told “as long as our mortgage was current there was nothing that they could do for us” Out of options we declared bankruptcy and upon the advice of our lawyer surrendered our house. In November of 2009 we were contacted by BOFA stating that we may qualify for the making homes affordable program deciding we had nothing to lose we applied, at this time the program was new and we were quoted a payment that was only 82 dollars less than our current mortgage, I immediately stated this would not work and that we were not interested in pursuing this any further. I received a FEDEX package which we ignored and made peace that we would be soon moving.

In Feb of 2010 a local non profit certified HUD counselor contacted us and upon reviewing the application that I had previously submitted spotted right away that the person who had taken our application had included my husband’s bonuses which is against the guidelines he urged us to reapply with his help and see if the results could be better.

Reapplying has been an absolute nightmare each person we speak to gives a different account of the steps we need to take to apply. We are sent letters of rejection followed by letters of acceptance, when we call to try and gain some sense of what is going on we are put on hold for as long as 45 minutes and never gotten back to, I have been hung up on several times despite the fact that never was I rude or inconsiderate I understand this circumstance is not the bank’s fault, we are simply trying to work through the process and make a bad situation a little more hopeful. Most disturbing of all is that we have followed every step given to us we have faxed every document required and FEDEXed the proper papers, but when I follow up I find that papers that were included in our faxes our mysteriously missing. For example we faxed 4 paystubs in the same fax, but BOFA representatives can only find 1. We faxed our complete doccumentation back with the hardship letter etc the representative says ” I don’t understand this I am looking at this paper work right here, but the computer says it is not present.”

After months of trying to get the false information removed from our account we finally had been quoted a new modification amount the application was pending when we received a phone call that our application had been denied and we would be getting a letter explaining why, when we questioned why the representative said they could not say it would be in the letter, we have never received a letter.

It baffles me that Bank of America would rather let this house go to Sherrifs Sale than work out the agreed upon modification amount, We live in an area where many houses don’t even sell at the Sherrifs Sale. The bank would surely make more money off of us if they would get the modification through so we could start paying.

Right now your system has some very shady practices that can not be said to be occuring simply because your system is overwhelmed, and if your system is so overwhelmed instead of continuing to practice such shady things as hanging up on customers, transfering them from one department to another without properfly handling the call, losing paperwork, and taking false information and applying it to accounts than take a month put a hault on foreclosures and make it right. I know that many of your representatives feel that people who default on their mortgage our scumbags, who most likely are uneducated and sleezy, but in this economy that simply isn’t true. I am a college graduate who prior to this situation never once had a late payment anywhere. Bad things happen to good people and if your representatives don’t start doing a better job you might as well close shop because foreclosure is like an avalanche.
In conclusion I would like to say that I support John Wright vs BOFA lawsuit and I encourage you to take control of your company and make your practices under the making homes affordable program honorable.

Anonymous:Dear CEO Brian Moynihan: I had my loan modified and approved in 2009 with Wilshire. My payment was lowered to $2495.12 and rate fixed till 2012. I was never late in paying my mortgage with Wilshire, I requested the Modification because I had an ARM and wanted my rate lowered and fixed due to financial hardship. Couple months ago our loan was transferred to Bank of America BAC. We received a letter stating that we will still make the same Modification payment with no increase. We even receive our March statement saying that our payment is $2495.12. The statement also indicated that my ARM will change in 2012. I continued to make payments thinking everything was okay.

The problem started in April when I didn’t receive a statement in the mail. I had called Bank of America for inquiry and i was told that i was TWO months late on my mortgage and that my monthly payment is $3,403.57!! My rate has reverted back to 7%, the rate I had before the modification with an increase of $908.45 on my monthly payment! They received my payment over the phone with no problem. Now all of a sudden I’m TWO months behind! Bank of America didn’t even inform me of this new payment nor did they send me a statement with the increase. I received no calls, no letters…nothing from them with this change. I don’t understand. My March statement even said my ARM will change in 2012.

I was never in a trial period, my modification with Wilshire was permanent till 2012. I called and spoke to so many people at Bank of America and no one seems to know what they are doing. I faxed my Modification documents and March statements to BAC Home Loans 805-520-5019. I was told by a couple reps to just make my normal modification payment of $2495.12 and they will correct and update my account with my current Modification. My account is still showing the wrong amount but it may take 60-90 days.

At this point, I‘m just very worried. I want to keep my house but this lender is so unorganized. I never felt so frustrated and confused in my life. I am still making my payments as it was modified, but I don’t want Bank of America to keep attaching fees and say that I’ve only made partial payments. I don’t plan to miss payments or go into foreclosure.

To be in the safe side I called BAC Home Loans Servicing a couple days ago to start the modification process. I pray that everything works out okay and that Bank of America will help me. Hopefully I get a notification with the correction.

Michelle Cascio wrote CEO: Mr. Moynihan: Since November 2009, I have been in Bank of America’s Making Home Affordable home loan modification program. At that time, I received a FedEx package of information and document requests. I completed- entirely- the document request list and returned all information to BAC Home Loans via a FedEx SASE a few days before Thanksgiving.

I made my trial mortgage payments on time and waited patiently for approval. On February 19, 2010, I received a message from BAC Home Loans requesting I provide documentation regarding the home loan modification. I called them- and to my complete surprise- they did not have a single document that I had returned in their self-enclosed FedEx envelope. There were “no records uploaded into the system”. This sent me into a bit of a panic- so I spent that weekend putting all of the documents together again- and paid special attention to providing updated information such as my 2009 Federal Income Tax Return, 2009 W-2, etc… which had not been provided in the original documents.

From that point on, my communications with BAC Home Loans became a customer service nightmare. Despite my constant requests for them to contact me via my cell or direct work numbers, they would call my house during the day while I was at work. I would come home and find messages that they were still missing documents that I had sent several times. I would call the ONLY number they would provide (800-669-0102) and I would have to wade through collection efforts only to reach a customer service representative that would give me the wrong information (an example- in February, I was given the wrong fax number twice). Some evenings, I would sit on hold for hours. I was asked many times to fax the same documents, and over the weeks, the document requests became inconsistent. During one communication, they would admit that they had certain documents, only to call me a few days later and ask for those documents again. I grew very concerned as I could tell there was no proper management of my loan modification. One loan representative, Paul T., would call me every few days- but I was never allowed to have a direct line or even an email address to communicate with him. The whole process was very convoluted and mismanaged. There have been no requests for information from them since late April.

Yesterday, I received a letter from BAC Home Loans indicating that my loan is not eligible for a Home Loan Modification because I did not provide them with the documents they requested. This is absolutely untrue and extremely upsetting. I am an educated, responsible, employed, 40 year old divorced mother of a 14 year old daughter. It is not logical that I would sabotage my modification- that we desperately need- by flippantly ignoring document requests. I promise you- there were days when I sat by a fax machine- and not only did I fax what they requested once- but I would fax it 3 or 4 times- with my loan number on the top of every single page.

It is my sincere hope that your office will be able to provide some assistance. I’m sure I qualify for a modification; I meet all of the criteria. I am employed full-time at 40k a year with The Humane Society of the United States, where I investigate animal cruelty in puppy mills. I also receive 9,000 in child support. During the trial period my mortgage payment went from 2550.00 a month to 1789.00. I can afford to keep my home (and my daughter’s home) if BAC Home Loans will just responsibly manage the information I provide. My major concern is that I might well be in a much worse situation than if I hadn’t entered the program at all. What if BAC Home Loans requires that I immediately pay the difference between the trial period payment and my regular payment for the last six months?

I have plenty of documentation to substantiate my claims. I have attached a few supporting documents.

I support the John Wright VS BofA lawsuit. United Law Group will be contacted- in addition to the White House and MD state governor’s office. I expect due process in regards to the HAMP government program!

We were previously with Countrywide. We have made many calls with little results. We were offered a modification by phone, however no paperwork was ever sent to us. I see we are not the only ones being pushed around!!! Please let me know if you have the name of any lawyer so that we can either join with your fight of contact them on a personal basis. I want to nail them to the wall and if takes forever I will fight them for whats right. Thanks John for all you do for us-Jacob & Terri Loera. Update: I recieved an email today from an advocate from B of A I’ve tried to contact this person but to no avail no reponse now he says he’s tried to contact me several times and I’ve not responded which is untrue. I have my cell logs and and it shows all my incoming calls. I also was told that I have 5 days to contact him or I’m out of luck.What do you all think about that? I know it’s probably a joke on me. well us hard working people who get screwed by these Ceo’s and employees who have our lives in there hands and don’t give a care about how we’re lied to and cheated as long as there lives are secure and and cushy everythings good. My family is torn apart now my daughters MS is out of control my grandson who’s 5 wants to go home and is so confused. how do you explain all this to a 5 year old? Can B of A help me out with explaining this I doubt it. They finalized my loan in March 2010, but incorrectly counted our Gross Income of Social Security, even after they received both parents award letters from Social Security. Any assistance at this time would be better than what we have received. Thankyou-Jessica WilsonComplaint Text January of 2009, we have tried to communicate with this bank. they do not provide the same information when we call back. the impression we get is that who ever we get on the phone has no idea what’s happening to our account. We make our payments as understood (so we thought) in September 2009. Yet the bank still charges late fees. We call the bank, but again they cannot provide any reasoning for their actions. we established an account online to see if we could manage our account that way, but only found that our last three payments have not been posted. Our payments are deducted through our online checking account, but the bank still says we owe them. we cannot get an answer as to where our money is or what it is being applied to. we see a “other un applied” column, and some of the money we sent referenced. there is no consistency as to what they seem to be doing with the money we send them and charges they are applying as well. we are reluctant to giving them any more money since we do not know where it is going. but if we do not then we get a “default” status. It is so easy to say we are in default, yet when the bank does not reply, provide necessary information, year end tax statement or why they keep charging us late fees when we have proof of our payments. we are extremely frustrated with this bank and do not want to “walk away” but as so many others, why should we not when we are treated this way. please provide a written copy of this complaint. HELP!

Resolution Sought: Have customer service. provide feedback when asked. provide information about our account when asked. provide refunds on late charges. (we have proof that payments were made.)

I have Patricia Barbosa, Bof A Vice pres phone, will call her tomorrow, do you know her email. I have Brian Monyihan emails, how about do you know who else to complain too in order to get results on the HAMP; they have treated so many people horribly. So many promises with their HAMP program, innocent victims follow their instructions in good faith, only to be closely defaulted on, strong armed…I am going to the attorney-general in Sacramento tomorrow, calling all the above, emailing all the above, send certified letters. I have a letter of approval for the HAMP program from last October, called them every single day, worried sick, my credit was the best ones could be, I have run into a problem with my husband at stage 4 of cancer. I have owned my home for 35 years, banked with B of A for 34 years. They have lied to me, nothing but lies. Someone has to care about this within the system and correct.

Steve Coopman wrote CEO 05/12/10:My experience with BOA has been a absolute nightmare since Nov.09 I have been working with BOA on the making homes affordable program I don’t believe BOA has any intention in working with people to help them out since I first made contact with them in Nov.09 I have been calling back to check the status of my account and each and every time I call I have gotten the same old line nothing is happening yet but I will e-mail it to a negotiator so I would call back in a week or so to check the status and guess what the same old thing no nothing is happening yet but I will e-mail it to a negotiator I played that game until about Mid March the I received a letter in the mail that stated since x amount of time has passed you will need to resubmit your bank statement, last 2 paystubs and the most current tax return so that is what I did again I called back to verify that BOA has received the information and yes we did and now the same old thing I will e-mail it to a negotiator again I called back in about a couple weeks and this time I was told that basically I was going to have to reapply and that I should be expecting a package from Fed-Ex in about 10 days so 2 1/2 weeks go by I still have no package from Fed Ex so I called again and I was told the very same thing again that I should reapply and a package would be sent out Fed Ex however I was also told that a notice was sent out that my home will be sent into foreclosure this is how people are treated when asking for help and the best part of this is they know the reason for this is because my wife was involved in an accident and is now considered 100% disabled unable to work you know it is not like we are not trying to work with BOA I asked about regular refinancing that went nowhere I asked to wait until work wife case goes to court hopefully in the fall of 2010 but that falls on deaf ears.

With all of this being said I FULLY SUPPORT JOHN WRIGHT VS BOFA LAWSUIT it may not help me but I hope it helps someone BOA should be ashamed of themselves for asking the United States of America Government for all the Billions of bail out money and then treating people the way they do.

After further investigation it appears your loan modification calculations are based on monthly gross income and should be monthly net based on the calculations.Just a heads up as thousands of Americans and immigrants are communication daily to put an end to this type of illegal, fraudulent, irregular and abusive business practices.Our monthly income was cut in half more than 11 months ago. We get the same type of responses like “we never got the paperwork”, even though they were signed for with documentation to prove it.I often wonder if FedEx, one of the most respected companies in the United States, does any type of business with Bank of America? Perhaps you should look at theses types of successful businesses and model yourselves after them.Its time to stand up and fight back. and I for one am willing to stand up for what is right. Thanks again Brian Moynihan for giving us the worst service of anyone in your industry. You should be ashamed to represent a company with the word America in its content! Your workers should now demand hazardous pay for doing what little they do at B of A. It’s funny that I never had any trouble with Countrywide isn’t it? And they were convicted as crooks.

On Monday the bank/modification team informed me the modification did not go through after a year wait sending the same papers over and over. Stating I did not make my payments on time, I informed her the 3 month trial period I made all payment on or before the !st but it was not taken out of my account until weeks later. The bank of America rep told me it was my FAULT THAT YOUR COMPANY TOOK THEIR TIME TAKING THE PAYMENT OUT OF MY ACCOUNT in should have questioned it.

 Lisa Mealia wrote CEO 05/13/10:Dear Sir; I’ve tolerated enough of you and your bank’s potentially illegal, fraudulent, irregular and abusive methods in the handling of loan #XXXXXXXXX Patrick Mealia Since first initial payment on 11/1/07 with Countrywide I’ve questioned and requested some kind of litigation loan analysis for overassessments. I’ve contacted bank in 9/08 the moment my income changes happened before any of these programs were publicly known but available (Countrywide Supreme Court Judgement Injunction 10/14/08) I’ve reinstated loan when faced with first NTS 4/29/08 no offer by the bank after curing processed 5/1/09 to which I was entitled to in payment reduction since both equity and escrow needed to be adjusted because of depreciation in value. Now faced with another NTS 3/23/10, I received a pretense of a modification by bank advising this will stop foreclosure proceedings or NTS only to have home auctioned even after me verifying over and over austion had been postponed. In conclusion, I’ve had enough and I am fighting back!

Update:John, I wanted to let you know the email to Brian Moynihan I sent supporting your case against them triggered a response today. At 1:30pm today a woman called from Bank of America telling me she had been assigned to my loan for review and how she’ll be in touch with me just give her 48 hours to go over the paperwork. I’m still wary in believing since they said they no longer handle my account yet this lady called me even though I didn’t add my phone number to email…I guess we’ll see

I know this probably will sound strange but Thank You – there really arent words strong enough for what it meant to me when I just happen to come across your story at my darkest hour. I felt so lost and helpless by what B of A pulled on me I went online in disbelief that it’s over they can just get away with taking my home! Reading your story and others knowing I’m not alone put the fight back in me enough to send that email when I was just about to give up so thank you for your support.

I’ve lowered/streamlined the household expenses 3 months ago, I got real BofA forms sent to me for BofA HAMP filled out/signed (our paperwork never looked so good) I cant wait to resubmit them in the morning….. Representative advised me in her research that the property had sold because it went to auction. {Hold on I got to refill my glass here…K} Yeah she stated my house went to auction and there’s nothing BofA can do at this point. NOTE: If this was just another borrower who defaulted & lost their property at auction she’d be right. I asked her to hold on in order to hear her better (actually I just put the phone down to do sort of a laugh/primal scream of frustration dance in order to continue the call) yes I know that’s why the advocate department in Tempe sent it to her department in CA. in the first place. I then asked why was she telling me to ignore her email with forms and updated information BofA wanted me to fax tomorrow again, lol? Basically Yes thats exactly what she was telling me that and with the first time in April when BofA received paperwork it was 6 days before NTS to which BofA doesnt guarantee modification and that due to lack of communication oon my part in November 09 was the reason I was facing another NTS. I in turn stated how in November 6 months after reinstating with Countrywide I’d been in constant contact with BofA that in November I even advised BofA I would be out of town and Yes BofA didnt guarantee a modification but they did in fact guaranteed postponement of auction 3 times once to my face at my branch and twice while working/faxing paperwork each time I asked not once was I told a date or that all paper was received. She apologized says theres nothing she can do. End of first call. I called her back like 10 minutes later to simply ask after I gotten my notes why then I received a letter from BofA 14 days after auction and10 days after being told property went to auction, BofA is processing my loan for a modification but I got her voicemail. In fact, I’ve left her 3 messages that night, again in the morning no response. I called the advocate who originally answered my CEO letter to question her why she even answered, what happened to her telling me she was waiting to get loan papers so she can submit them to her supervisor, yet the representative who she sent them to review who told me to ignore her request for updated information since advocate was on my loan was then assigned to my loan requesting updated information for the second time to call and cancel request again. Who was her supervisor anyway? Advocate’s reply was first my loan number like she didnt know what I was talking about it was only days earlier when she addressed me by my name. But here’s the best part I quote “Let me pull your account up on my computer-I’m going to give you some information you probably have already”… I asked is it the phone number to the respresentative because I’ve left 4 voicemails already to which she has yet to respond. She said “Well she’d be the one to talk to since she’s assigned to my loan” … I didnt even know how to respond I mean I had a response but it wouldn’t of been ladylike. After hanging up, I emailed and left 2 more voicemails still no response. I can’t stand the fact I have to deal with or Counrtywide merged with Bank of America. Everytime I had any dealing with BofA it got screwed because of an error on BofA end. In our family we refer to them as BunchofA’holes or BendoverAmerica bank. The B of A customer advocate who had contacted after being ssigned my loan advised me that she’d be the one to review what had happened during the loan modification, why our famliy homes was auctioned. She had also asked me what I based my complaint about and what did I want to see happen. I stated how this loan has been mishandled from the beginning starting with Countrywide not reevaluating the high escrow/property taxes when we asked after being notified by the State the amount we were paying and cap were overassessed, how we’ve been requesting some kind loan mediation since to be told we didnt qualify for any kind of loan modification when faced with the first NTS 4/09 (income too low-then how did we get loan to begin with, lol), how we reinstated at that time paid 22,000 to cure loan because we got tired of the verbal volleyball from Countrywide and wanted to keep our home. That when this last NTS notice 3/10 came and we contacted B of A they only wanted paperwork for (what else?) loan modification. I also let her know B of A never said how much or how behind even at what rate the loan was delinquent when I asked them. I also added how B of A assured me during the course of modification auction is delayed until approval each time I asked the random representative I called or contacted me because auction was in a couple of days and after I sent the last of my paperwork I called and to check if B of A needed anymore information to be told house was sold. So I want to know why B of A lied and auctioned our home and why because if modification paperwork takes time 30-45 days were we even denied? I also wanted to resubmitt papers for modification since I had researched more on exactly what to do for a modification and deal with one person. Advocate told me she’ll know more after reviewing paperwork give her 72 hours. Well to date, advocate called each time she said she would like clockwork only to tell me she still reviewing, resubmitted for more information to another department before she can go to her Supervisor with our paperwork to see if we can still modify. Meanwhile B of A other department (which is in California by the way- advocate’s in Texas) called me to find out from me what happened I never really got to answer after she finished telling me who/why she was contacting me but Advocate will be calling me after “she” send her back our paperwork. then a week later BofA Rep called advised me she’d like me to send her updated papers I previously sent for modification but she couldn’t tell me if loan was being resubmitted for a modification for sure when I asked her or why what was happening. She was going to email me further details that was 5/26/10 at 4:25pm. At 5:00pm the same day, she called me back basically told me to ignore email don’t send her paperwork that she didnt realize loan was being handled by an Advocate. Now wait on 5/28/10 at 1:51pm Representative called me now I do need to send HER the paperwork and she’ll in fact be the one handling the loan now and she’ll resend me an email with details. But I didnt send it in until I called Advocate on 6/1/10 (after holiday) when she was back in office to check because I was confused since Advocate was waiting for paperwork from Representative to submit to Advocates Supervisor right!? Advocate could only confirm that Representative is now handling loan and she cant answer my question if loan is getting modified (BASICALLY WHAT THE HELL IS GOING ON,sorry) the Representative would now be the one to ask or would know any answers. Now in the midst of this, I’ve also been cleaning. packing etc. because the house was auctioned remember even though I havent received anything about an owner or eviction just in case and I have trimmed down our monthly expenses to help for updating paperwork for B of A and with not sleeping or eating from dealing with the whole uncertainty of homeless not homeless I’ve lost weight I’ve never looked better in my bathingsuit to go swimming in my pool not my pool that’s in my yard not my yard this year. I immediatley sent an email to Senator Harry Reid’s office asking for aid.  Within a week I received an envelope with papers saying how can he help etc, So I started to fill them out but I didnt know how much detail they needed     I called the number on 9/24/2010 @ 10:00am spoke with Sandy Durgens here in the Las Vegas office telling her about Bank Of America etc.  ok she told me to hold on she’ll call over to Bank Of America to speak with them.     10:40am-Ms.Durgens called me back told me that my home was auction because there wasnt a payment in over a year that BofA tried to contact me in November and how Countrywide & Bank Of America arent required to offer a HAMP (WHY IS IT WHATEVER A CORPORATION SAYS HAS MORE VALUE THAN A CONSUMER & WHY IS EVERYONE HARDUP TO PUT US THROUGH THIS HAMP PROGRAM?)… I told her I had reinstated with Countrywide because they said if I was able to zero the account balance after telling to miss payment mind you-they’d be able to work with me in analyzing the loan due to the debt to value ratio and overassessed taxes. She stated how I was contacted thats why Mathew….the attorney filed NTS . Mathew who? Cindy Lee Stock’s the attorney Debbie is the associate I’ve been dealing with in fact I’m waiting to hear from property manager to do a month to month…Ms Durgens asked You have an attorney- No not yet- She stated how you dont need to have an attorney to do a loan modification then asked if I contacted any other office besides senator Reid- No- She then asked for Debbie’s number she was going to call her-gave her the information I then asked her can she give me repeat the name of that attorney Mathew she mentioned – Ms Durgens replied NO just let her handle it she call me right after she speaks with Debbie.     11:16am: Ms Durgens calls she spoke with Debbie and there’ll be no call from property manager because there’s no offer of a month to month. I’m still wary in believing since they said they no longer handle my account yet this lady called me even though I didn’t add my phone number to email…I guess we’ll see I know this probably will sound strange but Thank You – there really arent words strong enough for what it meant to me when I just happen to come across your story at my darkest hour. I’m writing to express my stressful situation and disappointment toward Bank of America Lost Mitigation Department. I bought my house in 2005 with my ex-partner. However, I am on the loan by myself. With the advice of my real estate agent at the time and the promise to help securing a loan with a large amount of down payment, around $300,000 from my 1031 exchange, I and my partner made what turned out now is an ill-advised purchase. Now the real estate market had crashed and the value of this house has decreased by at least 40%. My partner had probably foreseen the future of the weak real estate market so he abruptly walked away from his mortgage commitment leaving me a single mother of two struggling with a large mortgage bill. In addition to this, I also got hit with a salary reduction from my employment. As a result, I have drained all my savings just to keep up with the mortgage. I also got financial help from my immediate family members, and I had to cut down on all unnecessary spending including pulling my kids out of day care and sold my only car, however, the financial help was a temporary fix and there is nothing else that I can think of to cut, and as a result I am still overwhelmed.

Since purchasing this house I have been very responsible on paying my mortgage. I have never late on a single mortgage payment before April of 2009. However, after the real estate crashed down and my partner of 5 years walked away from his obligation around November of 2008, I assumed sole responsibility and still paid my mortgage bill on time up to April of 2009, however, I could not keep up with my mortgage any more as of early April of 2009 because I have drained all my resources. After the first month that I fell behind on my mortgage, I tried in vain contacting Bank of America Lost Mitigation Dept. and filing an application to request for a loan modification right away. The whole process was painful one. And through out the process until now, very time I call I got the run around and different information from different associates and as a result this has been dragging out for over a year without an answer. I’ve been calling them every other week. No one could give me the answer of what my loan modification status is.

I am now constantly living in fear of losing my home to foreclosure. I would like Bank of America and its’ CEO know that my house means a lot to me and my two kids. I have been working very hard to get my American dream home for my kids to grow up in with. To us this is our first permanent home which we would like to stay in it for long time. They got used to their school and the neighborhood they are in now. They involved in with many activities in the local area and they enjoyed each of the parks in the area. I can’t put in words how much my kids love this home and the neighborhood that we live in. If we are going to loose this home to foreclosure it would be a heart-broken for us and especially my kids.

In the past few months, we have been living in nervous, fear, distress, and very uncertain. We pray to god every night that our loan would get modified so we can move on with our lives. We love this house, its’ neighbor and the area. My kids will be very disappointed if we can’t keep this house. And I can’t imagine how chaos our lives would be if this house is going to be foreclosed. Especially being a single mother and trying to maintain a good environment for my children. Our future is in your hand so please help a responsible home owner. Please help us to remain in our only home with a loan modification.

I feel that a loan modification would benefit us both. Currently my house is only worth around $754000 according to Zillow.com web site. The home’s value is way below what we owe. This value is only for the area. I believe the internal value of the house is even lower because of the way it was built and the materials that were used to build it with. Although this house was new when I purchased it, but now according to experts and general contractors, the house was not properly built. The builder used cheap materials to build this house and as a result this house is falling a part slowly and we have to play catch up as far as fixing it as we go. We have been calling the builder to fix thing around this house since we moved in. We fixed the leaking roof. Kitchen’s tile floor needs to be replaced. Many tiles on the main entrain also need replacement. Our living room windows are still leaking until this day which also damaged the hardwood floor with water coming in during raining season. The pluming inside the wall in our basement was leaking and damaged all the dry walls. Stains are still visible. Sewage clogged up every now and then and overflow in our garage create a very toxic smell. In addition, there is a major problem with this property which is the underground water that runs from our back yard through the underneath the foundation since this piece of property is sitting on a down hill lot. Even during the summer, the underground water still comes up in our backyard. During raining season the excessive rain water and underground water rush into our basement and deposit in the garage. With all these problems we are still willing to work with Bank of America to keep this house. Currently my family members are willing to help me financially in fixing up all the problems in this house to bring it up to its’ standard, but we can’t go on since we don’t know the future of this house. My family members are willing to help us with the cost of repair but they won’t do that until they know if we are going to be in this house. We would appreciate it very much if Bank of America can work with us to lower our payment and principle if possible so we can keep our home.

Elinor de los Angeles wrote 05/16/10: In Nov. of 2009, I have applied for a home retention assistance. The representative who took my application via phone told me that based on the information I have given her, I was prequalified and will be contacted by a representative in 45-60 days regarding my application. I never heard anything from B of A about my application. In March 2010, a representative from the Help Team called me to let me know that they will be sending me a packet which I needed to fill out and provide documents for then to process my loan modification. Never received anything thru FedEx and B of A could not give me any tracking #. I even followed up 3 times for the packet and they kept saying that they will resend. Never got anything. Finally, i got a letter in the mail stating the my payment was being increased by over $200.00 because escrow is being added.I have called B of A to find out why since I have been making my own property tax payments myself for the past 4 years. They said that it was because I applied for a home retention assistance and that the only way I could get back my old payment prior to the impounded escrow is for me to cancel my loan modification application. I told them I never even received anything in the mail regarding my loan modification. So being left with no option, I cancelled my application on March 31, spoke with the home retention department to have my account removed from review status and for my escrow to be removed. I made atleast 20 calls in April to make sure that is was taken cared of and was told multiple times that my account is no longer in review. This May, I made an ACH payment thru which B of A received on May 5 but never posted to my mortgage account.When I called, I was told that my account is STILL in review status and that my account is showing delinquent even when B of A already has my payment. I was told again on May 14, 2010 that they will request removal of review code from my account. I AM VERY FRUSTRATED THAT UNTIL NOW, THIS HAS NOT BEEN FIXED. THE EMOTIONAL DISTRESS YOUR COMPANY IS CAUSING ME IS UNACCEPTABLE.I DO NOT UNDERSTAND WHY YOUR STAFF CAN’T DO THEIR JOB CORRECTLY. FOR THE 1000X, I want my account to be taken off review status and for all my payments to be posted correctly.Your home retetntion program is a fraud and your company does not really care about homeowners.

I have also been in contact with Theresa Cuhu. I’m asking for your help again. I’m in no better shape on this file. Everyone seems to be passing this to someone else with no follow up. Mr Flynn sent the following: “Unfortunately the $135,000 is the benchmark for when we issue the Seller’s authorization to participate in the program. As 30 day increments pass based on that date that document is issued out net amount we need to receive reduces slightly, but certainly not to the point where in 30 days we could accept $110,000 so I can see why that verbiage doesn’t really help when referring to the bottom line on this one. That said if you send me the documents as you mentioned I will include this email and send the appraisal back tot he vendor for review and we can see what happens from there.”

I contested the appraisal. The appraiser called and told me he had been contacted to review the file. He told me he sent an email back agreeing to my fair market value of $110,000 as stated in his original appraisal. His appraisal stated that “due to deferred maintenance” this property should sell at $110,000. This documentation was ignored and a fair market value of $135,000 was placed on the property. This is a major over site on these properties and why many do not sell prior to auction. Then you lose thousands of dollars at the auction vs a short sale.

When placing the fair market value on properties, your employees do not document the written comments concerning these properties – only what is completed on the form portion of the appraisal. Unfortunately the form has no line for these issues. If you could take a look at the appraisal on this property you can easily see the problem. The appraiser agreed this is a major problem when submitting appraisals on the properties. The processors need to add a line to accommodate these issues so you do not lose so much money!

I have called & emailed Mr. Flynn and Ms. Cuhu trying to get an update on the appraisal issue and neither will respond. I replied to the email Marcus sent Saturday requesting the results of the contested appraisal.

One is a 30 year 6.375 fixed rate loan and the other is a second interest only equity loan. Recently, like many home owners I have fallen on hard times and I enlisted the help of the NACA “Save the Home” Program which is a go between agent for home owners experiencing hardships and their mortgage company’s. I followed every single directive of NACA. Finally, I was put into a BAC temporary forbearance for four months that started September of 2009 and ended December 10th, 2009. My mortgage payment was reduced from $1420 down to $1050. I asked if this arrangement would affect my good credit standing and I was told as long as I paid as agreed it would not.

The forbearance ended on December 10th, 2009 after which I resumed my regular payments of $1420 which I’m still currently paying. NACA informed me that BAC would either approve a permanent modification at a lower monthly payment or not. All they could do is remit all my information again as requested by BAC. After the long arduous task of redoing the NACA paperwork again. I waited and hoped for a permanent modification at lower interest rate and a lower monthly payment. After calling and waiting four months and not hearing back from either NACA or your company I finally was told by your reps that there was nothing they could as long as my account was in modification. NACA finally returned my calls. I had to re-due the entire process all over again because four months had passed. It would take another 30 days for a response from BAC Home Servicing Dept.

First of all, the date on the new permanent modification agreement documents is May 1st, I didn’t receive the package until May 13th, 2010. I am to sign and return these documents before May 27th. Not much time. I was very excited to be finally getting my new permanent medication proposal until I read the agreement. This new proposed agreement appalled and shocked me. Your company’s permanent modification included $13,000.000 worth of delinquent interest charges. Also, the new modification mortgage payment is $64 more than what I had been paying for the last seven years and seven years will be added to the maturity date of the loan. I have paid the forbearance as agreement and have satisfied all the BAC terms but your company has reported me late every month of that forbearance to every single credit agencies. Of course this negative reporting increased my interest’s rates which in turn increased all my credit card monthly payments.

I’m bringing this all to your attention because this is not a solution for me. It’s a nightmare. Not only has my credit been adversely, I now have higher interest rates on them, higher credit card payments, my mortgage payments will increase, seven years will be added to my loan and now I owe BAC $13,000 as well. Where and how did your company come up with this additional $13,000 worth of interest when I have been paying my $1420 a month mortgage up into the forbearance? After the forbearance I resumed my regular payments. I assure you that owing $13,000 is inaccurate and does not reflect what my records have. Someone needs to explain how this figure came about?

I’d like to add that I am in support of John Wright’s lawsuit because I feel I am too a victim and the unfair and questionable practices of your company towards your loyal customers has been unthinkable.

Dear Congressman XXXX,

I am writing to you in regards to Bank of America Home Loans Forbearance or Loan Modification Program. As a Bank of America customer, I believe I have fallen victim to Deceptive Business Practices of Bank of America Home Loans.

As my research grows, I am connecting with several people that have also fallen victim to the BAC Loan Modification scam. Mr . XXXX, people are losing their homes because they have trusted BAC with a loan modification plan, and then have received foreclosure notices after paying, as agreed, on the modification plan. This is currently happening to us.

In August 2009 , we were approached by BAC as a candidate for the Forbearance program. We signed a forbearance agreement that states that we will be entered into this program of modification for six months as long as we make our payments on time. We were told that our monthly payment would go from $1296 a month to $714 a month. As agreed, we phoned in our payments to BAC on or before the 1st of every month.( Customer Service does have record of the dates that we called in and we can provide these if needed. )

Even though BAC would not post our payments for up to 10 days, we always paid on time, as agreed. I spoke to BAC representatives every month asking probing questions to verify that we were successfully entered into this program and that we were doing everything we needed to be doing to stay current . Every month we were told “you are fine “ and to “ keep paying the discounted payment. “

Finally, after the 6 month period was over, I was told to call in with my “financial “ information to see if I qualified to stay on the program .

After I gave my “financials”, I was told that it takes 30 days or more to process and we would be notified by mail with more paperwork to sign.

The next day I received ”Intent to Accelerate” Letter stating that I owed over $8,000 by May 31, or Foreclosure proceedings would start immediately. As you may expect, I was completely blindsided.

After speaking AGAIN with BAC, I was told that we should have been paying the PMI amount of $121.00 a month along with our modified payment amount. I was also told that we should just wait for the modification papers and “see if we get accepted”. I explained that if we wait, it will pass the 30 day foreclosure time.” Convenient isn’t it?

I believe that BAC home loans never intended to modify our loan agreement, and purposely withheld information from us so they could simply take advantage of our poor financial situation, and eventually take our home. This is illegal.

Since I have taken a substantial paycut over the last two years(hence the reason we thought the modification was going to HELP, not hinder) I simply do not have $8100.00 to pay off BAC. Therefore, I have to borrow the money from family members in order to keep my home. I will be again cutting my salary in half to PAY BACK this loan that I have to pay to BAC Home Loans by May 31.

Mr. XXXX, I need you r help. This is not an isolated incident. There are hundreds of people that have fallen victim to BAC.

I believe that BAC practices go against The Consumer Fraud and Deceptive Business Practice Laws and The Truth in Lending Act . As I research the HOEPA (Home Ownership and Equity Protection Act), I see a pattern of deception at BAC.

We are asking you for guidance, protection, and representation in saving our home. I would like to encourage you and your staff to start immediate research on Bank of America.

Additionally, I am sending a copy of this letter to the Federal Trade Commission, The Attorney General, and the Better Business Bureau. I intend to spread the word about BAC so no one else has to fall victim to possible foreclosure.

Please help my family save our home.

Update: 05/18/10: GUESS WHO CALLED MY HUSBAND YESTERDAY? BAC CEO Representative. They said they would speed up the modification! Oh boy, Like we will ever go into another shady program. I will take my payments back the way they were thank you. They also said that someone should have told us that the forberance was up in FEB. Seriously? Then why was my husband told “IT IS FINE” every month. Yesterday I also wrote to FTC, ATTORNEY General and many others. I will not stop untill I am heard.

On 05/19/10 XXXX XXXX wrote CEO:-Dear Sirs, Yesterday we received a Fed Ex envelope with one sheet of paper stating we need to give you our hardship letter and pay stubs. It said in the letter that our financials that we gave you were “enclosed” and they were not. We also asked for a copy of the Forberance agreement that we signed to be included in this overnight packet and it was not. We ALSO asked for a copy of the Promisary Note. That was also not included.

Additionally, I would also like to make it clear that while we were in this “Forberance” trial period, at NO TIME were we ever told that the agreement and payment plan had expired. Apparently the trial was over in February and we were not told even when we asked every month when we called in to pay on the 1st.

We called in every month to make our payments and I asked the representative after the Feburay payment “Are you sure we are only supposed to be still paying the $714.00 amount” We were told “yes, of course, you are fine”

Yesterday while speaking with your represenative, we were told “You should have been paying the full amount again in Feburary.” Hence the inflated charges , fees and INTENT TO ACCELERATE.

This is outrageous. I cannot believe that we have fallen victim to this and could potentially lose our home becuase of your poor customer service and contact, and misinformation.

I am not sure why you would think that we would actually trust BAC with a loan modification NOW that you are trying to take our home with your Intent to Accelerate.

What can you do to help us out with this ?

Glad to hear you feel comfortable with your attorney and your attorney being aggressive. Still be sure to have your file audited by an expert – ask your attorney about a possible referral or I can refer.

Finally, I forgot to tell you something: be prepared for the Bank to try to accuse you of a crime in another capacity; they play that way. There is a rift in the FBI and among some law enforcement, especially considering their pensions are getting hit, so they are still mad at customers although they are slowly coming to the truth. Just be prepared.

Had we went on vacation (not in 7 years), bought cars, or items that BOA would not see worth pursuing, then we’d be a complete write-off as many others are; or at least you’d consider reducing the remaining principal owed.

No doubt BOA’s stance is that you need to recover what you can when the opportunity avails itself as is your fiduciary duty. But what was BOA’s duty to the average U.S. citizen, and to us? Would an industrialist borrowed money from BOA to invest in a plant and not be angry that BOA would loan monies to another competitor nearby? Would not that be a conflict of interest? Is not that what BOA did when loaning monies to illegal immigrants, thereby encouraging their migration and flooding the residential building market with cheap, unskilled labor that not only severely undermined the existing skilled residential labor pool, throwing them into the ranks of the underemployed-and depriving future homeowners of well-built houses? During our homebuilding journey we meet these Americans and heard their stories. We also witnessed the illegal immigrants construct our house with poor workmanship and no comprehension of the residential building codes. Yet had we complained too loudly, no doubt we would have been confronted by illegal immigrants rights groups. We’ve also witnessed news stories about the coming flood of lawsuits over poorly constructed houses.

These new “customers” of BOA are at the root of this housing collapse. BOA was and is in violation of the Federal Immigration and Nationality Act Section 8 USC 1324(a)(1)(A)(iv)(b)(iii) and in Section 274 felonies any person, business, organization or local government who assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment.

I don’t think this is fair and good customer service. I can called repeatedly and so employees seem more helpful and others don’t seem to know what to do. After speaking almost 2 hours with the supervisor, I think she was just tired of my complaining, she gave me a number to see if I can get my case re-opened. I went ahead and called the number I was given and I fortunately was answered by a well knowledgeable employee and he was very helpful in sending an email to the person who was looking over my paperwork. Come to find out my case was re-opened, now its May of 2010 and I still have no response. Every time I call I get told everything will be fine or your request is under review, how much longer do I have to wait? Now their response have changed every time I tell them I have waited over the period of time that they told me they state, well there others that are also on the same boat and I have to be patient. This is not good customer service.

I would note that since March of 2009, we have paid $25,000 on a mortgage with a principal balance of $85,000. According to my recent mortgage payment invoice, that $25,000 has served to reduce our principal balance by a whopping $1000… We now have almost no money — literally, my wife and I have been eating TV dinners that cost $10 for 10 (a dollar apiece) for the last 2 months and most recently had a friend with food stamps give us a ham so that we would have food. We have been trying to find a way to pay for my wife’s monthly medications to prevent her from having another stroke (Coumadin, Plavix, Prevacid, etc.), and can’t even afford to do that. We are quite literally dying, disappearing from the face of the earth, waiting to join the ranks of the homeless … My car is now for sale and I have absolutely nothing left beyond that. Should you care, here’s our story:”My wife and I have been attempting to refinance with Countrywide (now BOA) since February of 2008, when we received letter after letter from the company urging us to refinance immediately and “exploit the equity” in our home in the process. They first assured us that we qualified for refinancing of an ARM that had doubled our mortgage payments, and told us we need only pay an “administrative” fee of $400 or so. Part of that was to be used to pay for an appraisal — of course, by an appraiser selected by Countrywide. After the appraisal, CW refused to disclose the results and even the appraiser himself hung up on us when we asked for the appraised amount of our home. (I have since learned that there is a class action against CW by an appraisal company which says that CW manipulates appraisals by cherry-picking the appraiser to give them the valuation that they want on any given property… surprise, surprise) They sent us refinancing paperwork which included a pre-completed application that contained inaccurate information, for instance, stating that my income was much more than I had ever represented. When I complained about the false information in the application and refused to sign it, CW then refused to communicate with me at all about the refinancing.

RJ wrote CEO on 05/20/10-I’m writing to complain about my experience with BAC regarding my request for a loan modification. My income was reduced last year by 15% ($800/mo) and my pay option arm (with negative amortization) reset in January 2010, an increase of $250/mo I meet all the qualifications for a loan mod, and originally started the process in Sept 2009. I have submitted all the required documents multiple times, but havent received a decision. I am struggling to keep my payments current, but I am running out of reserves, and if BAC doesnt make a decision by June to work with me on a loan mod, I will not be able to continue making payments. I support the John Wright vs BAC lawsuit, as my experience with BAC has been the same.

Dawn Ely wrote on 05/20/10-Hi John, I am writing at the very least, to lend my support. My BoA mortgage was ‘transferred’ to BAC in November & I saw then that this could potentially screw up my 1098. Good God I had no idea. I’ve posted some of story @ http://www.loansafe.org/forum/loan-modification/21320-your-1098-mtg-interest-stmt-incorrect.html but see huge similarities with postings on customerservicescoreboard.com. As an accountant I’ve now done my own calculation and have done at least my first amended return. I even had good branch employees here in NC but have seen them get as pissed off as I. I’m documenting some of my tale now but am really at odds with whom all to submit it too. Am curious with your discoveries/findings. I’m wanting to get tax prep fees paid back to me for at least this first round of amended tax returns but seriously its been like a bad part-time job for which I’ve have been paid since early Dec 2009.

She’s tried to get me to say my issue was resolved 3 times and another associate actually told me that she was going to have to contact this girl about reopening it on another occasion! Obviously this position is not a good fit for her. My name is Pedro Luna I have a Loan that was with Countrywide and was taken over by Bank of America. Loan# xxxxxxx

I began to have financial difficulties as a result of my wife’s porolonged unemployed status and as a result of inflation when the gas prices shot up and then everything went up so with that I applied for the loan modification program. I am the sole provider have a wife achild of 15years and an unemployed daughter in school. (4 dogs too). I was placed on a trial basis and BofA sent me coupons. I made every payment as they indicated. Then I got a letter saying they received all my paperwork and to await for a decision. It never came. In the process they would send me duplicate requests, one time they sent me a letter dateed Dec. 15, 2010…It was only feb of 2010! and the requested info had been verified to have been recieved by fax successful transmission and on the phone. When the coupons stopped ran out, I had to call and ask if I should continue making the modified amount payment. Regardless where you call the person answering the phone has no decision making power. they are just bill collectors. They want to verify and update the info you sent them each time or they won’t talk with you. I was told on the phone, never in writting, after they had me fax and send the same info over and over…that my loan modification was denied, They also kept calling my home number asking for payment, the typical bill collector routine…all throughout the modification process they kept calling so instead of being of assistance, they harrassed us calling as many as three times a day. It reached a point to where I went to a local Bof A office and asked what optons were available.

Sharon Sosa a mortgage Loan officer from BofA saw my situation and said she’d try to help me. because before this crisis I never missed a payment and I only had one missed payment (december 2009)… In December I got the coupons saying I should begin January 1st making the modified amount. So I did . Sharon saw my credit history, said I should be able to qualify for a 15 year 4.37% interest loan which would bring my monthly payment to about 900 pricipal and interest or 1100 dollars when taxes and insurance are included. I owe 114,000 on it with an equity of 100,000 dollars. So the likelyhood of memaking the new payment without problems is quite high.

We had the property appariased and it came in at 215,000. Meanwhile the loan modification people refuse to let me talk to a negotiator, they tell me all kinds of different things each time I try incluiding that They don’t have to send me anything in writing as far as a decision on the loan modification just that I was denied and now I need to make up the arrears or face foreclosure. Then the worst came. I got a call from Sahron Sosa telling me Bof A declined my loan refi application because it showed me 2 payment delinquent . I explained they added the four times I made a partial payment and made that into one late and with the december late, they reported 2 late payments but that in reality I payed as they indicated without missing a payment and stressed to her that anyone with a normal intelligence incluiding a loans ceo would see that it was circumstancial and not a reflection of an irresponsible payor.

When I asked if I could talk to someone about it, they (incluiding Sharon Sosa) limit themselves to say that there isn’t anyone I can talk to and she said to talk to the loan modification “Loan Mitigation” aka “home retention”/ alias the “making home affordable” / aka “advocacy program”. Each time I call I get transferered to anyone they desire and each time the person(s) I get transferred to every single one says they are the wrong person to talk to and then they forward me again to anyone who again says they will forward my call to a third, then a fourth person and it all ends in the same vicious cycle. When ask why I can’t talk to the negotiator they say that becasue my loan is in the modification …huh? so if it is denied why is it in the modification and if it is should I not be allowed to talk to the modifications negotiator? no becasue it is the advocacy department. It is just a never ending bunch of dead ends! By design because these are all the responsibilty of some CEOs but they play the same script they are told to but whenone asks questions, back to the same dead end answers.

A co-worker of mine making the very same amount as I do , same title, same pay, is upside down on his property. He got approved for a lower interest rate for 5 years and the arrears were appended to the end of his loan. I got lots of equity in comparison and the only difference between him and I is that, the equity and the fact that his last name is an Anglo saxon (English name) mine is Luna, Hispanic. I don’t mean to play the race card I dont like the idea of me the victim, but I cannot help but think that they want my property because it has equity. So if it goes into foreclosure, they may see my foreclosure as a profitable investment. Bof A is telling me I make too Much but when the expenses versus take home pay is added I come up 200.00 to 400.00 short. Now they say they conisder only my gross not my take home pay as a basis for their decision. But then again, my co-worker makes the same as I do. Also, they include my retirement to CALPERS as gross income but then again my co-worker also gets that liste though it is not part of our monthly income. He got to talk to a neogtiator; he explained it to him and he got the modification. For some reason they refuse to let me talk to a negotiator. Also, every now and then they say things like…the negotiator put a note in your file to call this number 1-866-607-3235 and when I call they say they have no clue, put me on hold for long stretches of time then the disconnect me, or forward my call to yet another unsuspecting party!

Anyway, I do see grounds for malicious persecution here and possibly a discrimination lawsuit. I have asked Sharon Sosa and others in BofA loan modification and they get nervous and don’t answer me why they owuld approve my co-worker but not me when if anyone is salvageable it is me that if Iam having trouble making ends meet it makes much more sense to refi me and instead of struggling to make 2040.00 payments with the refi an 1100 dlls payment is doable and a no brainer for their finance dept to discern.

I am writing this in detail and I have the notes on each conversation at each stage, the dates and times, the names of everyone I talked to, the checks I sent, copes of the trial basis coupons, and a detailed anaylisis reveals I acted as responsibly as can be done. I therefore have to conclude that BofA is TRYING TO LEAD ME TO A PREDETERMINED POINT WHRE I DEFAULT ANSO THEY CAN REPO MY HOME OUT OF PURE, MALICIOUS AND DESPOTIC GREED!

In light of this whole deceptive scheme, I am looking for an Attorney to file a lawsuit for all the deceipt, abuse and misleading information. I must also say that in order to process my loan I was placed in a position to pay for an appraisal about 600.00 when Sharon Sosa knew or should have known it was potentially going to set me back further in my financially strapped situation. Needless to say there have been a lot of emotional pain and suffering, marital discord, anguish from the bill collector calls when they knew I was in the loan modification process several times they told me to look for a second job even though I told them I am under doctor care and health monitoring for a variety of helath issus related to aging. The overall feeling of pending doo and worthlessness becasue how else can you view it when it is your entire life investment that greedy BofA wants to take away! We hope and pray we can payoff our home (we only have 7 years to go in our current loan) and we’d like to then retire. we are 52 years old and prospects for starting over and loosing our home look very grim should we loose our home.

MR Moynihan / BofA CEOs:

Please stop the greed, the abuse, the dehumanizing . Let people like myself pay their homes. How can yu knowing that like my sotry there are thousands or millions of american families trying to hang on to their dreams, their lifes as they ‘ve known it. If it was your parents, your loved ones…would you allow BofA to just keep the money these very individuals made possible for you to bail out and give them no assitance, have BofA collectors, customer dervice and loan officers do as they’ve done to us? If not, why let them do it to us that are willing to do everything possible to make out homes affordable. SO far BofA has done the opposite, that is: BofA has made our homes unaffordable so they can keep it if it has equity and as in my co-worker’s case, they made it affordable to keep them making paymnets on upside down properties.

The negotiator Amy nemoyer does not return my calls then I e-mailed again got a call from a man who gave me her boss name and phone, a joe cervolo 716-568-5520 called it several times, the coward has it on permanent message mode, no return call either. Just seems the try to make it appear like they are involved but they really don’t move anything along. All of these characters only have one thing in mind…collect a paycheck without doing the work!…this is an ambarrassement to BofA and the Nation as a whole, it is so Anti-American and it is sad that our institutions are turning into a bunch of lazy, unethical , fraud oriented gang of canivers!

At this moment I ask you give me some direction on oining an adequate calss lawsuit. Not a very nice way to seek help, is it?  Of course not!  why then when we the home owners wanting whole-heartedly to do what is within our means like make the trial payments you set; send you the documents promptly; show a positive disposition when dealing with your assigned negotiator; even though since last November to mid May of this year I went throught constant harrassment while already on the program.  LET ME TELL YOU, I have lost a lot of sleep; time and hair due to the stress generated by your debt collectors, receptionists and outsourced messaging services, not to mention the time spent and frustration factors that I should be restituted money to make me whole again.
I spoke with Amy Nemoyer yor Negotiator finally as I was typing this e-mail and she advised me she’d review and speak with Joseph cervola and in a week I’d hear from her.I asked about who has the note to my loan and she could not tell me.  I am hereby asking you that I need a certified true copy ofthe original loan note that gives you the right to foreclose and make representations that enble you to collect and foreclose on my home in the case I default.  She could not answer this either.I am asking you for :

The name of the investor(s)  their contact information (who they are; who the financial executive and attorney of record is; their corporate name; address and telephone numbers and state they have their corporation registered under, etc.)

A ”certified true copy of the note”  meaning the original loan note document that entitles you to act as a collecting agent for the investor.  According to the FDCPA (Fair Debt Collecting Practices Act) and the Freedom of Information Act, You in the capacity of collectors are required to provide uponrequest.

Dear Sirs,

I received your notification denying my loan modification based on the prior to taxes amount of my income.  Once again, you decided to ignore information I gave you in this regard.  This cannot possibly be a true standard since I told you my co-workers who make the same amount were approved.  Such is the case of Mr. Richard Daugherty.  In  his case it did matter if he takes home the same amount I do.  In his case, it did matter if he explained to you as I did that we pay off our bills from take home pay.  deductions are arbritrariky taken and we do not have a say so in it.  In his case, that did matter…why?  becasue he is white? you tell me why! then.
At this moment I will need a plan to remedy this situation in order to keep and stay in my home.  I believe a new forebearance agreement allowing me to make reduced payments for the next 3 to 6 months will allow me time to get rid of some debt after which time I may resume regular payments. 
Please contact me as soon as possible to determine what that will be.
I would also like to ask you review the loan for errors made in the application of interest monies charged.  My original loan called for a rate reduction if I made 24 consecutive oayments without delay or being late.  I complied with that criteria but the reduction never happened.  I contend that you should adjust that and prove to me that you did with the paper trial and copies to be supplied to me showing you did, when you did and how that was applied.  In regards to late fees you applied or are applying,  I also would like for you to send me proof that you actually did pay out such monies and to whom.
Time and proper legal action will demonstrate that it was in your best interest to formulate and approve a permanent loan modification as opposed to paying the price of consequences of the abuse you have subjected my family to.
Please respond within the time frame allowed by the law.  I will be referring this matter soon to a litigation specialist for  filing in the courts.

They told me it is Federal law that if you ask about the program they can automatically escrow you, I told her we were never notified of such a thing and we were denied for the program anyway, 3 hours later and on my 9th transfer I end up with Crystal in the tax department who informs me that they paid my third and forth quarter taxes because I was delinquent. I told her that was impossible I was not delinquent, well I drove up to my tax dept the next day and asked for a print out to prove that I had paid my taxes, I call B of A again and I am told I can not speak to Crystal because it is random and you can not be transferred to a person! So I explain my story again and I’m told that BofA will seek a refund and my payments will go back to $828 in about 3 days. Well to make a long story shorter I am still battling this out, and BofA has now escrowed me to April 2011, The last person told me I’m not delinquent in my taxes but until I pay them for the future taxes they paid I’m stuck. So they can keep escrowing my account until the cows come home, and they will always keep me stuck under it, never able to pay back the escrow because as soon as I do they pay another tax payment. Sounds shady to me. BofA finally sent us the paper work for the program on April 2nd, it said to fill out and return by April 18, 2010, we didn’t fill it out or return it, but on April 4th (only 2 days after we received the paper work )we received another denial into the program letter. So I filled a complaint with the OCC, Banking commissioner and I received a voice mail from the office of the president, who funny enough did not leave me a call back number…and finally I received a letter from a Peggy E Milbourn SVP Customer relations Executive. telling me that they have attempted to contact me to consider me for loan modification and I need to fax them my information…This is laughable, I was denied twice once by letter, once by phone, never filled out any paper work, wasn’t delinquent in my bills or taxes and Ms. Milbourn left a general customer service number on the letter, so I can’t call her and scream….

So please if you have any advice please let me know.

Obviously Bank of America has implanted this attitude with their employees. They do not care that I have spent hundreds of dollars advertising these properties, that I have inconvenienced already depressed sellers by all the numerous showings or the hours I have had to spend bird dogging them just to follow up on what they have told me they are going to do. Not to mention the time other agents have spent on this property.

My work and that of thousands of other REALTORS across the country provide these people with jobs by submitting these short sales. Perhaps they would wake up if we stop dealing with them and stop working with their short sales or loans. I tell my clients to beware.

When we moved to Florida to be closer to family the only mortgage we could get was an ARM which is what is killing us now. We tried to get out of the ARM when the banks started to have issues but they would not allow us they told us that we had to wait until February 2009 as we purchases out home in March of 2007 and Feb of 2009 was went we were able to refinance. My personal health is being affected by all the stress this problem has been causing me. I want to pay my mortgage and have been trying to do it but with the arm I cannot keep up as I keep getting raises ever quarter and I anly get a salary increase once a year.

My mother, banks with BOA and I will be convincing her to move her assets to another banking facility.

Sit back Sir and take a good look at your company. We bailed you out know you should try at least to help us!

I guess if I had 45 billion to invest I could turn a pretty good profit as well. I sent in all the required paperwork to Jennifer Gurule in January ’10 and was told to wait to hear back on which program I qualified for. First I received a letter explaining that I did not qualify for a modification program and that I should continue to make my monthly payments, at the time my payments were current. I stopped making payments that same month and then received a letter explaining that I did qualify for a program and details were on the way. I continued to make calls to BofA, (speaking to someone different every time I call) each call is met with the same frustrating process; enter your loan number and zip, then someone gets on the line and asks for the loan number AGAIN! and has no clue (so they say) what is going on with my account. I finally talked to Jennifer about the modification offer May 3 `10, the offer consisted of adding the late payments to the loan and starting payments again (GREAT modification). I called 5 more times and finally a different BofA employee said that ANOTHER offer is on the way. From what I am reading on the internet, I will be waiting for a COLD DAY IN HELL before you and BofA helps one of your customers. Is that the truth Brian? Or do you actually care about the little people that bank with you? Or is helping customers decrease your bonus a couple million?

Brian, how about you help me get a 30 year fixed mortgage at fair market value for my home with a decent interest rate and with drawl the negative reports on my credit? You have been able to since March 4 2009, instead I get the run around every time I call your bank which seems like an attempt to frustrate me into submission. Please explain…

I have kept your bank informed with any and all information that they asked for or needed. Now, it is just like I have seen on the television or read in the newpaper. You have deliberatly ruined my credit and are now trying to take my home away from me. How can this be the way a bank operates? How can you feel good about your buisness ethics?

Would you please respond to this letter and let me know if there is anything you can do so that I won’t lose my home? I am asking as an honest person dealing with another honest person I hope. I don’t see how this could be the only outcome from a bank such as yours.

I was told I would hear back from them in 60 days.

I Faxed documents requested to FAX 1-866-261-6472 on 9/21/09 as instructed, to Home Retention Program including:

2 pay stubs July & August 2009

Tax return 2008

I included my loan # on all pages of all documents as instructed

I Called and Confirmed receipt by BAC, and received a fax confirmation.

November 2009

I Called to follow up in November 2009 because I did not hear from BAC and was told documents were being reviewed, it might take more than 60 days.

December 2009

I Called again in December 2009 when I still didn’t hear from BAC and was told there was no record of my application. I was on the phone for 5 hours on 12/8 and talked to 8 different people, I was transferred 12 times, disconnected 6 times, hung up on once.

I finally got someone who was willing to help me so I started over.

Second submission: Started process over in December 2009.

I Received a Fedex package from Bloomfield Colorado, Making Home Affordable Application and instructions dated 12/10/2009, and had to submit all documents requested to BAC by 1/9/2010.

I Submitted documents requested in return Fedex envelope provided on 12/11/2009

Documents included:

Hardship letter

MHA application

Form 1126

Form 4506T

Tax Return 2008

Two pay stubs for October & November 2009

I included my loan # on all pages of all documents as instructed.

I called on 12/30/2009 and was told Home Retention had not received my package yet, and was told to call the 1-877-221-0825 number in Colorado for service from now on. So I called the number as instructed and Confirmed BAC receipt of my original packet on 12/17/2009.

January 2010

I was also instructed to contact HUD, which I did, and met with a rep Oksana Hill 916-646-2005, ext 204 on January 4, 2010. The HUD rep assured me that I did everything I needed to do, and should keep following up with BAC.

February 2009

Third submission: I Called 1-877-221-0825 on 2/5/2010 to check the status and was told they needed 2 mos bank statements and 2 mos SSI statements. I told the rep I didn’t receive Social Security payments, and the rep told me to send a letter stating that.

So I resent the 12/09/2009 documents, plus:

bank statements from December 2009 to Feb 2010,

latest pay stub for January 2010 and Feb 2009,

along with a letter that I am not receiving Social Security payments.

These were faxed to 1-888-258-7329 on 2/9/2010 to Home Retention Department referencing order # 3522 as instructed.

Confirmed Receipt fax was received by BAC.

I Also sent copies of the last 2 years statements from Social Security with estimated benefits showing what I would receive upon retirement, to prove I was not receiving any benefits yet as I am still working full time. These were sent by fax to 1-888-258-7329 on 2/22/2010, referencing order #3522.

Confirmed fax was received by BAC.

March 2010

I Followed up in March 2010 and was told everything was being reviewed. Spoke with Fred Burch at 1-877-643-2788, who helped me get to Home Retention Department, and confirm that my application was still being reviewed. I was told the review process may take longer than 60 days because of the volume of applications that were backlogged.

April 2010

Fourth Submission: I Followed up on April 5, 2010, with rep at 1-877-221-0825 and was told someone called me and left a message that they were still waiting for same documentation that I sent in February. I informed them that no one had called me or left a message, not at anytime since I started the process, all contacts with BAC have been initiated by me. The only contact from BAC was the orginal Fedex package I received in December 2009. Upon further checking, the rep told me the documents I sent in February were there, but had not been scanned in, so she would request that they be scanned and then escalated. The rep said they still needed the following additional information, so I submitted the additional documents requested by Certified mail/Return Receipt Requested to the Bloomfield Colorado address, including:

2 months most recent bank statements for Jan and Feb 2010

2 most recent pay stubs Feb and March 2010

2 years tax returns and expense statement 2009 and 2008

All pages of all documents included my loan #

I also included a cover letter stating that not only had I lost $800 a month income in 2009, my loan payment had adjusted, and had gone from $1400 to $1715 in January 2010.

Confirmed BAC received these documents on April 12, 2010

May 2010

I Followed up on May 7, 2010, with rep Karen Thomas at 1-877-221-0825 in Colorado and was told my application was closed because I did not submit all the documents requested within the allotted time. When I explained I had submitted everything requested more than once, the rep said there wasn’t anything she could do and after I asked her several times who else I could talk to, she instructed me to call the Home Retention Department at 1-800- 669-6650 to find out what my next steps are.

I called and spoke with Karen Vanagon, told her the whole chain of events, she transferred me to the Imminent Default Department.

I spoke with Manny, told him the whole chain of events, he did some research, and said the application was still being reviewed, it had not been declined yet, and he would request that it be updated and escalated and said I should call back 1-888-325-3120 to check the status within 7 – 10 days. I told him I had called in April and the rep told me the same thing then, that she was going to escalate my application.

I Called the HUD rep Oksana Hill 916-646-2005 ext 204, left her a message to let her know I am having difficulty with BAC and the loan mod process and needed her assistance to intervene on my behalf. Oksana called 888-325-3120 to check on the status for me, and was told my application was still being reviewed, and I should keep checking every 2 weeks. I explained to her I was running out of time and money. I was desperate so I sent an email to the CEO Bank of America on 5/20/2010 seeking assistance with my application.

I called BAC on 5/21/2010 at 888-325-3120 to follow up on the status of my application. I spoke with Carol who told me my account had been transferred to the Office of the President for handling, and she transferred my call. I spoke with Dominic in Customer Care Advocacy at 800-669-6607, and he told me my account would be assigned to Angela Spiekerman. He reviewed what was in my file, and asked me to submit updated documents (2 most recent paystubs, 2 recent bank statements, and list of expenses). He gave me 2 fax numbers 800-658-0395, and 800-658-9364. He also told me to call back in 3 – 4 days to make sure the documents had been received. I tried calling today to confirm receipt of my faxed documents, but was put on hold in the que and not able to speak to anyone yet.

I am getting no where. My paper keeps getting lost, and I have to keep calling to make sure it is moving forward, only to have to start over again and again. I even filed a complaint with the Office of the CEO and President, working with a Consumer Care Advocate, and still I am getting no where, my phone calls and emails go unanswered. I recently filed BK, and I may still lose my home. I appreciate all that you do in fighting these crooks. I support you 100%! I assumed that would be the end of it, until our next bill arrived, and our normal payment of $828.00 was no more, our new bill was $2,424.00 I called Bank of America immediately and was told that because we asked about the program, you automatically escrowed our account. I explained that we have lived here for 10 years and have always paid our property tax and insurance separately. After being transferred 9 different times and spending 3 hours on the phone with your bank, I am finally transferred to Crystal in your tax dept. who informs me that you had paid my third and forth quarter taxes because I was delinquent. So I drove up to my tax dept the following day and requested a print out of my tax payments which prove I have always paid my taxes. I call bank of America back and I am informed that I may not speak to Crystal because you can’t be transferred to a person and apparently no one has a direct line. So again I explain my story and I am transferred to Shondine in the tax dept. who told me that you will request a refund and my payments will go back to the $828.00. My new bill comes and it is now $1,860.00 lower but not near the original $828.00 so I call back again and re-explain my story this time I am transferred to John Williams in the tax dept.who tells me that you dropped my home insurance off the escrow but until I pay back the tax payments made by bank of America I cannot be dropped from escrow entirely. I told him I was not delinquent in my taxes and I had paid the money Bank of America said I owed, when I received a foreclosure letter even though I was still fighting the amount I owed. I had paid a total of $5,100.29 and I asked him where that money had gone if not toward the escrow. He told me he was going to put me through to your accounts receivable office and he would stay on the line with me. He never put me through to accounts receivable instead he told me, that I was not delinquent but I must pay back for the future taxes that Bank of America is making on my behalf. So my recent bill shows that you have me escrowed until April 2011. If I keep making the payments to get out of the escrow and you keep paying future escrow payments all along knowing that I am constantly battling this out. John Williams made the comment that I would have to pay Bank of America and my taxes anyway, so why not just pay the bill they send. I’m going to break it down for you here. My normal bill for the three months would be Bank of America payment of $828,$828, $828 and on the third month I would pay my tax payment $1,650.00 so my total for the 3 months would be $4,134,00 that is 3 payment to Bank of America and my tax payment. Now if I pay Bank of America’s payment with tax escrowed I would be paying $5,580 for the same time period which is $828 plus (+) escrow amount of $990.66 so the difference between your way and my way is $1,446.00 which I can use for my other bills. So as you can see by forcing me into this escrow you have seriously hurt our credit and our way of life. I am asking you to help stop this. I received a voice mail from a women (Benina) in your office who called to investigate my complaint with the OCC and funny enough she did not leave a call back number to reach her. Then on May 15th I received a letter from a Peggy E Milbourn SVP Customer Relations Executive who states that they have tried to reach me unsuccessfully to enroll me in the making homes affordable program and I am to fax her my information. On her letter she left a general customer service number which I can not be transferred from…and no one there knows Peggy.

Let me explain this to you again:

1) I called in Nov. 2009, we never received any paper work to fill out.

2) when I called back we were denied over the phone.

3)My bill jumped from $828.00 to $2,424.00

4) You told me to pay back the escrow and I did, but then you escrowed me to April 2011

5) I finally receive the paper work for the program on March 22, 2010 I do not fill it out or return it.

6) The application paper work said I must return it by April 18th, I do not send it back

7) March 24th I receive a denial letter into the program even though I didn’t fill out the paper work, and it has only been two days since I received the paper work any way.

8) So I am denied twice once by phone and once by letter, have not been delinquent in my payments or taxes and you refuse to put my account back to the way it was for the past several years.

9) $1,446. may not seem like a lot to a big bank like you but I need to pay my other bills which are suffering because I am being extorted by Bank of America.

10) Please, set my bill back to what is was and refund me the over payments so I may get back on track.

Ben Pavone and John Wright are fighting for there rights and so am I. Please do the right thing here and set my account right.

After I emailed, your pal and mine ( LOL) Mr. Moynihan, I received a letter back from his office pretty quickly asking me to call Carmen at a specific phone number and extension, and I do but I still don’t get this Carmen lady instead I get a Cecilia, who explains to me that the manager has approved for me to pay back my escrow in 60 months and my new payment will be $894.00 I tell her that it is not my fault for this escrow and it was B of A ‘s fault. She tells me regardless, I still need to pay them back. So I hang up with her and call a lawyer, I’m done with talking to B of A. So as I’m waiting for my appointment with the lawyer to roll around a week later, I receive a new bill and it isn’t what they told me it would be, it’s $977.00 “surprise,right” I mail the payment in and B of A cashes it of course. I finally go to my lawyers appointment, and he shifts through my mountain of evidence and all the contradictory paper work I have and he is stunned. The lawyer thanks me for my record keeping and my good evidence and tells me we should definitely prevail in court, only no one knows how long it could drag on for, but he advised us to find a new bank and get rid of B of A asap. So we are currently looking into that, but guess what came in the mail today?!!! A foreclosure letter saying B of A wants $1,788.00 now where the heck did this amount come from???? The new bill was supposed to be $894. in came in as $977.00 which we paid and they cashed, but now I owe $1,788.00 It’s still June how can I receive two bills in the same month at vastly different amounts in which none match what they told me it would be in the first place! I called my lawyer and emailed him the foreclosure letter and all he can say is WOW they are messed up!! No Sh**! LOL So that is where I stand as of today……just shaking my head, can’t say I’m still flabbergasted anymore, because there is nothing they do that shocks me any more!

In on-line Banking Center, Bank of America says that a negotiator will call me after receiving the Loan Modification Package. The negotiator never called. This is why I am trying to talk to a negotiator. After waiting for the negotiator to call, I called Home Affordable Modification 800-846-2222 and 800-669-6607, but no help at all. Instead, the Loan Consultant told me they made this high priority, red flag and sent the request to Danny Kendris (Negotiator). Now I need to mail back the Loan Modification Package by tomorrow.

In the meantime, I have called Bank of America many times looking for a Negotiator or somebody else who can help me, but the loan consultant told me that only Danny Kendris can help me, because he did the paperwork, but there is no way to contact him or find him. I have also tried to call him, but nobody is picking up the line and the call gets routed back to the Loan Consultant again. Now I need to mail back these documents by tomorrow.

In a way I am glad I did not refinance thru Bof A, as this experience has proven that you are all, worthless as a whole, scamming the American people, and I hope never to do any kind of business with you in the future. Thank god I don’t have any other Bof A accounts.

It was shortly after that I received a letter from Ken Sheller stating that my husband and I qualify for a modification. However my employment status had changed so I called BAC to see if the mortgage payment can be reduced due to my current employment situation. I called BAC and spoke to Susie Park, customer advocate, which she requested various information so that a determination can be made to see if I qualify for a re-modification. This was on February 4 2010. I called Susie to inform her of my change in employment status she requested to get my current information to be faxed to her. On February 8 2010 I spoke to Mia ext 8237 to see if my information was received, she told me that I would need to talk to my worker which is Jennifer Dazila. I called again on February 9 2010 and was transferred to Rodney Gillins and he told me to refax the information and that I should only talk to him about my situation. I faxed my current information directly to Rodney on February 16 2010. I have called Rodney numerous times after sending in my information but have not gotten a response. I finally called again on April 22 2010 and spoke to a women and I was told that my information was still in review.
 
The letter dated May 21 2010 stated that my husband and I are not eligible for the modification program or any other loan modification programs.
 
Now I am wondering how I was able to qualify after I made a complaint to the Office of the Comptroller of the Currency but when I requested for BAC to look at my modification again due to my change in employment status I am not told that my husband and I don’t qualify.
I would like an explanation that makes sense.

I requested help via a loan modification in November of 2009 and was told on a weekly basis that everything was being handled and processed as normal, it wasn’t until January of 2010, I was notified (and only due to my phone call) that nothing had been completed with my loan modification. I was advised by a supervisor that it is was not setup correctly due to an error by a B of A employee and that the process had to start all over again. It was not until February when we were sent another packet because they said they never received the documents. During a conversation on a check up phone call to B of A in March of 2010, I believe it was around the 15th or 16th, I was told that we were approved for a trial modification in the amount of $1783.93 by the Home Retention Department. I had requested the documents in writing and was advised I should receive them shortly, but to make the trial payment starting in April. I scheduled the payment over the phone the same day and here is confirmation number 20100317180518846P. In April I contacted B of A on a weekly basis asking for the trial modification documents to be sent to me and was advised it should be just a couple of weeks and for us to be patient as B of A was very backed up. I then received another packet requesting all of the same documents which my attorney and I had faxed multiple times, now stating they never received them. I re-sent the package on April 17th via the pre-paid Fed Ex envelope that was provided and verified it was received weeks later by phone call to the Hope Department. During the month of April I was told that I was now behind in my payments due to the trial modification payments and after speaking to a supervisor, I was told everything was fine as he could see we were on a trial modification program. I asked him at that time if this would affect our credit and if we would be charged late fees. He emphatically said no as there is a block put on our credit and it would not be impacted. This phone call was on April 30th and the supervisor only gave me his first name as “Mark”. I then scheduled the next trial modification payment with Mark and the confirmation number is 10012102.

Now it is May and on May 13th, I received a letter from B of A stating that they were still missing documents and that if we did not return them by May 12, 2010 that we would be taken off of them program. Here lies my frustration again, I was told that all documents were received and accounted for. When I asked what documents were missing nobody could tell me and I was bounced around from HRD to Imminent Default to the Hope Department. The Hope department confirmed all documents were received and the letter was sent out in error and it had happened to a lot of customers. I then called almost every day trying to get answers as every time I spoke to someone in the HRD department I was given different information, some associates could see the trial payment in the system some couldn’t and told me that we were late and it was affecting our credit. I spoke to numerous supervisors and was re-assured on many occasions that everything was being handled and it was just waiting to be reviewed. During this time my attorney also contacted the Hope and HRD departments and was advised the same information and that we were on a trial payment plan and my credit was being blocked due to the MHA program. At this time I made the third trial payment for June 1st in the amount of 1783.93, this was done with a Supervisor name “James” and the confirmation number is 10252786. When I asked him why there was so much confusion with my trial payments, I was advised that when they first quoted me my new payments everything was done verbally, but now it is done via packet. He then took my payment and transferred me to the imminent default department to find out why I had not received any paperwork. After waiting on hold for quite some time, the person in the imminent default department transferred me to a supervisor to discuss. After speaking with the supervisor she advised me that she would have to escalate the call to the escalation department and she would get back to me on Wednesday, May 26th. I waited and on Wednesday I did not receive a phone call, instead I received a form letter dated May 19th, 2010 that stated that if I was having financial troubles to call the HRD department. I decided to wait a another day or two for the supervisor to contact me back and on Friday I decided to contact the HRD department. When I called to find out what the status was with my Loan Modification I was told I was not in one and that the review had been closed. There was no documentation on why, no contact to me via phone of mail. I was then told that we were past due and that late charges were accruing and it was being reported to the credit bureau. Everything that was told to me prior was not done and speaks of bad faith.
What I am requesting from you and your company at this point is to honor what was told to myself and my attorney.

1) There will be no late fees charged
2) No information will be submitted to the credit bureaus and if already done, retracted.
3) Please find out what is going on with my loan modification and see to it that someone is doing their job and working on it in a diligent manner.
I started paying the $1783.93 because I was told to by your company and I don’t think that it is fair that I be penalized for completing all of the necessary steps and following the bank’s direction. If this matter is not resolved then I would be forced to file suit for bad faith. I can be contacted via email.

Since then we have been promised paperwork finalizing a modification, then told we were denied a modification because your company did not have any information from us. All of our information was sent to you during the trial period and should have been recorded into your system, but we resent it as requested and heard nothing from your company for several weeks. We were then told that our modification was being worked out and the gentleman on phone, Dave, said the paperwork would arrive at our house within two weeks. The most infuriating part of this for us are the constant phone calls we’ve received from your company letting us know that we’re behind on our payments and feigning ignorance of all the steps we’ve taken with your company to come to an agreement that works for both of us. When we speak to your customer service agents they will say “I don’t have that information in our system” and when pressed further they will admit that they have the information right in front of them.

I understand that your company has had its fair share of trials and tribulations over these past two years and I would hope that your experience would help you feel some compassion for your customers who are also experiencing troubled times. When my husband and I bought our condo in 2007 we were able to afford the monthly payments without issue. Over the last two years we’ve tried our best to keep up with payments in the face of reduced hours and lost jobs but unfortunately our current financial circumstances make it impossible to pay the full amount of our mortgage every month. And given that the value of our condo has dropped over 40% since we purchased it I really feel it would be in your company’s best interest to work with us rather than foreclose on us, as you will never be able to recover the full amount of our loan in the current market.

I am asking for you to reconsider the way your company treats customers who have been hit hard in this economy and need your help. It would work wonders for your public image for Bank of America to be more aggressive in working out solutions that help people stay in their homes and reduce the amount of foreclosures in your inventory. I appreciate your time and attention.

It is my hope, that somebody at Bank of America will assist me in resolving this matter before my loan goes into foreclosure and it becomes to late for me to retain my home.

03/01/10 Bank of America drafted the payment despite the termination online.

03/01/10 I placed a stop payment on the draft and was charged $25 by my bank and thought it was a one time event. I was not aware that this would be a 6 month enactment and that any payment I tried to make in the amount of $915.96, would be returned.

03/04/10 Received notifications that my payment was returned and I was being charged $25 in late fees.

03/25/10 Made online payment of $952.72 and an additional $6.00 fee to resolve the March payment. I received an email that several “trial deposits” would be made to my account I needed to verify in order for this payment to be completed, despite the fact I have used the same bank account for the life of my loan and saw no need to have to verify this information you already have. Three trial deposits were made for 28 cents; 77 cents; $1.05.

04/01/10 Payment for electronic draft for $915.96 attempted by Bank of America system again, despite previous cancellation.

04/06/10 Payment draft was reversed. Rec’d letter indicating it had not gone through and was returned for “Authorization revoked”

04/08/10 Rec’d notification that stop payment had been placed and payment had not been made.

04/23/10 Contacted Customer Service again to resolve. Spoke to Gwendolyn Isokpan in refinancing, who informed me I was qualified for a “fast track” refinance. Loan #xxx-xxx-xxx. Contact 866-645-5503 x5012. She stated she would send paperwork.

04/26/10: Attempted to make April payment for $915.96 online but was not able to complete transaction. Made several attempts to call Customer Service but could not complete calls, they were disconnected by automated phone system.

04/29/10 Contacted Customer Service to inquire about what was going on with my payments. Spoke to “Latonia” 800-399-1762 x8225. In reviewing history, it was discovered stop payment was still in effect and was resulting in returned payments. Instructed to release stop payment and fax confirmation to her and she would remove late charges and make notation on my account.

05/03/10 Rec’d email from Gwedolyn Isokpan that she had new extension and could be contacted at that number.

5/04/10 Released stop payment order at Callaway Bank as instructed to resolve issue and faxed as instructed. Attempted to call Latonia back directly and was unable to contact her at the provided extension and informed that any Customer Service Representative could address/resolve my issue.

5/06/10 Called Customer Service and spoke to Rakiah x 9163 to make April payment over phone for $915.96. Confirmation #11004978P. Informed May payment amount would be $885.26 but I had a shortage of$118.37 in my escrow account. Same day, Rec’d notice that my payments were behind and I owed $1041.18. Same day replied to Gwedolyn Isopak that I rec’d her email and to let me know what documentation she needed. Rec’d a reply addressed to “Kimberly” that she needed documentation I was not familiar with. I then called to find out what she needed. She reviewed and asked if I had rec’d loan docs. I told her I had not. She stated the paperwork had never been mailed and would mail it out immediately. Rec’d documents a few days later.

5/21/10 Faxed signed documentation back. Rec’d phone call I was not eligible as my April payment was noted to be over 30 days late. She apologized and said I would need to straighten it out with Customer Service in the mainframe computer, the AS400.

5/28/10 Called Bank of America Customer Service. Spoke with “Raymond” 805-520-5019 who first suggested the HOFA program but then referred me to Default Prevention Program. Transferred me to that department, but after 20+ minutes of being on hold, was disconnected by your phone system.

06/02/10 Called Bank of America Customer Service at10:28am and spent 1 hour and 6 minutes on the phone and transferred to 5 different people. I first spoke with “Sharon” and asked if I was eligible for the Homeowner Retention Program. She asked me when I could make a payment. I told her I needed to speak to someone about that. I was then transferred to “Michelle” in the Making Homes Affordable modification department. She attempted to review the requirements and check eligibility. I told her I knew I was reasonably certain I did not qualify b/c of the 31% and I didn’t want to waste her time if I wouldn’t qualify. She made notation as a “refusal” to provide information. I was then transferred to “Desmond” to discuss “partial payment” and he informed me I had refused participation and I had to complete that process before I would receive any assistance. I told him I did not refuse and would he please note that on my account. He told me it didn’t matter what wording was used and encouraged me to proceed with the process and if I did not qualify, I would have other options available. I was then transferred to “Jim” and as predicted, I did not qualify and was told by him that I could contact a HUD counselor or he could transfer me to the “short sale” department. I then tried calling your Executive Customer Relations general line: 704-386-5687 and spoke to “Avis” an attempted to discuss the situation. She asked questions and listened to my situation until the phone call was disconnected. The result of that conversation appeared to be moving in the direction of “sorry we can’t help you”

It is abundantly clear that home “retention” is not an accurate description of your services. I am desperately trying to remedy this situation and find some relief so that I don’t lose my home and you don’t lose money by foreclosing on my property, but nobody seems to want to discuss that. They all want to tell me that I don’t meet guidelines for anything but foreclosure.

I have contacted Bank of America numerous times to resolve my payments and request some type of relief so as not to go into foreclosure. I have spent countless hours on the phone being transferred from one department to the next, often being placed on hold for long amounts of time and ultimately disconnected by your automated phone system. I have been told repeatedly that I do not qualify for any program or refinance because of the cumulative effects of this payment situation. Initially, I applied for the “Making Home Affordable” modification program in August of 2008 and was told that I did not meet eligibility requirements b/c my gross income exceeded the 31%. I then attempted traditional refinancing in hopes to obtain a lower interest rate and lower payments. Twice this resulted in being told me debt to income ratio was too high and I needed to pay off my auto loan of $25K to become eligible. I then attempted a HUD loan but the out of pocket expenses became excessive and that loan was not closed. I paid $425 for an appraisal and told I must fix all peeling paint which was going to cost $2K. I know have an appraisal that is useless and am out almost $500 I could have used to make my mortgage payment. In a last ditch effort, I contacted Bank of America again and found myself qualified for the “fast track” loan without another appraisal. I thought I had finally found a solution. However, because of my payment situation, I was told I am no longer qualified

In summary, the late payments and reversals were as a result of your system. I correctly canceled my auto draft and it was your system that failed to recognize this for over two months. I was forced me to remedy at my end and at my expense and then charged late fees and identified as having a payment being over 30 days late, disqualifying me from refinancing with my own current mortgage holder. This is now impacting my credit report and appearing as if I am at fault. At no time have I spoken to any one person consistently to address and resolve this situation in a way that is beneficial to me, “a valued customer,” of Bank of America. I am now two months behind (approximately $2,000) and unable to make that payment despite repeated attempts to resolve this matter. I requested, begged, and pleaded to be put in contact with some type of “account manager” who could review the situation and help me resolve and was told that there was no such person. This has been an extremely disappointing and frustrating experience and would appreciate an immediate response and resolution.

Update:  Molly wrote on 08/11/10: hey there!   Not sure when I last updated, but essentially back to point A after BOA sent me 3 sets of correspondance telling me how sorry they were and had taken all necessary measures to refund fees, straighten out anything reported to the credit bureaus and now my loan had been referred to a “executive” for modification, who I would deal with and was aware of situation.    HA HA HA HA!!!!   Got a “rejection” letter from BOA saying my modification was turned down….due to late payments and delinquency on my BOA account!!!   HOW IS THAT FOR IRONY!!!

Update on 09/15/10: Dear Mr. Moynihan, I just wanted to follow up on my loan modification and express my frustration when trying to catch up my mortgage payment today.   I was going to make an online payment, but as usual, Bank of America won’t allow you to do that if your payment is late.   I then called Customer Service and after entering all my information, was put in contact with “Velma” who made me repeat all the information (TYPICAL AUTOMATED SYSTEM).   After providing my banking information, she informed me there was a $20 fee!!!   Since when?   I laughed and asked if there was a cheaper way to make a payment and she offered an address where I could “overnight” my check….seriously?   I can hardly afford to make my payment and your going to charge me to make a payment?   I was in the process of working with someone in your office about a loan modification but after getting my hopes up, received a ridiculous letter saying Bank of America couldn’t help me b/c my credit history and payment history with my EXISTING MORTGAGE was poor.  Perhaps I am confused, but isn’t that why I am applying for financial assistance?  Because I am behind in my payments and have been asking for help for TWO YEARS with NO SUCCESS!!   I have given up.   I no longer care about my credit score, making payments, or losing my house.    You can have it…..thanks!!!!  You all are really doing a bang up job!!!!

My name is Mary-Angela French. I am a former Title Abstracting vender for Bank of America. In March of 2006, seven short months after Hurricane Katrina, my family and I moved from Concord, NC to Slidell, LA. I left my abstracting business and with my husband and 6 month old son went to a devastated city to help. My husband, an electrician, and I are home remodelers and thought we could assist in the recovery of New Orleans. After moving here the economy took a turn for the worst; that combined with overseeing out of state rental properties, caused us to get behind on our mortgages.

More than five months ago we began contacting BofA customer service. After much paper work and numerous calls, the modification process began. March 19, 2010 I was told to make a payment on both properties, which I did, and they were sent back April 7, 2010. I contacted customer service again and was told that I was in “modification review” and I could not make payments. I then received a letter dated March 25, 2010 from Nationwide Trustee Services, Inc. stating there was a hearing on May 12, 2010. I contacted customer service again asking them if I needed to attend the hearing. I was told it was not necessary that my loan was in “modification review.” Finally, yesterday June 2, 2010, I was told that my house went to sale and there was nothing further I could do. Thoroughly discouraged, I spoke with an attorney and was told that Bank of America could rescind the sale and enable me to make arrangements to get current on my mortgage. I spoke to customer service repeatedly and was told otherwise. Without taking any of my new information, the supervisor said I did not qualify for any of your modifications. I have exhausted all resources after days on the phone and feel I have no other option but to join the class action suit with John Wright and The United Law Group and fight for my houses if someone with BofA won’t help me. A collective voice is a strong voice.

I provided prompt and quality background searches and was proud to work for your bank for many years. Now that I need your help no one has given me correct or consistent information to resolve the situation.

My family and I have worked very hard to acquire these properties and while I do not live in them, there are families that do. Now all I’m asking for is your help. Give me a place to start! I am willing to do whatever it takes to keep my houses and keep the families in them.

I phoned BOA and finally was put through to Dorothy in Advocacy. She looked at my mortgage and said that it states it was ‘under review’ but had not been assigned to anyone. She told me that I should continue making the modified payments from the six month agreement, she would ‘expedite’ my review and get back to me. That was on April 30th. I have heard nothing. I have however, received notice of certified letter from BOA which I was told was a notice of foreclosure by your repesentative. I phoned today again, and spoke to a representative who I asked to put me through to Dorothy. He put me on hold then said he wouldn’t be able to transfer me that my mortgage is no longer being reviewed and I was to start paying according the statements I received, as well as telling me I was over $11K past due. This includes the escrow issue that I still have not received an answer to. He was extremely rude and I told him to transfer me to Dorothy and he said he has sat on hold for 3 minutes and is unable to wait any longer. Apparently he had something better to do. Apparently I have all the time in the world to sit on hold. This call was at 9:33 am on 6/2/2010. I called the direct number (877)-327-9225 and after being on hold for 16 minutes, was able to talk to Nily who told me that the mortgage was no longer under review and I would need to reapply for the loan modifications.I did not receive one letter, one phone call, one email from BOA to tell me of the status of my mortgage. I did not receive one letter, one phone call or one email from BOA to tell me that I would need to reapply. I did not receive one letter, one phone call or one email from BOA to explain the issues I raised in my letter of February 4th, February 26th and March 1st, about my escrow and BOA erroneously paying taxes that were up to date. I did not receive one letter, one phone call or one email from BOA telling me that my mortgage was no longer under review. I did not receive one phone call, one letter or one email from BOA stating the past due amount was threatening foreclosure. BOA has sent information to the credit bureas stating my account is over 8K past due, which includes the ESCROW amounts that I have still not received a response about.I filled out another application with Nily. She said it would take 3 to 4 weeks for the Federal Express to arrive with the application and the instructions I need to provide. I also informed her that I NEVER received any application or request from BOA prior to this to provide information for a Loan Modification so I am actually at a loss as to what they were ‘reviewing.’ I can assure you if you check my records you will not any recent pay stubs or bank statements or financial information collection during the past year, which would have been necessary for review of an application for a loan modification. I then asked her what the status was of the foreclosure and she said that I should continue to make payments and that should hold off the foreclosure. I have to say that I am not very confident with the information I received from Bank of America. I asked her if I should obtain a lawyer and she told me that would not be necessary. I think it would be in my best interest to obtain a lawyer. I have filed a complained with the Texas Attorney General’s Office, the FTC as well as RESPA for violation of Section 6 and 10.It is absolutely unacceptable for customers to be treated this way. We started working with the negotiator, Patrick Lynch, who asked us to send in our financials in the Fedex package he sent to us – but before we could send our financials to the negotiator, we received a letter declining us of our modification base on our financials – but at that time we had not even sent to Home Retention or to Patrick Lynch the requested documents. This is the very reason for our concern. We then called customer service to provide us with the phone number of the Legal Department and the customer service rep gave us a phone number that went to Florida, an Apartment Complex. We thought that was very unprofessional to give us a wrong information all because we had asked him requesting legal documents on our loan. We were then transfered to a supervisor and he wasn’t helpful either – all that he said was “we are sorry for providing you with a wrong number.” An other time we called and a customer service rep said to us that she sees on her System that our modification has been approved on May 24, 2010. When we call another day we were told a different story. We were misinformed that Aurora Bank says they will not approve our modification but we know by law it is Bank Of America that has control to approve modifications. We are to the point very much fraustrated. We had a Forensic Loan Audit done and there were many violations found. We requested some important legal documents – Assignment of Note and Assignment of Mortgage and still we have not received any response. We were never given any written information when our loan was sold and re-sold to Aurora Bank. So we told them we will rather settle this by getting a principal reduction instead or our next option is to go to the court and have Bank Of America provide the court with the Transfer of the Original Assignment Of Note and Assignment Of Mortgage. We really want to keep our home, and have several times explained to the Retention Team on that matter. But to our astonishment, they sent us a Notice Of Intent To Accelerate and also sent us a letter with two options – either to “Deed-in-Lieu” or “Short Sale.” We we’ve been misinformed or lied to after Bank of America giving us promises and were not able to deliver – we feel someone wants to steal our property from us for a gain. I am sending you proof that I had received a verbal modification approval last Oct 2009 by one of the B of A reps ( work out dept). I was told not to make 3 mos payments to qualify for the modification. I had a Attorney friend speak to the Rep ( Majauna ) @ B of A and he was also told for my not to make payments for 3 mos. I was to start up again on Feb 1,2010 at the lower payment. As soon as I sent the payment in I was denied by letter. I argued with B of A and they did a new modification. Again denied. I can not tell you how many negotiators I went through in over 1 yr. In Oct 2010 ( it will be 1 yr. ) Please read all the attachments to get the full story. I am now involved with a Attorney who is working on my Modification with HEMP/HUD due to the laws and my FHA loan. Because I had went through the circles 2 times already with B of A and nothing gained. I was told that the HEMP dept would have to do a ” Manual underwriting process” witch should be better for me in the long run. I will tell you up front that I am not new to Mortgages,Credit Repair,Modifications: I have been a Loan officer for a few years in Nevada and I am now retired from that field. I don’t see where I can make any money from writing loans with all the programs that we had gone now. Originally this loan was made through Countrywide Home Loans.

My issues with Countrywide and Bank of America are numerous, as we have never received straightforward answers from either of the above. Each phone call over the past 2.5 years, is met with either a denial of our attempts (in the process of a third attempt at obtaining a loan modification out of pure desperation) or to refinance our loan, and always receiving either a straight out NO or after being requested by the representative on the phone to submit certain documents to process our request, and never receiving a call or notice in the mail regarding our request. And when we do call back to request information, we are told that it is not on file, and that the person we spoke with originally is not available, or that our request was denied, but not providing us any written document or verbal explanation as to why it was denied.

At the current time, I feel that our situation is bordering a fraudulent act on the part of the Bank of America and/or initially, Countrywide Home Loans.

We have a 30 year Conventional Jumbo Loan with a 7 year Option ARM. We understood that of the options, that the minimum payment (negative amortization payment) should only be used in rare occasions, as if used too frequently, it could increase the mortgage debt, as it accrued additional interest. However, due to financial distress, loss of employment, we have had to use that minimum payment option more than we would hav liked to, as we have been trying desperately not to get behind in our mortgage payments; and due to a decrease in value of our property by over 30 percent, we were unable to refinance our loan, which caused us try to receive relief by requesting Bank of America to to allow us to enter a loan modification.

What we discovered after the first two attempts to receive a loan modification is that Bank of America is using the minimum interest payment option (the negative amortization payment option) as our “principal/interest payment”. They are not using it as an “option” but are stating that it is our principal/interest payment on our mortgage statements each month.

Due to that misinformation, they have twice denied our eligibility into the loan modification program, because they state that our current “principal/interest payment” is well below the 31 percent range required by the Home Affordable Loan modification program.

That is truly not our principal/interest payment, as our TRUE amortized payment is well over $4,500 per month, which does not even include the homeowners insurance nor the property tax payment, which would cause us to be eligible under the Home Affordable Program.

While the Bank of America hides behind their misrepresentation of what our mortgage payment truly is to deny us a loan modification, they are simultaneously stating on the same mortgage statement that our minimum interest payment is not sufficient to pay even the full interest on the loan each month, let alone the principal, and charge us $1,400 per month in interest each time we pay the minimum interest (negative amortization payment).

So we are boxed in by Bank of America:

  • We cannot afford to pay more than our minimum interest payment – so our loan increases by $1,400 each month (so far it has increased our mortgage from $637,000 to well over $658,000),
  • AND we cannot get a loan modification because the Bank of America states that our “principal./interest” payment is within our ability to pay each month. I don’t believe that Bank of America can have it both ways. My solution to the problem is to either:

1) IF our current minimum payment (negative amortization) is looked upon by Bank of America as our “principal/interest payment” as stated on our mortgage statement each month, they should treat it as such, and reduce our interest rate to make sure that a portion of that payment goes towards our principal; then refund the over $20,000 in interest that Bank of America has tacked onto our mortgage for each time we used the “minimum payment (negative amortization payment).

2) OR if in fact the negative amortization payment is TRULY that, and our principal payment is well over $4,500, then the Bank of America should extend us the courtesy which we feel we qualify for, and provide us with a loan modification so that we can make our mortgage payments each month and keep our home, which houses ourselves and our three children, one of which has special needs, and will have to live with us all of her life.

All we want is to live in our home, and pay our honest debt to Bank of America – however, we do not feel we have been treated either fairly or honestly by the Bank of America, or its predecessor, Countrywide Home Loans. We ask for relief from the Bank of America, actually we require it.

We support John Wright in his Bank of America lawsuit - not out of vengeance, bitterness or spite – no not at all – but out of a kindred support of his plight, and ours, and the many others who have the same simple wish as we have – to live without fear of foreclosure in our own homes.

Update on 06/17/10 Denise: Hi John – I just wanted to update you! Wow that was fast – I just sent the email last night to the Bank of America CEO and a copy to you – and already something happened!

For months I have been trying to get B of A to look at my file in a REAL way and not penalize me for having a crappy loan (Conventional Jumbo Loan with a 7/1 Option ARM), but no one would review it with me – and I could never get a straight answer from anyone.

Well – up until yesterday afternoon, I have been able to view my Mortgage Note online – but this morning – I went to view it again – to see if I could decipher the “mortgage lingo” a little more – and when I went to open the Note, there was a big message (in red) from Bank of America which stated in essence that my loan document has been locked pending a review of my mortgage note as I requested!!! Can you believe it?? The notice also stated that it takes approximately 7 business days for them to review my mortgage note.

WOW!!! Just wanted to let you know things are moving and shaking – finally!

I am begging you to help my family keep our home from being foreclosed upon.

We have owned our home for almost eight years and have always been current on our payments. When we purchased our home in 2002 we did not use any “creative financing” and we were well within our means; our loan was for approximately $180,000 after we put our 20% down. When the value of our home almost doubled not too shortly after, we were completely inundated with solicitations to capitalize on that growth. We refinanced our home and borrowed money against it. With that money, we economically landscaped our backyard (per HOA/CC&R rules) and paid off much of our debt. We thought we were doing the right thing.

Starting in mid 2007 we fell on some hard times. My vehicle broke down and the cost of repairs far exceeded the value of the vehicle so I purchased a one year old vehicle with a moderately low payment through a local dealership. In early December my husband lost his job and was unemployed for three months and my hours at work were reduced. We never missed a house payment but started using credit cards for our daily life expenses. My husband was able to obtain a position in the hospitality industry. In May 2009, my 90 year old mother passed away in California. I was in California for almost three weeks to be with her before she passed away and for the mourning period. I did not get paid for that time which put us farther behind in our bills. In October 2009, my husband lost his job in the hospitality industry. During that time my hours at work were inconsistent due to the economy and we again had to rely on credit cards to be able to survive; I have worked for Smith’s grocery store for almost seven years and am a member of UFW 711. During this time we continued to make the house payment and tried to pay all of our obligations including never missing my husband’s child support payment. I attempted to get more hours at Smith’s or find a second job to help with the mounting bills but was unsuccessful in doing either.

We contacted Bank of America, our mortgage holder, in December 2009 to modify our loan because my husband was not working, our meager savings was depleted and we wanted to do our best to keep our home. On this initial phone call we verbally provided them with our financial information and the representative stated that we would prequalify for a trial period of three months at payments of approximately $1100 per month and paperwork would follow. We paid the amount we were told to for two months but never received any paperwork. Then we started receiving delinquent payment calls. We were informed that no trial payment was on record. In March we contacted the Home Retention Department, verbally provided them with our financial information and after 3 weeks to a month received a packet of forms to complete. At this time we were advised by many sources to stop making payments. Media reports stated that Bank of America was notorious for not working with homeowners, not sending documentation, requesting duplicate documents, and generally playing games. In talking to the many people we knew who are going through this situation we were informed the only way to get B of A’s attention was to stop making payments. Since we were completely demoralized with the B of A process and lack of progress we decided to stop making payments. We completed the stack of paperwork and sent it to them within the required deadline. Three weeks or so later B of A mailed us a packet with a request for information that we had already provided. We contacted the Home Retention department and the representative confirmed that it was an error and to disregard the request. We didn’t contact any modification companies due to the lack of funds that were required up front with no guarantee for modification success and the unscrupulousness of most of those companies. We recently received a third request for the same information. I am in the process of completing the paperwork and will send it to them (even though they already have it) within the stated deadline. As of today’s date we have not received a response from B of A but we have started to receive notices (solicitations from attorneys and real estate agents) that our home is being foreclosed on. We also received a letter, I have enclosed a copy, from a company called ReconTrust that they are representing B of A and are demanding $246,056.77 or a letter disputing the validity of the debt within a 30 day period. I can only assume that within 30 days our home will be foreclosed and we will be forced to leave the home we love.

I am afraid to contact B of A. With all of the confusion and intentional delays on their part I do not believe that they have any true intent to assist us. I believe that there is a class action lawsuit against them for this exact reason. I thought that bills were passed and relief was on its way to help homeowners in situations like mine. The nightly TV news and the Las Vegas Review Journal have reported that “help for Nevadans is on the way.” I would really like to know where this help is. During the last election my husband, who is a registered Republican, voted for President Obama because he was sick of the way things were, the state the country was in, and wanted change. Unfortunately he is still waiting to see change and this situation has caused much friction and fear in our household.

Please, please, please…is there is anything that you can do to help us remedy our situation. I am not asking for a handout, but would simply like B of A to provide us with a real loan modification. No more games, just a real modification that we can agree upon so that we do not have to disrupt our health, our home life and our daughter’s school (she is an A/B student). I love my neighborhood and the local storeowners that rely on us, the little people, to survive. I was told by friends and customers at my work who are going through this same process and by my own research on the internet that B of A generally offers a three month trial period at some arbitrary amount but after the three month period even if all payments are made as stated there is no guarantee that the modification will be approved. My friend made all of her trial payments and B of A told her that her trial rate was not approved and she had to pay $300 per month more! What is this, a scam? They weren’t trying to help her retain her home in my opinion and she felt that B of A knew that they would not approve her modification. It was as if they were trying to get three months of payments from her since that was better than nothing. She ended up declaring bankruptcy, lost her home and ruined her credit for a long time. Senator Reid, I am afraid that this is the direction that my family is heading. For 29 years I have been employed, paid my taxes, maintained a 750+ credit score and paid all of my bills. Where has all of my diligence and responsible living gotten me? Possibly to bankruptcy and losing my home (the American dream) due to the economy taking such a down turn and unscrupulous activities in the mortgage and real estate industry as well as Wall Street, that I had no control over. I do not want to become a statistic. Senator Reid, if B of A can modify my payment and/or lower my interest rate and get my payment down to $1200 per month (which is above the “trial” amount from the initial phone call), my family can stay in our home.

I love Nevada, my home, my daughter’s school, my neighborhood and all of the benefits that Las Vegas offers. I want to stay here, pay taxes and support my local vendors. I do not want to move.

Please help and advise me what I can do in this situation. Time is of the essence. You are our only hope. If you are able to help my B of A loan number is XXXXXXX and you have my permission to contact B of A to do whatever you need to do to help my family.

Mr. Moynihan, I’m writing in regards to account # xxxxxx. I have been in contact with Bank of America since November of 2009, trying to resolve the matter with the arrears on my account. Back in December I was told that I was under review for a special forbearance. I called the bank multiple times every week to check on the status and was constantly given conflicting information. No documents were ever requested and back in April I was told that I was denied. I was never told why are if I needed to provide any information. My financial information was taken over the phone and I was then told that my loan would be put in review for a partial claim.

We are now a few days away from July and I’m still not able to get any concrete information. I received 2 letters from BoA. One of which had the incorrect loan number on it but was addressed to me and delivered via FedEx. This letter stated that I didn’t qualify for any work out options and that I would need to sell my home or do a deed in lieu of foreclosure. When I called the bank, I was told to disregard this letter to the erroneous loan number on the letter. The representative told me to shred the letter. I told him that I would not do that, providing that I may need to refer to this later in my defense. The other letter I received had the correct loan number and same information as the first letter. When I called the bank regarding this letter, I was told to disregard the letter because I was still under review for a partial claim and that the letter was sent out in error.

I received a letter dated June 16th 2010 from Phelan Hallinan & Schmieg, P.C., who’s the law office representing BoA in the foreclosure proceedings on my condo. The letter stated that Bank of America was going to proceed with a judgment against me and that this will take effect July 1st. I immediately called Jessica Hansbury (the attorney handling my case at Phelan) and she mentioned that BoA was suppose to notify her office of my pending review status, in order for the file to be placed on hold. I then called the bank was told that someone left me a message, however the rep couldn’t tell me what number was called nor the details of the message.

A few months ago, I was able to get a voucher from the Passaic County Board of Social Services in the amount of $6300. The check was sent to Bank of America, after I was told that I can still submit payments. The check was returned to the Passaic County Board of Social Services and I was never notified. I became to privy to this information during my many phone calls to the loss mitigation department at Bank of America.

I’m a single mother trying to keep a roof over my head just like millions of other Americans during this economic climate. I have taken all the necessary steps to get this matter resolved. I fell behind on my mortgage due to loss of income back in November of 2009. At that time I went to the Board of Social Services to see what type of assistance I could get. The voucher was processed only because I was able to correspond with Ms. Hansbury to obtain the necessary information to provide to Passaic County. It was very disheartening to find out that the voucher was returned and my loan went into foreclosure. I have never been able to speak with the negotiator handling my account.

Ironically, I’m now working as an administrative assistant for a law office that focuses on foreclosures/loan modifications as I prepare to attend law school. I know all too well that there are many people dealing with the struggle of trying to keep their homes. My question is what do I need to do to keep mine? I was never told why I was declined for a special forbearance. I’m now making $1400 a month before taxes and I’m taking the necessary steps to lighten my expenses. All I’m asking is for a forbearance or a lower mortgage payment.

Since January 6, 2010 I have called almost weekly to get status updates and have been transferred and told different stories each and every time. I have a log of almost every conversation and…. BOA representatives have been giving us conflicting and inconsistent answers from different departments. It appears that many of the BOA reps, that we have spoken too, do not understand the Loan modification/MHA program and process. I received the same denial letter you did and made my trial payments on or before the first of the month. They too took not three months but here we are now, almost July and I am still battling with them (my first trial payment was on January 1, 2010). In the contract it states it could take up to 45 days to get an decision; it is now June 2010.

I have never been late on one payment and in May, they reported me to the credit agencies that I was past due; no fault of my own! BOA has not kept up with their obligations and I demanded they remove my name and any adverse effect the reporting may cause on my credit reports. I hold very high clearances and this could cost me to lose those clearances and my livelihood due to their poor, unorganized processes.

I call every day and get a different story every day therefore; I am drafting a letter to my local congressman, state attorney general, my attorney and calling the news station to report my horrible experience with Bank of America.

Not only did they not fulfill their part of the contract; their agents are rude and not customer service oriented. I just received a past due letter the other day and now they are stating I am 3085.00 in arrears because they could not fulfill their contractual obligation in time. They fraudulently reported me past due. In the contract, it states the following:

“If you are delinquent when you enter the trial period, we will continue to report your loan as delinquent to the credit reporting agencies during the trial period even if you make your trial period payments on time. However, after your loan is modified, we will only report the loan as delinquent if the modified payment is not received in a timely manner.”

I made all payments on time and they reported me anyway; I was told on 20100623, that they will remove the claim but it will take 60 days! This is ludicrous. I too am fighting back because like you and many others, we have done nothing wrong; just everything right.

I too am unable to access the “Pay Now” feature on my account because of their poor business practices. If my account gets completely blocked due to this email; this will also be addressed in my letters to congress, the attorney general, and my attorney, along with the media.

I cannot even make a payment the way I want too; they dictate that as well and that was the last straw for me.

I ORIGINALLY filed for loan modification with Bank of America November 12, 2009. My original loan was with Greenpoint (for $390,000/ 30 yr. fixed at 7.4% in 06/2007), who sold to Countrywide, who sold to BofA. I found out on December 28, 2009 that BofA lost my original application for loan modification (which was done via phone on 11/12/09 with “Phillip” at BAC Home Loans), setting things back a month. I had to refile for the entire modification all over again. I did this January 18, 2010 with the services of Imperial Home Mortgage in Roseville, Ca. For a hefty fee they prepared a complete package with detailed analysis and presentation of my income, assets, monthly payments and expenses. This package also included my hardship letter, cost-benefit analysis, cash-flow and balance-sheet, current market analysis of my property and a proposal for loan modification.

I stopped making mortgage payments in December 2009 due to eliminating all of my savings funds to make up the difference in my lack of income. So, I am now seven months delinquent, totaling $21,843 as the past due amount. Plus my principal balance is still $380,611. I am totally underwater and need help! My original monthly payment was $3010.30 (including escrow). Not to mention my property value has dropped over $150,000 plus $20,000 in renovations, condos in my complex are selling for less than $230,000!!!

After bi-weekly phone calls to BofA and hearing the same thing “your loan modification is still under review,” I received via FedEx in April 2010, a request from BofA for updated financial’s and a form to submit for the Making Home Affordable Plan (MHA or HAMP). I completed this, sending it via FedEx to BofA on April 3, 2010. I have still been calling bi-weekly since that time and hearing the same thing “your loan modification is still under review with the negotiators” On June 1, 2010, I also confirmed this status directly with the Making Home Affordable group or the HOPE team.

I have read and hear from co-workers that many of the “trial” loan modifications that are enacted for three months are fraud. BofA rarely makes a permanent modification and then requires the borrower to repay the full delinquent amount plus late-fees. By doing this it creates an even higher principal and monthly mortgage payment then originally existed. How does this make any sense?

On June 9, 2010 I called the HOPE team and BAC Home Loans as usual to check the status and to see if I could contact my negotiator and also update my financial’s (my gross income has declined again and we now have a monthly car payment). I was told as usual that my “loan is still in review for a conventional loan modification.” I asked what is that? Apparently, I am not even being reviewed for the Making Home Affordable Program and I was never notified of this!!! “Shawn” at BAC Home Loans could not see any notes about my loan ever being considered for MHA/HAMP! I have copies of everything I was sent and everything I returned, all via FedEx to and from BofA applying for the Making Home Affordable Program. I also HAVE PROOF that BofA received this package (FedEx tracking number, who signed for it; “A. Taylor” and exact date, time and location; “4/7/10, 9:12am, Broomfield, CO” of delivery and acceptance). They claim that another package was sent to me via FedEx with a proposal for loan modification under Fannie Mae and Freddie Mac. I never received this package! They say since I did not return this package by the date requested that the only modification I am now being considered for is a conventional one. With my circumstances I am eligible for the MHA/HAMP program! Under a basic conventional loan modification my payments will be higher because they will add on the past due amount to try and make my loan current again. How will this help me?

Most recently, on June 21, 2010 I received a package from BofA via FedEx. BofA claims they have been unable to get a hold of me regarding my loan and to send them my current contact phone numbers. This is a total lie! I record every conversation I have with anyone regarding my loan, whether I have called them or they have called me, both instances have occurred! I most recently RECEIVED a phone call from BAC Home Loans on June 14, 2010. A three minute conversation was help. How can BofA say they are unable to contact me? I am tired of the lies, the games and the run around that BofA attempts with their customers!

If BofA will not work with me on my proposal for loan modification, they are looking at suffering severe foreclosure costs well over the amount of my properties worth! I support John Wright vs. BofA Lawsuit!

First of all BofA has been part of family for my whole life; my Mother worked for BofA for over 30 years.

I have been a customer for 20 years, I have had two mortgages with you, a car loan, have a checking and savings account and I have been a good paying customer.

There are no words to describe my horrific experience with your company regarding trying to get a Home Loan Modification. Not only my experience but also many others, online there are countless testimonials of others who have had my same experience.

I feel like I have been dealing with the devil, there have been lack of and miss communication, deception, lies, rudeness and lack of follow through. All of your departments that have a hand in this process work in silos; no one knows what the other is doing. I have talked to at least 12 different reps (you can never get the same person twice; you do not give extensions numbers), have received at least 6 different numbers to call, been bounced around your phone system like a ping ball, been disconnected a couple of times, reps transfer but do not tell the transferee why I am calling, so I have to explain my inquiry again. I have wasted countless time because of the incompetence of your employees and your process.

I originally called you in Spring of 2009 about refinancing or getting a Home Loan Modification but was told I did not qualify and would have to keep calling until legislation/guidelines change and than I may qualify. I heard and read that things had changed so I decided in December 2009 to inquire again, I initially was asked a series of questions and than was advised it would take about 45 – 60 business days for you to send me the intial paperwork. I understand you have had many of these requests and it might take time, so I was content on waiting but had no idea how bad this journey would become. You sent me a request for intial documents in March 2010, I sent those documents via Fed Ex in March 2010 and I called to advise they were sent, verified with you that they were received and was told I would have to wait an additional 30 -75-business days. I than received another Fed Ex from you in April that stated my documents were missing and I had to resend them, this did not make sense, since I verified with Fed Ex online that you had received my Fed Ex in March 2010 and I tripled checked my documents to make sure they were completed and all were in the Fed Ex envelope before I sent it. I called, talked to a rep and they advised that the letter that was sent is a generic letter (why would you send a generic letter and confuse your customer) and that in fact my paperwork is not missing but another area of your company is asking for the same paperwork again and because of HIPAA they could not use my paperwork I sent you in March. I sent that paperwork via Fed Ex, confirmed with Fed Ex online you received, I called you to verify it was received but it could not be confirmed until about week later since you had lag time from receiving the Fed Ex to when my documents are logged in some system.

During this time, I receive my monthly statement that showed I was due my regular payment plus escrow; increasing my monthly payment by almost $800, I was again confused. I called and found out that an escrow account had to be setup (was setup on 1/19) and that you also made my property tax payment that was due by April 2010 (I also, made this payment and now had to collect it from the county). I advised the rep no one from BofA every told me that an escrow needed to be created, that you would be making my tax payment and that my monthly statements would be going up. The rep basically said take it or leave it, I talked to another rep and they gave me the same run around, they said they could do some calculation to extend my escrow payments but still my bill would be my regular payment and some of my escrow. I kept telling you that if I am trying to get my payment lowered how in the world does BofA expect me to pay a higher monthly payment. Finally, I was told someone from escrow would have to call me back. A female rep called me two days later; she advised she could push out my escrow payments until July and by than I should have had a decision on my Home Loan Modification. She confirmed that I would only be due for my regular payment and she sent me another statement to state this.

I than called periodically for updates on my Home Loan Modification and was than told that Underwriting was reviewing and I should get an answer in June. On June 11, I received a voicemail from a rep advising me to call you regarding my missing documents; this message confused me because you had already received my documents twice, once in March and again in April. I called that afternoon, another rep advised my documents are not missing (so again why does a rep leave message that my documents are missing, when they were not) but Underwriting needs my documents again, she advised me to send everything that I sent in March and April plus two updated pay stubs with in 72 hours. I faxed the documents on June 14, called and talked to a rep (keep in mind I had to call twice since the first time the fax number that was given to me was not working, so the rep gave me another one) and they advised me that you received my documents and I should get an answer in 30 days (beginning of July), at this point I am remember that my escrow was pushed out to July so I am concern about getting a statement showing my regular pmt plus escrow. On June 18, I received a letter from you verifying that you received my faxed documents and it will take 45 days to make a decision, based on this I am confused because now for sure a decision won’t be made by my July statement, I called June 22, spent over an hour with reps from home retention to default to escrow; no one could give me a reasonable answer on why it is going to take 45 days for a decision when you have had all this paperwork since March and April but default department said I had no choice and that the investors would have to review. I than talked to escrow and asked about what can be done with my escrow since my July statement will have my regular payment plus escrow, they said nothing they can do and they said default/home loan modification folks should have had a decision on my trial payments by now. I advised a female rep last time called me back and made this change for me, the male rep than said her name is Miss Jackson and he would email her to call me back, well it has been over 72 hours and no call. So at this point, I have to wait again for Underwriting or the investor to review the same documents they have had and no one can help to adjust my escrow until a decision is made on my potential trial payments. If I am trying to get my payments lowered by going through this Home Loan Modification process, how do you expect the consumer to make a payment for more than what they have been currently paying? I have been paying interest only for 5 years, according to my July I have to pay my regular payment plus escrow and escrow says they cannot do anything for me. I would think someone could push out my escrow until I get a decision on my Home Loan, I should be able to just make a regular payment until a decision is made. This is perfectly sane request.

Who at BofA can help me? I am tired of getting the run around for these last 7 months. I want a decision on my Home Loan Modification (I think it should be approved) and I want my escrow payment to be pushed out until this is done. I have done everything BofA has asked me and more, I know if I have not been persistent with you there is no way I would have gotten this far. Please advise.

I immediately called B of A to discuss this completely unexpected bill and informed them that I never signed anything and never received any paperwork. They then told me that I had been denied at the end of May 2010 and that’s why I received the bill and accelleration notice. When I expressed outrage at never having been informed about a payment at the end, I was told that B of A had signed documents stating my acceptance of terms. Once again, this is impossible since we NEVER signed a single document.

My initial goal for looking into this program was to lower my rate while providing for my family. If I had been able to pay out $21,000, I never would have needed this modification. I am a responsible homeowner who has lived on my property for 41 years, without incident. I am extremely concerned that I have been a victim of some type of unethical procedure. I have contacted my lawyer and various agencies to report this practice and have found that this is a common practice of B of A.

I am sure you are an ethical man and as the responsiblitity for the practices of your bank fall on your shoulders, I am sure you would want to be aware of the way this makes B of A appear to the general public.

requested. I have not requested any credit cards or auto loans. I’m not happy with how Bank of America treated me on this.

This will just be another statistic for BofA and the Hamp Loan to show the government how they “helped”.

    fedexed documents to us who signed for them cause we sure as hell never got anything. never recieved any court notices till I came home one day to a sherriffs sale notice. I was working with a company to try and get this handled we were told they b of a would cancel the sherriffs sale and we waited and called everyday for confirmation that it was cancelled on the morning of Don’t trust the bastards we did everything right faxed everyting they wanted several times they stalled and stalled till they foreclosed and sold our home of course back to themselves. I’m not a stupid person The paperwork was never reviewed I recieved only one phone call asking for “updated info” which I gave them no other phone calls from b of a were recieved. they claimed they the sale which was feb 5 2010 at 10am we were contacted a half hour before it was to happen that if we western union them 13,000.00 by 10am they would stop it kick in the ass isn’t it. so you can all guess what happened. I emailed and caled constantly finally an advocate named marlin briscoe left me a voice mail when I got off work I returned his call left him a vouce mail and never heard from him again. in july I recieved a voice mail from some weathers women with a contact # for the recission department called there left a message didn’t hear back called again nothing. I was informed by friends this past sunday that someone was living in our home so we went by and sure enough it was true. they weren’t there a couple of days before that as we were checking on the house every couple of days. there was never any for sale sign or ads in the paper or on the internet I checked frequently so ont he sly they sold it so why did they bother to give me a contact # for the recission department cause they screw with people lives and emotions in hopes of dragging them down well not gonna happen here i’ve been through enough in my life Mr Moynihan I’ve taken alot of crap and yours that you’ve dished out is all but over believe when i say I’m tough have to be with people like you in this world all I have left to say is THIS IS NOT OVER BY A LONG SHOT you may think it is and i a stupid women but guess what I’M NOT
