At the time, I had just returned to work after having lost my job of 11.5 years. I returned to work one short month after having lost my job but this was still a hard hit financially. It was only a matter of time before my payments would be late due to this. I called Bank of America and explained my situation and it was suggested that I refinance to lower my payments. It took two weeks to get the needed paperwork and two weeks to confirm that thes were received. It took several weeks for the underwriter to review these pushing me into the month of July. It was made clear to the person working with me of the urgency to complete the process prior to a new payment being due. I was assured in the beginning that we had plenty of time and that I would be allowed to skip my August payment. Needless to say that refinancing fell through because Bank of America took too long in processing my request despite my attempt to plan ahead.I have finally been informed that my request for modification has been denied but was never given a reason. I was told to “wait for the letter of expanation to arrive” as this was sent out on 10/22. I immediately requested to speak to a supervisor and was given the reason for denial. The denial letter was finally received 2 week after I was denied. I am now appealing this decision with the request to be considered for other programs that I may qualify for. As you can see from the details listed below, this is documentation of just one day of abuse. I am now at the end of my rope and will no longer tolerate this from anyone at your company! Do the right thing, HELP ME AND GIVE ME THE TIME AND ATTENTION THAT I DESERVE. I AM ONE CUSTOMER AT A TIME!
As of 11/9/10, I am working with my newly assigned negotiator Ellen Billie at 877-345-6431 (with a four digit extension that is non existent) Apparently I am no longer assigned to Ms. Sherlena Love who by the way can no longer be contacted (her extension is no longer in service.) I have faxed over all of the needed infomation to Ellen Billie twice and have printed confimation that all 16 pages have gone through but as of today, NOTHING HAS BEEN RECEIVED and I am being asked to send it again! Despite my many calls to Ms Billie, I have received two return calls while I was at work unable to take her calls despite my request to not call during these hours. Here voice mails request that I return her call at 877-345-6431 (no extension is given) not allowing my call to get through to anyone.

Call #1- Representative x 4568 (home retention dept) read me notes per Ms Billie, to fax over needed information as nothing had been received. He sent e-mail to her informing that I had refaxed these to her as per her request. Said he could not tranfer me to her.
Call #2- Emma x 6252 (home retention dept) I called her to ask her for a mailing address to overnight documents that had been faxed twice and not received. Said she had to transfer me to HOPE dept. for them to give me the address.
Call #3- Tuan Carter (Michigan HOPE dept) Stated he could not give me the address but would transfer me to the dept that could. I asked for the number in case the call did not go through and he gave me 877-345-6431 (the same number that requires a 5 digit extension) I informed him that this would not work and again demanded to speak to a supervisor. He transferred me to the number that I asked to not be sent to of 877-345-6431.
Call #4- Called (Michigan HOPE dept) 877-767-0670 and again started the process. James Holmes (with no extension) tried to transfer me to the same 800#. I asked to speak to a supervisor and he stated that this was a call center, NO SUPERVISOR WAS AVAILABLE.
Call #5- Solomon x 4095 (Home Retention Dept) took all needed information, sent Ms Billie a message requesting a call during my requested hours, and gave me the address to overnight the documents to Ms. Billie. However, he clearly outlined that this was not the “requested method” for receiving these documents and could not guarantee that these would make it to Ms Billie! At this point I will take my chances as EVERY BANK OF AMERICA EMPLOYEE IS CLEARLY WORKING AGAINST ALL HOMEOWNERS DOING EVERYTHING POSSIBLE TO DELAY THE PROCESS FOR ANY TYPE OF ASSISTANCE” I thought I had made progress until he informed me that Ms Billie will be out of the office until 11/15 and that the process would continue at that time. I have now asked that Ms Billie’s supervisor contact me in her absence but have a feeling that she too might be unavaiable as is YOUR ENTIRE COMPANY!

Update on 11/16/10: John, Thank you for this, here is my update: I received a call from Kyle at the President’s office the very next day. He left me his number and extension but the call would not go through. I called my regular 800# and was informed that they could no longer discuss my account with me as it had been referred to the President’s office. They gave me the direct number and passed me on to a different representative within that dept. as Kyle was not available. Since then, I have spoken to various representatives who have all told me the same “WE ARE WAITING FOR ADDITIONAL INFORMATION” I finally confirmed with Kyle that no additional information is needed. He apologized stating that the representatives I spoke with do not have access to the same system and therefore could not see the paperwork that had already been received. He informed me that he would be assigning me to a Sr. Negotiator. It took Kyle one week to assign me to a new negotiator “Ellen Billie” which happened to be the same negotiator that I was previously assigned to, the one who gave me a bad number with a four digit extension that does not work and the same one that I have been working with for several weeks now with no results other than “THE MISSING INFORMATION THAT SHE NEEDS TO PROCEED” TALK ABOUT BEING GIVEN THE RUN AROUND!!! Kyle informed me yestereday that he has no control over the negotiator that was assigned and that it would now take 24 hrs to be assigned to a new Sr. Negotiator. As of this morning (24 hrs later) no negotiator has been assigned. The message given to me by a different representative is that Kyle is still working on this and will call me as soon as one is assigned. I will keep you informed of the status of things and would appreciate any feedback.

I was told by a gentlemen named Andrew on 10/1/10 that he would accept our partial payment and when we banked enough of the partial payments for full payments, they would apply it to the loan. On 10/27/10, another rep named Kurtis, told me you no longer accept the partial payments. On 10/29/10, another rep named Cindy, took a partial payment from me. I asked her if she saw what was going on in the loan process for the modification and she said we were denied. She told me that a Fed Ex letter was coming to us on the reason why. The only reason in that letter was that there was no affordable solution. I’m sorry, but what kind of reason is that. What I want to know from you, is why are you denying a customer that not only has their mortgage loan through you, but also our checking and savings. We are asking for the modification from you or some other program to keep our house. I know that Bank of America does not want to add another empty house onto what you already have. You say you help one customer at a time.

Update on 12/03/10 : Dear Brian Moynihan, I emailed you on 11/10/2010 about our need of assistance with our home loan. Within 5 business days we received a letter from you stating that you put a senior negotiator on our loan, Ms. Regina Mayes. You provided me with her direct line and also another number to reach a Steven Nielson in your Customer Relationship Advocacy. I would like to inform you that neither of these people know how to answer their phone. I have tried reaching them since we received this letter. At one point after receiving this letter, I thought their was a glimmer of hope that maybe, just maybe, Bank of America would possibly come through and help us with our loan.
You say you help one customer at a time. I AM THAT ONE CUSTOMER. We live in a subdivision where our builder went bankrupt and you have about 15 houses in our neighborhood that got foreclosed on or the homeowners simply walked away. I know for a fact that you own these houses. Our subdivision was only 40% completed, so the odds are against you right now. I know you don’t want to add another house onto the list.
You of all people know that the economy is bad. I did work in the building industry and lost my job. We are coming to you to find out which program Bank of America has to help us. I refuse to lose my house and I know you do not want my house. I would like to know which program you have to assist us. I would like to hear back from Ms. Regina Mayes.

I know you are very busy due to the situation in the country, please help me, I dont want to lose my house, this is all I have, I have a job and a personal business and everything is taking shape for me now, its just that I have a pay cut at my job and business is very slow, if I get my loan modified, I will make my payment going forward, Im appealing to you to use all that is in your power to help me move this situation to positive result

Update on 11/30/10: Hello and Good afternoon, My name is Musiliu Aminu, I contacted you few days ago and you posted my complaints on your blog, Im happy to tell you that I finally received FEDEX package yesterday and Im starting my 3 months trial payment in January, like I said before, this after 18 months or worrying, many calls, sleepness night, hundred of emails, I pursued this and Im Grateful to God that if finally worked out.

Update on 12/08/10: John Wright wrote Musiliu to let her know that the BofA rep mentioned above name “Trinia Saldivar” typed her own name into google and end up reading this complaint about her on piggybankblog.com. Musiliu responded with: “Thanks for letting me know. When my file was referred to her, I called and left several messages and she never return my call, when I threatened to contact her boss (which I did anyway), she finally sent me an email and she wasn’t able to help, another thing I noticed was that when you listen to the message on her voicemail, she said to contact someone if she is unable to answer the phone and the phone number she provided on the message was wrong, I finally got the correct number and sent her email, its possible it was a mistake or intentional, when I was dealing with other negotiator, they returned my calls even one call me on Saturday, anyone refer to her should ask for another person as I think she of no help at all and just waste people’s time.”

On 11/10/10 Naomi DeLa’O wrote: Good morning Brian, on two occassions I spoke with Alicia Corosco and so far am not impressed nor have I felt like I am any closer to a resolution. Yesterdays conversation was condesending and just plain un professional. Speaking to me as though I do not have common sense is an outrage. I had inquired as to why I would be recieving a billing statement on my mortgage when I have been in modification review since December of last year when BOA bought my loan. Alicia’s response of “the banks not going to stop what it does, your still going to get a statement each month” is of no consequence to me. Since I have never received a billing statement from BOA not once. I feel Alicia did not understand my question as to why out of the blue would I be getting a statement when I should be in a review process? Also on the same day I recieved a letter saying I should ask BOA for help if I am having difficulty paying my mortgage. Just what is going on inside BOA? Why does it appear that my information is in several different departments and generating a variety of letters being mailed out to me? I have not once heard from my assigned reviewer Colby Gilbert. Yes I am working with a HUD Counselor Andre Holcomb but he also is getting the run around. According to Alicia when she reviewed my account I was told “she read no where in my account that I had been denied for an in house modification” I understand BOA has thousands of homeowners trying to get a modification with BOA. But does it not make sense that when there is a trained Hud Counselor involved that half the work is already done? and that the reveiwer should then be better able to present a sensible work out to the investors? I understand the investors need to agree as well to a modification. So then shouldn’t the home owners plead their case directly with the investors? I read somewhere that home some home owners were denied a modification and it was blamed on the investors not approving the modification. So then in those cases the home owners have a right to understand exactly why they were denied. It should be clear why it would not benefit the investors. Who can explain why a group of investors would by bulk mortgages fully knowing many of those homeowners will default. I beleive since this is the case those investors need to clearly define why a modification is not applicable. In my case I have been in my home for more then 10 years I have raised my family hear and now have my mother to care for. I have a long employment history in the same career feild. If a reviewer were to consider those things it would be clear I am not of high risk. If I hadn’t been let go from employment I would never had been in this mess. I appreciate all the help you can give me.

Until 2008, my company didn’t get a renewal contract from the Federal (the contract has been renewed for the past 10 yrs). I was collected Unemployment benefit for more than a year .We were struggle and drained all of our saving, max out our credit card. We have no choice, then we applied for home modification since April 2009 because we were told we didn’t qualified to Refinance the loan. During that time I have changed my job from an Internal Auditor to an Agent for New York Life. I had no experience in a sale business, from an exempt salary to a commission only. My application was transferred to New York first and then California. Each time they want me to re-sent all my document because they did not have anything in the file. One time, I called the customer services line one of the woman told me that my account has been transferred to the bankruptcy dept she needs transferred my call to them but their dept was not open at that time. I called them to check a status of my application almost every two weeks. I have been worked with the upper manager level from NY to CAL. Finally, my application has been sent to an Underwriter in Florida June 2010, he called me and after that about a week, he able to completed his verification in one day he said to me” now I sent your package back to Bank of America, give them about 2 weeks and then follow up. A final underwriter will scanning all my number to make sure is accurate. They will notify you with an offer” . From the end of June until August the fifth I received an overnight letter from Bank of America, the letter indicated that “Within in 45 days you will receiving a final decision from us” . That is until now, I was so upset, every time I called they rotated the call to a different person and they had no clue They don’t care where and how you find the money to pay them for the mortgage.They also said the letter generated by a computer it could be longer. I think” You are very good to cover yourself legally with the law and the government” None of my painful experience that matching with the information you listed on your web site about this program. Let me went over some of the answers they given me about my status and the letter: * You need to call every two weeks to check for the status there is nothing that we can do (manager of the retention dept) * You don’t have a sell date on your property and you also not on the list for the foreclosure that why (staff from retention dept) * If you can’t not wait for their assist just tell me now (customer services center) I don’t know how many time they have requested to escalate my file, because it more than 45 days since the end of June. Nothing good About three weeks ago I called the HOPE HOT LINE for help all I want to know what happening to my application. I have been transferred to worked with another non profit organization they asking me a same thing they went over my financial. I told them I already know all of that do not waisting your time. They didn’t care they keep talked like a machine, all they want from you a completed personal information to keep you in their books. Later on, I found down from your bank that they have requested to escalate my file again. They did a same thing what I have done in the past. Even that I am still calm try to work with the bank to updated my current situation if I am running late on the mortgage. It has been 2 times since September. When I called them all they said “when can you pay, if we do not receive the payment by the 28th we will send a notice to the credit bureau. Until you in a trial payment we can not waive any late charge.” I am thinking about the message from your 1-800 to the consumer “we are not a debt collector we want to help you” how do you feel about that? Are you a Catholic or you from another Planet out here with no heart Last month, I called to make a payment over the phone so you can get your payment quicker than if I do the pay bill through my bank it will take couple day. They didn’t let me know about an extra 20 for a fee, they automatic debit to my account another 20 with a follow check number that I gave to them for the mortgage payment. I called them and asked about an unauthorized check charge to my account, they told me they received a notice in September that they can’t waive any fees to the customer. This a fraud and a violate the law you should not used a duplicate transaction to charge the customer due to their previous approved transaction. From the credit card to the Equity Line than the Mortgage your bank have been charged the late charge from left to right even your staffs have my current status in the system. To proof my story, I encourage you take a look of my file to verify what I have said is correct or not and let me know Is this how you rate my loyalty and my credit PREFECT with your bank for the past 10 yrs. .

Update on 12/04/10: Mr. Brian, I have been written to you once and now this is the 2nd one. I appreciate that you have passed my concern to Mrs. Rhea L Smith to handle the issues. I knew her name due to a phone call from your office called me and said from now my case will be handling by her and she will contact me shortly. Unfortunately, after a week I haven’t heard anything from anybody contact me. I have called and requesting to leave notes in the system for her to call me. I have spoke with 3 of your staffs and raised a concern. One Friday, they said she is in the office but she said took a message for her. I have requested either she is pick up the phone and talk to me or I would like to speak with her supervisor. They transferred me to Mrs. Mayra Ramirez her supervisor. She mentioned that she didn’t receive any message from me, I said with the customer relation staff I am happy to provide all my notes to her if this is what she want. After, I had a conversation with Mrs. Mayra I have been told that my case now transferred to Mr. Tong Freddy. Until now I haven’t talk to Mrs. Rhea once. She has sent me a letter dated 11/19 but the envelope was stamped 11/23 I received on 11/24. The letter indicated that she is following to ensure that I have received a good quality services she is providing to me. She also said she had returned a $20 back to me. Mr. Brian, about the quality of services she had none, let review a sentence in her letter “Please know our goal is to surpass your expectations by responding in an impartial and expeditious manner. It is also important for you to know that assistance is not guaranteed and is dependent on several factors”. Is this a professional public services spoke to their clients that way or let me put at this way without clients she will be collect an unemployment benefit how is that sound to her.
Mr. Brian, one thing I would like to be clear to you and your staff that the purpose of my first e-mail to you was “request for the status of my loan modification” “concern about your bank’s Trustee and Honesty” I have couple staffs in your office said to me that I sent a letter to you for a complaint of $20 charged to my account. I e-mailed you because I need your help because you can give us a solution. I have an opportunity to spoke with Mr. Freddy Tong couple time he told me he has requested to escalator my file again. On 11/26 we have received a denied letter from BAC without signature dated 11/24. The letter indicated that the reason BAC denied our APP was we didn’t meet a requirement of the NPV’s test. I have called the phone number listed on that letter and request if somebody could explain to me why the investor has to have such of profit for them to approving the loan. If that is a case then this program is designed to please an investor and not to help people. I also requesting for the calculation to make sure that the number used in the calculation was an accurate number given. I have been waiting for a week but I still didn’t receive any phone call yet per their promise. Freddy Tong is on vacation until December 15th. My account now has a late charge for $383.23 I don’t know how It end up like that. I knew I have late for Oct and Nov. but when I called in to make a payment they said I pay $2336, 01. I don’t know who can I believing? I am loosing the trust with your bank; none of your staff are keeping what they have said to their clients.
I am sorry but my time is running out we do not have any much more left either you come taking my house or I am moving forward and take action.
I am requesting in a week all of the concern above need to be explaining in writing and timely manner and what is a next step of my situation. I hope the bank’s relationship and us are not come to the end due to this matter.

I am a self-employed concrete contractor who works in the housing industry, primarily new construction. When the economy went in the tanks, my income dropped over 65%. Even though I had made changes to prepare I couldn’t possibly have prepared for that. To add insult to injury, on November, 2009 I cut off one of my fingers while working, cutting my income even more. On November 20th 2009 I received a Notice of Intent to Accelerate letter from your bank. I needed $4513.68 by 12-16-09 to cure the default but with my hand the way it was it was going to be impossible for me to be able to pay, so on December 14 2009 I called B of A to discuss what my options where. After discussing, I was led in the direction of a home loan modification. I was told to send 2 months of Profit & Loss statements, and I was pressured into making a $1550.00 trial payment that “it isn’t mandatory, but it will sure make it easier to complete the modification”. I found out later that that was totally untrue. $1550 was all I had at the time and Christmas was only 10 days away. I sent in the paperwork requested and on January 19th made my 2nd trial payment. On January 26, 2010 I received another Notice of Intent letter but now the amount I needed was $6280.00. Concerned, I called to find out what my status was, as I had done when I made the 2nd payment, and I was told not to worry, keep making the payments and check back with us at least every other week.
On February 25th I made the 3rd and what would have been my final payment. It was made just like I made the other payments, on the phone with a live person. When I asked about my status, I got the same answer-keep paying and keep checking. On March 28th 2010 I made my 4th of 3 trial payments, then on April 5th I received a letter stating they were sorry but my financial information was over 90 days old. I would be able to reapply if I sent in updated Profit and Loss, bank statements, and last tax return. I did that in a timely fashion-then on April 12th I received a modification packet which stated how much to pay for 3 trial payments and other info about modification almost giving the impression that if I make the next 3 payments on time then I will qualify for the modification. I was asked to send in the last quarter’s Profit & Loss which I did. I then made payments 1, 2, and 3 all on time (which were actually payments 5, 6, and 7) each time making sure nothing else was needed then on August 13th I received a letter stating that because of my income to debt ratio I needed to get debt counseling and it told me how the counselor would give me support and help me with my monthly budget. A tough task for a small business owner who has lost most of his income but 4 days later it was complete.
Sir, through this whole process I was let to believe that my loan would be modified. I have sacrificed more than you can imagine to make sure that my trial payments and the ones I made after where made on time or early. I have sent info when requested, and have spent countless hours going through prompts and being placed on hold because I was sold a lie. When this process started I could have saved my house for a little over $4500.00. On October 23rd 2010 I received a letter from B of A stating I didn’t qualify because I made too much money. It says they verified my income at $7,164.48 per month, not $5,000.00 like I had put on the application. VERIFIED—remember back in April when they had asked for a Profit & Loss for the last quarter-I sent it to them. It is a profit and loss for a company that is in a business that is seasonable. In January and February I was collecting from the previous year and had very few expenses going out (materials, labor, etc), so the profit on the profit and loss was escalated.
On October 23rd that same day, I received my rejection letter. My income was at $56,700.00 or a little over what I projected. Close enough that I definitely qualify for the modification. Through this whole process I have repeatedly asked if they need anything-check statis, etc. And the WHOLE time the #1 thing I needed to be granted a modification and the #1 thing needed to obtain any loan is not accurate, but it takes 10 months to figure out. Why would it take that long for someone to let me know that, I believe that when I was pre qualified over the phone it was one of the first questions asked, what is your income, if I send something requested and it contradicts what I had stated previously then I think it should have thrown up a red flag and brought to my attention then, not wait past the 3 trial payments to send me a letter- I didn’t even get the modification packet until I sent in that profit and loss, when they received it did they even look at it? Or better yet, at the time did they even need it or where they covering up from not getting my modification done the 1st time around. There is something horribly wrong with your system.
And then the worst letter of all comes. NOTICE OF INTENT TO ACCELERATE.
Remember last December it took only $4500.00 to save my beautiful home.
On October 30th the amount needed to SAVE my house- $14,419.89. My cure date- November 25, 2010. THANKSGIVING DAY.

Only after realizing we could not keep the house and continue making family pay for our home decided to start the short sale process (1 year of payments after first being laid off which BofA would have otherwise not received). A loan Modification will not help because our adjusted income since purchasing the house is down so much. I was then laid off from my last job in August of 2010 and am now searching for new employment. BofA will be paid for the house by either the short sale or by foreclosure sale. The difference is whether or not they care that it means a world of difference to us to have a short sale on our credit and not a foreclosure.
The short sale process has been frustrating and slow. We received an offer on the house and it was sent to the bank but was then canceled by the buyer after 3 months of waiting. We then re-listed the house and received a second offer which was sent to the bank. That offer was counter offered by BofA accepting the offer price and asking that we pay $2,000 now or $4,000 within a few years. Know that would take away a large part of our savings and being unemployed we knew it would save us from foreclosure and agreed to pay $2,000 now and finalize the sale. The buyer then canceled the offer before BofA could accept the sale. Somewhere between the 1st and 2nd offer we received a notice that the house had been given a foreclosure date of Oct. 31, 2010. This now became a scary reality that the house could foreclose simply because the short sale process takes so long.
The foreclosure freeze by banks helped slightly as it pushed our foreclosure date back to November 17, 2010. We re-listed the house and received a 3rd offer contract on the house. The offer has been submitted and now the fear is that with the offer price being the lowest it has been and with the foreclosure date being only a few days away that BofA will just foreclose on the house so they do not have to deal with another short sale negotiation.
Below is a quick outline of what we have gone through with the short sale process and some other information that may be contributing to the home price going down with each offer. We live in a small subdivision of around 45 homes that was built in 2007.
- When we started the short-sale process. It was listed on January 25th. The complete short sale package was submitted on March 30, 2010.
- The offer price, date received and date buyer canceled the first offer. The 1st offer was for $102K, received March 26th. Canceled on June 18th.
- The offer price, date received and date buyer canceled the second offer. The 2nd offer was for $99K, received around July 1st. Canceled on October 5th.
- The new offer price and when it will be submitted to the bank. The new offer price is $88K and was submitted this week.
- If how many homes in our newer small subdivision where for sale or foreclosure at the time when we started the process. Around 3.
- The number of homes in our new small subdivision are now for sale or in foreclosure now and in our area. Around 7; 61
- The average comp. price for this house size in this area when we started and what it is now. Average is 108,500 based on tax record comps. We started at $136,000 but had it listed at 79,900 before getting multiple offers on the home. We currently have an offer for $88,000 which has been submitted to BOA.

I will be sending in this final paperwork for the MHA program with the hopes that I will finally be accepted into a REAL program and not just pushed along so the home can be sold in foreclosure.
I have 3 children that live with me and we have no other place to go after being in this home for 5 years it’s hard to want to leave. I want to work this out and have a resolution to a Standard loan 30/40/50 year at something that my family can afford. I don’t understand as to why the loan couldn’t be resolved.
I would like a phone call or some kind of response that there will be some kind of action.

Well on November 15 are world fell apart we got a denial letter after 8 months of this long process.
So I call and they said the only option is FORCLOSER or a repayment plan so I opt for the repayment plan therefore my payments will be 1700 dollars a month and I have to come up with 800 in a hurry.
I have two kids that I refuse let them see what is going on or live on the streets for that matter.
Its not like I went out and bought a house that was millions of dollars or over are head I could not see the future or the fact that my husband would loose his job because he is in the construction field. i have also taken on a second job so I am not one of those people with my hand out and saying give me give me and I want it all and will do nothing in return!
I am not going to sit here and give you a sob story because you for one don’t care and for two I don’t need sympathy.
I have decided that I am sending this email to you and all my state congress members and governor it may not help me but I want these people to see what Bank of America is doing!
I will not loose my house and all I want was a cheaper house payment that’s it. We just knew that the offer would be here any day and are house payments would go from 991 to 750 or something.
I am also going to hire an attorney because it seems like Bank Of America is going to keep screwing me and I want to make the right decision from here on out. I believed the lies but I will not fall for them again.
I can not believe that Bank of America would do this to people and the thing is I have done what I could. I could have just never made a payment in one year through all these struggles.
I really hope that you could take a minute to respond.
I do know after this process and we bring are head above water I will leave Bank of America!

Anyway, you sent me a letter last week saying you were going to forclose Dec 8th even though I kept sending you the modification payment amout each month and you don’t have the guts to even respond to me in 11 months. I am not really sure why I am sending this email since it appears you are not contacting people on purpose and this pretend incompitence is a systematic scam. I am in good faith trying to keep paying you and figure in the end you will take take my house anyway but at least I tried.

I was very shocked by this event because the law firm, Willford & Geske, that was hired by you, felt free to discuss with my tenant the entire situation. I believe that there was some extreme, if not illegal “wrong doing” on your part for breaching my privacy. It was extremely embarrassing to hear all of the details of my current situation told to me by my tenant. I called BoA right away to express my displeasure and was basically “blown off” by one of your customer service reps. My tenant began to threaten me with moving out and legal action.
I was now loosing time to complete the requested documents as the sale date was approaching. I called BoA again and they were able to extend the Sheriff’s Sale date to the first part of October. I completed all of the requested documentation and sent it to BoA. I received a letter on September 20, 2010 stating that they received the application and it was under review. They then changed the Sheriff’s Sale again to November 19, 2010. I waited for approximately 3-4 weeks without any contact from BoA. I finally called BoA about my status and was surprised that the rep told me I had been denied. I found it disturbing that I was never sent a letter stating I was denied, rather I had to call BoA and have a rep tell me, and only after I asked. I still have NEVER received anything telling me I was denied. I’m supposed to believe a customer service rep who is reading from a computer screen, or maybe possibly making the whole thing up because they were late for their lunch break. I feel these matters NEED to be done in writing. I was told that the reason for my denial was I was not occupying the home and that if I was living in the residence I could reapply.
Taking the CSR advise I was able come to an agreement with my tenant for her to vacate the property so I could move back in. I told the CSR that I would be taking back possession of the property on November 15, 2010. I was told to have documentation such as a recent Address Change Request from the post office and a utility bill that was in my name. I was told to call back and I could reapply. I have since gone back to work as of September 20, 2010, even though I have been still dealing with my illness.
I called BoA on November 16, 2010 to find out where to send the information. I was informed that the Sheriff’s Sale date had been extended to December 6, 2010. I understood that this extention was to give me time to reapply under my new circumstances. On November 17, 2010 I called BoA and explained my new situation again to a different CSR and he told me he had to pre-qualify me using my current situation. He had asked me for my income and expenses and then told me I did not qualify. This took a total of 5 minutes. He told me that I “needed to make much more substantial income”. He also said there were no other options for me other than to call back Monday or Tuesday of next week (Nov 22 or 23) to see if there were other options available, or to see about having the Sheriff’s Sale postponed again to give me enough time to reapply.

I was quite disturbed by this. I didn’t believe that the CSR had understood the answers I gave him or he didn’t enter the data correctly. I immediately called back to see if there was a mistake made somewhere. I talked to another CSR who was extremely rude, loud and condescending. I was simply trying to explain my previous conversation while she just kept talking over me. She told me that I had exhausted all of my option. I was simply trying to tell her that I thought that the previous person I talked to had not entered my data correctly or didn’t understand my new situation. She told me that I was only allowed one application. She stated that “doing more than one application was not part of company protocol”. This didn’t make sense to me because I was doing the things that were requested after I went back to work and moved back into the property. She abruptly ended the conversation stating the only option was to do a short sale or come up with 50% of the past due amount plus attorney fees. I had no clue what she was talking about and then she hung up.

I immediately called back and was connected to another CSR who basically took the same stance with me as the previous CSR. She actually told me to “shut up and listen to me”…. “I have been doing this for many years, and I know what I’m talking about, so YOU need to listen to ME”. She was basically telling me she didn’t want to hear anything I had to say. She made a comment about how I had called 3 other times that day. SO WHAT…! I told her I just wanted to keep my home. I ended the call.
So, here is where I think I am with this whole fiasco. I got behind on my payment due to loss of income because of an illness. I tried to get a loan modification which was denied. I was never offered any other options. I have had all of my sensitive information shared with people that have no right to this information which has embarrassed and humiliated me. I basically evicted my tenant of which I was never informed that I couldn’t have until after I was denied. I have never spoken to the same person twice and have always been given conflicting information. I have now moved back into my home and will be forced to move out after I was told I needed to be living in the property in order to qualify for the modification. Needless to say this has been a total nightmare.

I need to talk to someone who is professional and who can explain to me with clarity where I stand. I realize that time is of the essence and a speedy reply would be greatly appreciated. I would very much like to keep my home.

I am back to being under review for MHA (the biggest crock this county has ever seen) – but now I’m in foreclosure and your inexperienced reps are trying to tell me that they will postpone my sale date as long as I’m under review. How am I to believe this when 1.5 years ago I was told you would modify my loan???? My husband and I have put everything we have into this home and loosing it is not something we want to have happen. The hardship we have been under was unforeseen 5 years ago when we purchased this house – all we wanted was a nice home in a good neighborhood to raise our family and we worked really hard at trying to keep that dream alive.
We can not stay in this house without the your help. My kids will be crushed if they have to leave all that they have known and my faith in the government and our country will forever be lost.
Please I can no longer go on blind faith that you will help me or that the reps that work for the bank know what they are talking about. I’m begging with all my heart – please don’t take my home away from me – please help me. I have ideas – I just need someone who has the power to approve.

Update on 11/22/10: Dear Mr. Wright – I wanted to let you know that I just received a phone call from an agent within the CEO’s office, Anthony Estrata. Just as you stated and so many others on your site stated, he will be turning my file over to a Sr. Negotiator for further review for possible in house options. I’m not holding my breath that the bank will come back and offer me any sort of help – I have lost all confidence in them and it really saddens me. I want to fight for my home, but feel like its a no win situation. The bank wants their money – that is what all of this is about – stupid money and we are all victims to their game. We, like many, many other got the ol’ “you didn’t send the requested bank statements” or “tax returns”, etc. but those requests were indeed fulfilled on the very first application that was returned to BoA in May of this year. And for whatever reason we were never even given a “trial period”.
Seven months gone by and making this mortgage payment becomes more challenging with each passing month. We don’t want to lose our home but, at the same time, we have to be able to feed ourselves and our children. Please help.

Update on 11/23/10: Will do. Thanks. My friend just got served with forclosure notice today from Citibank – they were telling her all along just pay us $1000 per month we will work with you. They worked with her alright!! I told her not to pay it was just a collection tactic, now she is broke and still getting forclosed. I called Nova Debt today and they called bank of America with me. I asked how can I be denied a modification if I submitted $64,000 annual income and you denied me on a $1600 per month modification yet my original mortgage purchase I submitted for a $3000 per month mortgage I showed $74,000 annual income. There is only a $10,000 difference from 2007 to today and they said if I had a grievance I could file a complaint and they would look into it!!!! That was today. Its all such bullshit. Yet they say they don’t want our homes cause they lose money. Riiiiight. They are not doing anything to keep us in these homes you bet they want them. P.S. my sister told me down in Florida they have appointed a court with retired judges to handle 25 robo signed forclosures per hour. That is 1000 per week. I hope I get to stay here 1 more year. I want my daughter to finish 10th grade

BOA told me they could not help me until I was in arrears so I fell behind 1-1/2 months. They put me into a temporary modification program which took effect February 2010 into April 2010. In May I would know if I was to be made a permanent modification. I did not hear from BOA in May so I paid the temporary modification of $1614.17 (my full mortgage was $2829.00). Also in February I contacted my lawyer regarding filing for bankruptcy because at this point it was almost six months and I was still without a job. The lawyer told me I had to take a mandatory credit counseling course with a government approved HUD counselor. I took this course with Nova Debt. My counselor’s name was Daniel Slocum. Together Daniel and I called BOA and spoke with a rep named Gerard who assured me a bankruptcy would not affect my modification as long as I reaffirmed the debt. This was on a recorded call with the Nova Debt counselor. I went ahead and filed on May 28th, 2010. On June 4th I received a letter from BOA stating my loan was not eligible for modification with no reason why. I called BOA and I was told there was a note in my file dated May 31st, 2010 that a mistake in judgment was made to resubmit my financials. I did this on June 7th, 2010. I then called three weeks later to confirm all documents were received and I was told they were. Then on July 3rd I received another letter from BOA stating again I have been denied for loan modification and I should either short sale, sign my deed over or sign my deed in lieu of lease (even though I was not in foreclosure). On July 3rd I called BOA and got a rep named Melissa. I asked Melissa why I was denied and she told me it looked like excessive forbearance. I told her that’s impossible a HUD counselor went over my budget and saw a $1200.00 surplus after all expenses were paid. She said she could not discuss anything else with me that my loan was being handled by the Bankruptcy Department. Feeling very slighted, I called my congressman’s office Scott Garret and got his representative Andrew Whitehouse. Andrew called his BOA contact and explained my situation to him and I was expedited to the Office of the President and assigned a representative named Jacqueline Baker (very polite). Jackie was the first person in a year of dealing with BOA to give me her first and last name and a contact phone number. She explained she was not financial in any way that she is just appointed to handle the trail of my case. I told her I wanted to know why I was denied due to excessive forbearance if a counselor appointed by the government told me I should have no problem. Jackie informed me I was not denied to excessive forbearance but I was denied due to Bankruptcy. She had no idea about Gerard from BOA. I then proceeded to tell her about the letter I have from Nova Debt stating the phone call to BOA and Gerard telling me bankruptcy would have no effect on the modification. She then asked me to send over new financials which I did and a copy of my letter from Nova Debt. I sent all the information to the modification department and to Janice Robertson at the BOA Bankruptcy Work out department. I did this on July 21, 2010. I also sent a letter from Nova Debt to Jacqueline Baker on 7/21/2010 as well as a release from by lawyer that it was okay to talk to me about modification. I contacted Jackie Baker around July 28th to see if she had heard anything or needed anymore documents and such and she said no. She was hoping to hear something in the next week or so. Jackie contacted me on August 5th to let me know they were putting me into a new modification program and my new rep would be Trina Saldibar with a phone number. On August 5th, 6th and 7th I tried contacting Trina with no success. I left three messages and got no returned calls. On August 12, 2010, Jackie Baker contacted me again to let me know I was not canceled due to bankruptcy. Now I was canceled due to lack of a paper trail to show my son’s income and my mother’s social security income was actually being used in the household expenses and instead of requesting more documentation, BOA just dropped my modification (First of all BOA should have requested documentation before dropping my modification, second of all I had requested if any other documentation was needed and I was told NO. Isn’t it funny how I was first denied due to a bankruptcy filing and now it is something totally different yet my cancelation came right after my bankruptcy filing (which I never would have filed had Gerard not assured me it would not affect my modification)? On August 12th when Jackie Baker contacted me, she told me she was not aware of the lack of paper trail regarding my son and my mother’s income and that my new rep would be Irene Smith and she could not give me a phone number but that she would call me Monday August 16, 2010 to go over the needed documents. August 16th happens to be the date the full amount of my mortgage due before late charges take effect (so much for getting the old modification restored to the month of August). Turns out Irene Smith called me on the Friday the day after Jackie Baker and gave me an 800 number to reach her at. After I hung up with her I tried to reach her ten minutes later and lo and behold no chance. My congressman’s rep Andrew tried to reach her and no good. I was not surprised. At this point I don’t think it is a real name. I have given up trying to modify this loan. It is a year later, I am back to square one. I have sent my documents in 7 different times. I have been given three different reasons for denial, (excessive forbearance, bankruptcy and now lack of documentation), I have spoken to or been given countless reps (Melissa, Trina, Janice, Jackie, the latter I believe is the only one that is real), and I have been given the run around for a full year only to see how much money BOA can bleed out of me all the while being unemployed. The fact is I don’t understand how BOA can be such a successful bank with so many reps who don’t know what they are doing. I thought about it and I came up with the fact they know exactly what they are doing!! They are taught to use as many stall tactics as possible and do not approve any modifications. Draw it out as long as possible and get as much money as you can out of the debtor. This is why BOA is so successful. This program was designed for people like me. You see Mr. Moynihan, I did not buy my house out of greed. I have been living in it for 21 years. I am a single mother with three children. One of my children is a handicapped Achondroplastic Dwarf with Hydrocephalus, spina bifida and scoliosis. My home has been modified just to accommodate her. My 80 year old partially handicapped mother also lives with me and gives every dime of her social security to live here. I have never been unemployed and this supposed “program” was designed to help people like me. But its not. BOA is only modifying people who owe more than their house is worth because that way the banks don’t lose. Even though they were bailed out at the tax payers expense. This program is total spin and nothing more. Good luck trying to sell a home modified for a dwarf. I have been living here, maintaining my home, loving my home and caring for it because it was mine. It is breaking my heart to know something I have seated and worked for is going to get run down and then sold dirt cheap to some scavenger. To BOA it will only be just another piece of real estate. Keep in mind at one point in time it was a “Home”. I wish you had to be here to tell my daughter we have to move because BOA is not making enough interest. ($900 a month just is not enough interest) lets displace this family of 5 who have been living here and maintaining it all the while under a cut income. With no job and no place to go I would still rather be jobless and homeless then to work for a bank. The class action lawsuit in Texas against BOA and its tactics extend well beyond Texas. It is alive and well right here in New Jersey also. Sleep well.

My experience with your bank regarding communications has been extremely unsatisfactory. After six months of a three month trial payment period of 2790 per month, my mortgage was reduced from 4500 dollars per month to 3700 dollars per month. The loan processor mocked my situation stating “Gee, you’ll have 400 dollars left per month after your new payment.” For some reason my modified mortgage offer was reduced to a twenty eight year term versus a thirty five to forty year term; though the latter would have made the payment affordable. I refused to sign the modification and contacted your office stating such, at that time I was informed of a new government program regarding mortgage balance reduction. I was told, as the processor read from a manual or bulletin, she had no idea about the new program and to contact them within one month for qualification. I followed up within said month, but was told that I did not qualify. I was then directed to the website, but was unable to log on because I had no password or pin. At this point I applied for arbitration, but was informed my window of eligibility had expired due to the trial period taking so long. Its genuinely been a “Mickey Mouse” runaround since my first contact. After receipt of the letter dated November 02, I contacted your home retention team again, and was told I did not qualify again. In figuring the budget they used the higher payment of 4500 per month instead of what a modified payment would be which may have qualified me.
Originally I paid 854,000 for my house; it is now worth approximately 500,000. My own investment in the house is 300,000. I wish to keep my house, and you would think it would be logical, instead of a short sale, to lower the mortgage balance or lower the payments to affordability with a longer term and lower rate. Any help you could provide would be greatly appreciated.

Also I Called to make a loan payment of $1025.40 on 11/02/10 and it was taken out of my checking account which is what I wanted, so OK that’s fine. Then the payment was taken out again on the same day!! then it was refunded on 11/03 and THEN on 11/03 I was charged again, there is something truly wrong with this system. It is just about a month and the money is yet to be refunded to my account. I have called and called and they never have a straight answer. They say 24-48 hours and it is now a MONTH! Just as the economy was taking a downward spiral, I suffered an illness that nearly cost me my life. At the time, I was working as an independent contractor; if I was not able to work, I was not able to earn.

We were told we did not qualify for any type modification as we had already been given a modification in the Summer or 2009 that reduced our monthly payment by less than $75. Our monthly payments were over $2,000. As you can imagine, this provided little – if any – relief.
Our foreclosure auction was postponed and we were told we were ‘under review’ for some type of modification. If you review our account history, you can see that we have been making regular and in some months, multiple payments. During the last several months, I have been calling very regularly to check on the status of this ‘review’. Each time I call, I am transferred multiple times, hung up on, told ‘not to worry’ and that our case is still under ‘review’. On multiple occasions, I have advised that I am now working full time again and as a result our financial situation has changed. I have asked the past due amount be rolled into our existing loan and our account be brought current. I am not asking for a principle reduction. I am not asking for any fee reversals. I am only asking for my account to be reaged. During a November 1st call I was advised by a Shontey (sp) that this IS possible and she knows this because she used to work in ‘that department’ – she called is a ‘capitalization / regular modification’. I was transferred (again) and Kevin in the Home Retention Department said he could start this process, but that it would ‘mess up’ the review process we are in now.
I called today to inquire yet again on the status of this review. The first three people I spoke with told me it was still under review and “do not worry”. I was transferred four times and hung up on once. I then requested a stateside manager. I spoke with a very nice gentleman named Tyler. Tyler advised me that we were not in ‘review’ and we did not qualify for any type of modification. However, he did offer to re run the financials again. He also advised that neither he nor his immediate supervisor has ever heard of a ‘capitalization / regular modification’. Please note this is the exact opposite of what I had been told previously. I was so frustrated that I apologized to Tyler and ended the call.
Mr. Moynihan, I am a former employee of Bank of America. I worked in your Phoenix Credit Card Fraud Prevention Unit and have saved Bank of America more money than I will likely earn in my lifetime. I left your company only after a senior department manager tried to reprimand me for something I did not do. I was great at my job. I loved my job. However, I loved my principles more.
As a current customer, former B of A family member and average working American, I am asking that the remainder of the $8,153 past due please just be rolled into the balance of my loan and my account brought current.
Please. I am one customer at a time.

Otherwise, I had to make the payments or I would be considered in defalt and it could damage my credit and potentially cost me my home. Which by the way it’s woth doble of that! Now, in august of this year once I had closed my business and sent a letter stating they needed to move faster as I was now unemployed and at a higher risk. I told them out of desparation that I would go to the media to expose them if necessary and I would. I received a letter stating they had received all my information and they forwarded it to the underwriter for verification. I’ve called 50 times since then and always get the “someone is working on it and no updates have been made”. What do I do?! How long does it take to know I qualify and even if you assist me and lower my loan to a 3% you still make a ton of money!!!!!!! What’s going on in this world that we live in? where the banks that have put us all in this mass. we bailed you all out of our pockets and you continue with no restrains to abuse us?! I am sure Obama and the congress didn’t mean to pass this laws to allow you to continue to get rich through damaging others people’s lives. You could still make money and be fair.This could be you and your family one day. NONE is exempt from suffering not even that high up off the ground. BE HUMAN. On 12/06/10 Jennifer Smith: Dear Mr. Moynihan, I am writing to express my utter dissatisfaction with Bank of America. I think it is appalling the way we as consumers are being treated by this organization. Before I voice my compliant I thought it would be important to let you know that not only does BOA hold my mortgage, but I also hold personal and business checking accounts as well as a personal savings account.
I am a single mother who was diagnosed with stage 3 Invasive Ductile Carcinoma (Breast Cancer) in May, 2010. The months to follow would be trying at best. Then in September, 2010 while undergoing treatment I was let go from my job. Knowing that getting well was my first priority, and the fact that while undergoing treatment as well as several reconstructive surgeries I would be unable to obtain any type of full time work for several months. In a state of despair at that point and not knowing what to do or how I would make ends meet I started doing research to find out what type of programs or assistance might be out there for someone in my state of dual hardship. It was then that I found out about BOA Mortgage Modification program for FHA Mortgage holders like me. Based on the criteria listed I am extremely qualified for this program. Naturally, I was ecstatic upon finding out this information. I immediately called the number, went through a series of questions with the representative over the phone who did determine that I was eligible for the program and that an application would be sent out to me. That call took place on Sept 9, 2010. It is now Dec 5th, 2010 I have yet to receive the application. I have called numerous times to find out why I have not received the application and each time I am told a different story. The last call was about a month ago and I was told at that time that an expedited application packet would be mailed out to me, of course I still do not have that application.
I was told on the phone that if I fall behind on my mortgage that I would no longer be eligible for the program, however I am at the point where I may have no choice but to fall behind. I’ve been managing on fund raisers and donations to stay current, but it will not last much longer. Is this the BOA tactic to not have to modify a mortgage?
I am appalled by this and for the life of me cannot understand why it has been 3 months and I still do not even have the application. I’m sure that this is just the beginning of a long, difficult and frustrating journey that I am forced to take with no recourse.
If there is any way at all that I can receive my application I would be highly appreciative. I am not someone who wants to default on her mortgage. I do not expect or want anything for free- I’d like to take advantage of the options that are supposed to be available for me so that I can continue to pay my mortgage on time.

1) The new payment was higher by $581.31. The new monthly payment of $2,581.31 is more than 40% of my gross income.
2) The escrow amount was higher by $111.52 than the actual amounts.
3) The County name is wrong on the documents (instead of Montgomery Country, you have Prince Georges County).
4) Almost $23,000 in interest was added to the mortgage balance.
5) What happened to the almost $2,000 we were paying for one whole year during the trial period? We don’t see where they went to – do you?
6) Our principal balance was $561,720; now it is $595,055.56 ($33,335 was added to the loan balance). Can you explain this?
7) The loan modification is only for 5 years and then our payments will go up by $358 for one year and then the payment will go up again by $520 for one more year and then I am back in limbo again.
I did not sign the contact and sent Ms. Gina a registered letter explaining that the above was not acceptable, pointing out the errors. I received a call back from her and she told me that if we don’t sign the contract, we will not receive another modification.

I have spoken to many assossiates and customer service persons. I have been approved twice for a modificationin which both times somehow fell thru and I did not recieve my modification. The last time I was told it went thru and I would be recieving my new statement in the mail for my payment and recieved instead a letter saying sorry we can’t help you. I recently sent three goodfaith payments and only two were recieved. I have been round and round with you to try and solve this dispute. I am even willing to just resume my regular payments. I asked if you could just modify my loan to help with the monnies owed in back payments. If BofA would not have stopped taking my payments I would not be in this bad of shape. I truly believe the policy needs to be changed. No matter what the status is for someone the money is still owed and if allowed to pay it would not let a person go further into the hole. Please Sir, I want to keep my home. I have a family and no where else to go. I’m sure you may hear this alot, but I do. I’d hate to think after we the tax paying people lent you 60 billion dollars so you could keep your jobs that you could not help me out with a measily sum of money and help me out. I’m also sure you don’t need or want another house. I love my home and want to keep it. Can you HELP! Thank you.

The payments above should have brought back my account to current status as I have paid all my balances with the exception of the $156.18 Late Charge. When I spoke to the Customer Service Representative who took my phone payment, they had advised me that only the negotiator can waive the late charge. They had further advised that after 2 to 3 business days, my payments will post on my mortgage account and that I can see this online.
However up to this day, the payment have still not been posted. I have been trying to contact my new negotiator below but I have not received a response:

I believe I have fulfilled my obligation to pay my mortgage account but it seems that Bank of America is holding up something and is not posting in to my mortgage account. I have saved my hard earned money just to ensure that I am able to make payments and have peace of mind that I can still keep my house. Could you kindly please refer me to the right people who can get this cleared. Otherwise, I will be obliged to take some legal action for the Mortgage department for not posting my payments and not responding to my request to waive the $156.18 Late Charge. and the final would be the PMI which would be $54.51 for 12 months so how come my escrow amount is figured incorrectly. I brought this to Bank of America attention more than once and they refused to correct this. This was a month after they had analyzed the account and I informed them this was incorrect and also told VP Mr. Jim Price who works out of Forth Worth, Texas about this escrow analyze and how they continue, to pull my credit report weekly, giving incorrect credit information, and stating I owes 24 years and 4 months on my loan.
Last then my equity for my loan is not correct either. I purchased my home in January 31, 1996 and Bank of America show that I have 24 years and 4 months payments and this is incorrect when I had a 30 years loan and been in my home since January 31, 1996. I should only have left 15 years left on my loan when I have been in my home almost 15 years.
I look forward to hear from you in regards to my complaints and issues. This lady Ms. Taleshia Smith keep writing response to my complaints and they are not being corrected or resolved because I would not continue to write if there were corrected. I do have a case with Office of the Comptroller of Currency case No. xxxxx. You can not contact anyone on my account anymore. I would like this matter resolve to bring my loan current with my Make Home Affordable Modification since I know that Fannie Mae is my holder of the account and Bank of America just service this loan.

After 45 days I called backed and they say wait up to 90 days. While I was still waiting I received phone calls and a letter to accelerate my home. Even though I was told to make a payment of $1777.84 instead Bank of America opened an escrow account and increased my payment to $3200. I asked is this normal and can I cancel my escrow account and they said it’s normal and I can cancel the escrow if I don’t want the loan modification. I have called the Hope Team, Home Retention Team, Home Preservation, MHA Status and no one knows what’s going on with the loan modification. Everytime I called in they tell me the underwriter is working on it. Than I would called the following month the underwriter is reviewing the document and needs me to send updated income. I would call again the following month the underwriter have submitted to the review board. Than I called again the review board have send it to the senior underwriter..I called again the following month the underwriter have submitted with the Investor (Fannie Mae). Than a month later the paperwork is with the underwriter and he is reviewing the paperwork…after Hell with Bank of America I decided to cancel the loan modification and requested the escrow account to be closed. They closed the escrow and reopened it the following month because they said Fannie Mae the investor required that I leave the escrow account alone and that I can’t close the escrow even though I was never late in my payment and my original contract does not require me to have an escrow account. Not only that Bank of America escrow department made a Unsecure Property Tax which does not affect the house which I do not own which was owed by the previous owner which I called the Orange County Tax Assessor that they are aftering the previous owner but Bank of America instead made the payment and have forced me to pay them back and now I have an escrow account which caused my house payment gone up and they made a Unsecure Tax which was not owed by me. I’m considering suing Bank of America with everything I have. It has caused over 9 months of stress for my family.

B of A now wants the difference between my modification payment and the actual payment or they will foreclose on me. Now my 10 year old son is so scared of losing his home and not having a Christmas. He asked me ‘Dad does the Bank of America president have a good Christmas, why would he take our home.” is that nice or what. Finally on Saturday Dec 4th I had an agent from customer service call me and tell me I am 5 payments behind. I told him off and very loudly mind you. I have made every payment every month and you had better get your story straight. I told the agent to contact HRD. As my wife and I struggle to make our payment every month and when we do there is nothing left. I’m sure you don’t live this way. So please take a proactive approach to this and make it better for my wife and kids. PLEASE.

As for the monthly payment on your new modification program, Emily won’t have that information yet. The underwriter approves information based off of the loan and current payment and income ratios once the documentation has been received. This is where your loan modification is in the process. This information then all gets entered into the loan modification models to determine additional information such as the modified payment amount, applicable interest rate, etc.
Once Emily gets back this finalized information she will know these details and can share them with you. She is out of the office today but will be returning tomorrow. I’ll forward her this email and request that she responds to you as soon as possible. Barry

Update on 01/10/11: Hi John, I’m not sure where my situation is headed, I will say that I got a phone call from Allison at Bank of Abusing America today. She stated that my modification was in the modification model phase. I don’t know what that is nor have I heard of that term. But, she did say that the Dept of Treasury needs that model before moving forward. So let me get this straight, for the past two years I have been jerked every direction by B of A and now o find out the Feds have to bless the paperwork too. Who is backing this modification? And I wonder how much longer I will wait for closure. So we do all the paperwork send it in, get denied, then we appeal, then we raise hell, then we submit more information, then we send in more information, then we send in more information. Then the bank gives it to the Feds so they can see if they need any information, REALLY? Sound like crap to me if this is an MHA program why don’t we just deal direct with the funding agency and screw the bank. I wish i could try to understand this mess. I am hope-full that I am closing in on this. I don’t know how much more blood I can give.

If I do not send you guys $806 by Januray 7, the foreclosure process will begin, and WHY? I have never missed a payment. I find out on Dec 15th, that you guys turned around and decided to REDRAW my loan docs, and no one can tell me why. They want me to resign, for a slightly higher payment? and send in an extra payment with these loan docs?
I have saved absolutely EVERYTHING from you guys stating that we were fine, we had our new interest rate, new payment, all is good. And then out of the blue, you change things, send foreclosure letters? I do not believe this is legal. You can not just up and change legal and binding documents without forwarning the customer. I have since, contacted the attorney general again and have contacated an attorney. I will not sit back and lose my house like you guys are doing to thousands of other Americans. I have never missed a payment, I have done absolutely everything you guys have asked of me (sometimes two or three times over because you keep saying I never turned in my documents EVEN THOUGH i saved the tracking numbers of the things I sent back. Update on 03/24/11: dear Brian Moynihan & Mina Mettry, It now has been 17 days and still no financial packet that has been sent to me. I said before and I will say it again, this is unexceptable to me that someone is telling me I can not afford my home that I am living in. I was borrowed the money in 2001 to buy this home that I have worked very hard for, I have refinanced my home and also took out a home equity loan. I have also made payments on my home for 11 years without ever having a late payment with countrywide & bofa. This is unexceptable what you and your bank are doing to me. Your bank recived a $45 billion dollar bailout of the taxpayer money to make intersest on your bank when that money should of helped out distressed homeowners like myself due to my hardships immune disorder, chrones disease and also haviing to take two pay decreases from my employment. I have been trying for 15 months to renegotiate my loan with you. Shame on you for using your potentially irregular, unethical and greedy banking practices on me. I received my letter of acceptance into the trial period in August. I was instructed to begin my trial of 3 months of reduced payments beginning October 1. I have made these payments on time and in full. Now I am receiving letters from BAC telling me I am behind in my house payments and late fees etc are accruing. How can I be behind when I am paying exactly what you instructed. I have received three such notices of being in arrears. On Sunday, Dec 19 a gentleman came to my door asking me to identify myself and verify my address and he needed to ascertain that I was living in my house and that it was secure. I asked him why he was there and all he could say was that he was independant inspector and gave me a slip of paper addressed to me stating it was important to contact my mortgage company. Those words strike fear in the heart of anyone who has been subjected to this travesty for you know you can not connect with anyone.
I have spent the whole day after a sleepless night trying to get help or just find out..why are you putting me into a false default situation and trying to eventually take my home as the difference between trial payment and original loan payments acrue with added fees.

Since May of 2007 I have been working towards modifying my home loan which at the time was maintained by Countrywide. I completed every aspect of the process in order to have a modification completed and received NO assistance. Countrywide was then bought out and my loan is now maintained by Bank of America. Once my loan was purchased by Bank of America I made contact and provided all necessary documentation. As the harassment continued regarding BAC proceeding with the foreclosure and the sale of my home I sought out assistance from NACA. NACA was able to make some progress, more than I could anyways. I provided NACA with all necessary documentation regarding my finances, my insurance and various other things. At this time NACA completed a budget for me based on the “Obama plan” and it was submitted to BAC. On March 16, 2010, I received notification from BAC via NACA’s website that a modification proposal was available to which I had several questions as to why I was not being offered all of the available terms/conditions that BAC had available. On 3/31/10, I accepted BAC’s offer which was for a new payment amount of $1597.48 PITI. On 4/1/10, in typical fashion I received a FEDEX package from BAC that contained documents that I did NOT agree to. The numbers that BAC were trying to have me agree to were $1871.12 PITI. I immediately contacted BAC via NACA’s website on 4/1/10, 4/6/10, 4/8/10, 4/9/10, 4/10/10, 4/11/10 disputing the documents/numbers/terms that these documents contained which you can verify on the attached document titled “NACA info direct from NACA’s website”. Due to the fact that BAC was proceeding with the auction on my home I was forced to file Bankruptcy on 4/12/10. On 4/23/10, BAC rep Breanna Pennington advised that she was in need of a Bankruptcy authorization in order to send the corrected documents out.
The documents were never sent out and I continued contacting BAC as well as exploring all other options including filing a complaint with the State of California Corporate Compliance Center. On 7/12/10, I continued contacting BAC as despite the fact that I have filed for Bankruptcy BAC had my house set to be auctioned yet again. I resent the same message again on 7/14/10 and on 7/15/10 I was contacted by BAC stating that BAC’s attorney was notified of the Bankruptcy that had been filed. I was also contacted by a representative working out of the office of the president with BAC by the name of Alicia Carrasco. She was working towards bringing this situation to a resolution. However, on 7/30/10, I was notified by BAC via NACA’s website that a title search had come back with numerous tax liens. I was told by Alicia that she would obtain these liens so that I could view them. However, my complaint was then passed onto Arturo Tomlin, another representative with the Office of the President and CEO for BAC. He confirmed the tax liens and even stated that he was reviewing them but advised that he was not able to provide them to me. I contacted the Riverside County Recorders office as well as a title company and have yet to be able to locate any liens against myself or my property. Mr. Tomlin advised that he would work with me but in order for him to do so I needed to terminate my contract with NACA do to ethical dilemmas. On 8/30/10, I faxed Mr. Tomlin verification that I had terminated my contract as he had requested. I was advised that he would now be the driving force and get this situation resolved ASAP.
From 8/30/10 til now I have yet to locate any such lien either against myself or my property. I cannot understand how I am to resolve something that I nor the Recorders Office in the County in which I live can locate. I have asked repeatedly to be provided the liens so that I can review them and then take the appropriate next action but I have been denied the ability or the right to view such information. I received a letter sent by FEDEX from Marina Martinez with BAC that was dated 10/27/10 requesting that I provide proof of release of liens. This letter was misdelivered to my neighbor by FEDEX and therefore I did not even receive it until just before Thanksgiving. I contacted Marina immediately via telephone and left her a voicemail. To date I have left her approximately 4 messages and I have also left Mr. Tomlin approximately 3 messages and neither have bothered to respond to me. I have proof of each and every time that I have called both Marina and Mr. Tomlin and it is extremely unfortunate that neither can make any effort at all to respond. I have rights! I have rights as a customer, as a consumer, as a tax payer, and as a human being and yet all BAC has done to this point is play games with me! How is this ethical? How does this not violate my rights? BAC holds all of the cards here. I have proof that I have been working towards a resolution for months via NACA’s website and yet here I still am with a new auction date!
As I mentioned above Mr. Tomlin stated that in order to help me I had to terminate my NACA agreement/contract yet I reviewed my account today and I find that I have been receiving messages on their website from BAC. Oddly enough I am not the least bit surprised that the right hand has NO idea what the left hand is doing. I can no longer tolerate this potentially illegal, fraudulent, irregular, and abusive treatment and business practices. I reiterate that I am reaching out to you Mr. Moynihan and pleading with you to please help me bring this situation to a resolution, to please not force my children and I to move from our home.

Her name is Dola and though I have not spoked directly to her things seem to be progressing. I have provided all of the documents that she has requested. In addition, I wanted to share with you that I have also been in contact with Carl Saterfield of BrookStone law and I am in the process of sending them my loan docs and the required payment in order to have the audit done on my loan documents. I am really hoping for the best here. Again, as always I want to thank you for all of your support and kind words. I truly appreciate it.

of for (only 38 yrs). IF I can’t trust my bank who can I trust. This program was set up to fail. My blood pressure has went
up and I have anxiety attacks this is the worst nightmare I have ever been in. Because the bank took so long to modify
I applied for a Naca restructure The bank had Naca put me in a forbearance that means that the person has no job. I have
a job I had 2 but the hours were shortened on my second. I should be in a restructured loan not a forbearance. On top of
that when I made my last trial mod for B of A they took out $500.00 too much. When I called them about this they said
I had to wait 7 to 10 business days to get my money back. They made the error but I have to wait. Keep in mind that this
is done on the 15th of December and Christmas is on the 25th go figure. I talked to several people I even told them
I needed money to get home with all I got was I am sorry but who is really sorry me or you. What kind of way is this to treat a loyal customer?

I just want to keep my home that my family has lived in for the past six years. I would like an explanation from someone why I was approved for this modification but nobody seems to be aware of this.
At this point in time I am at a loss. I have been in contact with John Wright and am going to join his lawsuit. I want to stay in my home, if you can help me in any way I would appreciate it enormously.

On 12/24/10 Christmas Eve – Michael Lee Wrote: Michael Lee at XXXX -XXXX, Jacksonville, FL. I was late renewing my Flood insurance on Oct 03, 2010 and renewed it on Nov 28, 2010. I recieved a bill for over $2400 for flood insurance from Flood Insurance Department BAC Home Loans so I called them many times and told them that I renewed it on the 28th. They said they would cancel the $2400 they tried to extort from me knowing flood insurance is only $250 year. I called back 15Dec2010 and they said they took the $2400 off of my loan and I was ok with that. Today I get a bill for $362.48 for the lapse in coverage about 55 days. I called them up today and said yes I was late but to charge me 362.48 for 55 days is pure extorsion and I would pay $42.87 the normal rate for my flood insurance that is .77 cents a day. They would not work with me at all. I will not pay this and by reading other peoples experiences with BAC I only thought the mafia delt with extorsion but no BAC is the new mafia. I will pay $42.87 and not a penny more for my lapse in coverage.
The insurance company that sent me the bill is Balboa or Lexington insurance and god only knows who they are. Even the people in your loan dept has no clue where and who they are and how much they charge. They said they don’t have anything to do with them and are clueless and pass the blame to someone else. I spoke to many supervisors and managers about this and they will not work with me. Please do the right thing.

I called them many times and wanted to know why I didn’t know it had been put into foreclosure. Oh, and that date changed to January 31st. That is where it is right now. I haven’t gotten any information/break down as to what the payoff would be or how much I needed to bring the loan current. I think I am owed that much at least and I think I need to know exactly why I was declined. I was hoping that my paying 10 months out of 12 payments that I proved my ability to pay if I had a permanent modification. A “trial period” of sorts. I wrote that in one of my five “hardship letters” that I sent in with my “updated” financial data. I am still in hopes that I get a modification but if not I need a good explanation as to why I was declined. Thank you for your attention to this matter.

I then found www.piggybankblog.com where numerous people have stated the same issues with BofA. I figured I would cut to the chase and email you directly before BofA tries to sucker me into some plan which ultimately leaves me with no other option except foreclosure. Your whole plan of loan modification is a sham and you personally know you don’t intend on helping anyone except yourselves.
I know only 4% of people who apply for the loan modification actually get it, but I can tell you right now if I don’t receive a loan modification from BofA I will personally contact John Wright and sue BofA also. Its ridiculous how the federal government bailed out banks which didn’t deserve it. The U.S banking system is nothing but a corrupt set of individuals plotting the destruction of middle class Americans. Bank of Abusing America stated that they are trying to regain America’s trust one customer at a time, I seriously doubt this statement is remotely true. I also will be emailing the OCC and my local and state congressmen and President Obama about this issue.

The following is a description of what has been going on with our mortgage which started with Wilshire Credit Corp and is now ongoing with Bank of America.
When we entered into this Making Home Affordable program with Wilshire we were current on our mortgage, just trying to get our payments down as our rate was 8.8% with a scheduled ARM change due on 1/20/10 and the payment was $2657.30. We were told to make 3 trial payments on Oct, Nov and Dec 1st 2009 in the amount of $2266.39 while they review us and see if we qualify. After we made the 3rd payment I called Wilshire as we still had not received the closing documents and they said it was going to take a bit longer to approve the program and to continue to make those trial payments until they send us the packet. We made another payment in that amount in Jan 2010. Then in Feb 2010 we finally received the packet stating that we were accepted into the program and to send the signed docs in and that our new payment was $2461.71 with a rate of 7.175%, not exactly the $700 a month savings they had originally told us!. We signed them and sent them in on 2-22-10 via UPS Overnight Delivery then found out that on 3-01-10 BOA Home Loans took over our loan. We paid you 3 payments in the new amount of $2461.71 and then started receiving letters from BOA that we were a few months behind on our loan. I then had many conversations, all documented, with different reps from BOA who always told me something different. I was then told to continue to make the “Trial Payments” until it was taken care of so that is what we did ever since our May 2010 payment. Once BOA took over our loan on Mar 1, 2010 you have continued to say that you don’t have any paperwork to support our being accepted in to this program by Wilshire and that you reevaluated us for the program and denied us. We have been making our payment every month since we purchased our home and I pulled every payment off your banks website and can provide them. We were told to continue to make these trial payments until this is straightened out, the trial payments are a few hundred dollars less than our original payment. Then you started saying that you have found our papers, but that always depends on who I talk to when I call. You have been telling us for months that you are sending this to “escalation” to get it straightened out that it will take 7-10 business days, I then will call back in 2 weeks after hearing nothing and another person will say that we are behind and they don’t have the paperwork etc…. I end up getting heated on the phone and then they finally check into things and find the papers then they say the same thing…sending it to escalation…yet again! I ask to talk to someone in escalation or a manager and they decline you the right to do so. Then finally in September 2010 they said they had honored our modification and they were going to go ahead and fix our credit and then a few days later we get two certified letters stating your intent to accelerate our loan…..Please make up your mind! We then received a letter dated 9-22-10 stating that you were sending the credit adjustment through and that it would take 30-60 days to reflect on our credit. Obviously this still has not been fixed on our credit yet and we will make the appropriate steps to get this taken care of but it is a slow process. You are also saying that our new modified amount has gone up to $2537.99 due to escrow increase….so all of this has gone on to just end up saving us $100 in the end! Then we started getting phone calls that we were behind, which was a mystery since we making our payments but apparently you were showing us with a past due balance, which was a mystery to us what that was for since we were never behind and were always told that anything past due would be attached to the end of the loan once the mod went through and that all fee’s were waved once the mod went through, so every month that we made a payment you were applying partial to the previous month that you were showing us owing for and in turn was still making us look behind on the current month. I had called and called and called until I couldn’t take it anymore and I have written down dates and times and contact names for every time I called. I always get a rep that says I need to be transferred to a different department and then after being transferred 3-4 times and then sometimes disconnected I find myself on the phone with another incompetent representative of Bank Of America that tells me I am months behind and not in a modification at all. We also started getting fedex packets from your Home Retention Department telling us that our recent application for a modification has been denied and inviting us to reapply…..How do you get denied for something you have already been approved for?
All of this is what prompted me to send you our first email a few months back and to stop paying you anything on either loan until you fixed what was promised to us. You did have someone get in touch with us a few weeks later named Jocelyn Alvarado. She was very nice in the beginning telling us that she was from the “Office of the President” and that she was here to help us and she would be our contact person from here on out. She stated that she needed me to contact the Home Retention Department and to request an appeal on their decision to deny us based on our declining to be in the program…imagine my surprise when she said that that is what it said on her computer!!! I asked her why I needed to do that since I never declined it and we were already in the modification and she said that she suspected that they would deny my request for appeal and that once that happened then she could get us an in-house modification. I did what she said and also sent her all of my pay information. They did deny the request and then she called and said that she ran the numbers and it didn’t look like a problem at all. She said she was going to combine our 1st and 2nd mortgage since they were both with BOA and that our payment would be $1800 including our insurance and taxes. That was quite a happy thing to hear after 4 years of paying well over $3000 for both as our 2nd has an 11.9% apr. Then she came back and said you couldn’t do the 2nd because there is a freeze on 2nd but that she was going to be putting through the 1st and call us back in a few days. She then called and said that we were denied for not making enough money. Through speaking with her we realized that she wasn’t including my husbands pay stubs as he had been out for work from 7/2010 until the end of 10/2010. I sent her over his 1st pay stub and she sent it through. We then had to call her many times to get a call back from her at which time she said that we were denied due to making too much money..How the hell is that even possible? She said that we have too much expendable income and the only thing you would offer is to add the mortgage payments on the 1st mortgage only to the end of the loan and you would do nothing for us on the 2nd. She said she could not guarantee to us that you would correct the markings on our credit that you put there and we were never behind. She went from being very nice to being very nasty in a hurry. She sent us the packet via Fedex, postmarked 12/2/2010 and the papers were dated 11/22/2010 and had to be signed and sent back no later than 15 days from date of modification papers..which made them due back no later than 12/7/2010….in case your not that great with math…that gave us 5 days to return them to you! They show us with a principle balance of $289982.75 with a fixed APR of 7.175%….so after paying on this home every month since May 2006 we now have a principle balance that is $4982.75 more than what we originally borrowed!!? We then passed all of our information along to our attorney to start dealing with this. He spoke with Jocelyn a few times and explained to her that we were not going to sign the papers she sent us as she could not agree to fix our credit on both loans, it is only fair after all since the only reason we had to stop paying was to get you to finally do something that in the end you didn’t do anyway! We need our payment down and our credit fixed and that is the bottom line. Our attorney left the ball in her court that she was going to get back to him once she spoke with her supervisors. it has now been a few weeks and I had to call her 3 times to finally get a callback at which time she told me that she was waiting to hear from my attorney and hadn’t so the loan has been closed since we didn’t sign the papers and get them back within the 15 day timeframe. She said that if we want to try for a modification again then we have to start all over. She knows full well that if we have to start over that you will take our house in foreclosure before the process happens since we have not paid you since since our September payment.
I will not go back to dealing with your representatives that are completely unwilling to follow through on anything.
I do expect to hear something back in regards to what is going to be done for us. Thank you for your time….again!

Mortgage payment for Sep was paid before due date (15-Sep) on 9-Sep (check #2250) and was cashed on 17-Sep-10. On 15-Sep I noticed that the payment was not received or cashed and to insure appropriate payment (avoiding additional charges), I send another check (#2138) with an attached note that if the 1st payment will appear to discard the 1st check (#2250). The 2nd check was cashed also on 20-Sep. However, nobody from BAC informed my that they received a double payment and I would have expected that BAC would have contacted me asking what to do with 2nd payment. BAC claimed without informing me that this was a voluntary payment for Oct. It is my decision if I want to make an early pre-payment for the the next month and not the decision of BAC. I tried several times, interacting with several people at several locations providing me with several request numbers and ensuring me that the money will be refunded within 24 to 48 hours but the money has never been refunded until now. The decline of my request was never communicated to me but after interacting and calling BAC several times, it was simply stated that it was rejected. This all happened before the due date of 15 Sep but BAC found a way dragging it out past the due date of 15-Oct. Since mid Oct I refinanced and the argument (another bank bought the entire mortgage charge in full) that withholding the Oct mortgage payment seems erratic and irrationally to me.
Resolution Sought: I would like BAC to refund the overpaid mortgage by either send me a check in the amount of $2632.38 or re-route the amount to my bank account with Wachovia.

I sent out an email on 11/12/10 and BofA called me on 11/15/10 to let me know they received the email and were looking into my situation. The followed up the next day letting me know that my short sale account was assigned to an associate and that my house would not foreclose while there is a contract offer in negotiation. I am seeing hope.

I sent an email on 11/16/10 and was contacted on today 11/18/10 that they have received my email and will call me bank within 24 to 48 hours about my situation. I spoke to NACA about their proposal and they said to accept because they did not think they would offer anything better. So hopefully they will. Well, today I recieved via FedEx the letter from Bend over Amercia, telling me that we aren’t eligible for a loan modification! They told us that we have a negative NPV or Net Present Value. They state that the HAMP requires a calculation using a formula developed by the Dept. of the Treasury! Apparently this “formula” is top secret, hush-hush special magical formula that only is available to Very Special Piggys! In the letter, they state the available NPV inputs, but no numbers to explain it. If I want them I have to request it in the next thirty days!
Why didn’t they just include them in the first place?
Oh yeah, it’s so they can keep dragging their feet on this and it would be logical. We can’t have that now, can we? I am SO ticked off! Back to writing e-mails and making phone calls. Now I have an idea with the info here and now I am Tammy Stein and I’m fighting mad and fighting back! Deeds, not Words.
Since I got the letter stating we weren’t eligible, I have gotten in contact with a Ms. Tawnya Schoolitz Vice President,Bank of America Home Loans,Loan Modification Research and her assistant, Afaf Khodaparast and they are working with me to appeal the denial. Afaf sent me the NPV input numbers to look over and correct. So far, these two seem to be competant so we shall see! One thing I have done for myself is go to my mortgage account on BoA’s website and printed out everything pertinant to my account. Including payment and transaction history! Luckily, I have an all in one printer! So I got some file folders and labeled EVERYTHING and I keep a file of ALL corraspondence from BoA! Making a heck of a paper trail. I suggest everyone do the same.
I got a call today from Rhea Smith from the Simi Valley, CA office, Ph. # 800-669-2443 EXT: 2773, I called back to speak with her, she was busy, so I spoke with Michelle. She told me that the rason for the call was to inform me that Rhea was going to assign a new negotiator to my case. I told her that I was working with Ms. Schoolitz and Afaf, so we shall see how this goes. I am going to e-mail Afaf and see where that leads, Also, Who else here has dealt with Rhea Smith? Well, today I get a call from Robin Dent from the New York office telling me that now she is my Bend over America’s contact and that I will be dealing with her.
And that she is a loan analyst, that basically my Go To Girl.
REALLY! What happened to Rhea Smith? Afaf Khodapast? Tawnya Schoolitz? Theresha Sutherland? Erick Estrada? Et Al.
Sounds like I’m getting the Customer Monkey-Shuffle they told, no ASSURED me that they wouldn’t do!
I think I will write to Afaf and ask her that and cc the letter to all above AND to Moynihan and Desoer’s office as well! Of course here to show what I wrote!

The Bank of Screwing Over America started calling us again today and when the overpaid rep said in the beginning that the call may be recorded I said “oh thanks for reminding me, I a turning on my recorder too!”
She said “you can’t do that.”
I stated “if you can I can!”
She then said…in an extremely annoyed voice, “if you are going to record the call then I need to end the call.”
At which time I said…”OK GOODBYE!”
Weird, she didn’t call back!
We also still have had no response to our second email to the CEO of the Evil Empire, Brian Moynahan.

I emailed CEO of Bank of America back in October 2010. I finally heard from someone from his office, a Michelle Khodiyari, and she seemed very hopeful and very helpful. She gave me the information of the Sr negotiator who was suppossed to handle my case, although, when I called and left a message for this new negotiator, I did not hear back from this person. Another negotiator called me, Todd Blazey. He mentioned that he would be the one handling my case…i have spoken to him twice and it is now January. I have tried to contact him before the holidays, after the holidays, and every day this week I have left messages on his voice mail. I have also left voice mail messages for this Michelle Khodiyari but apparently this week she is on vacation. She left an alternate person to contact, a Jessica Letto, also from the CEO office, and left messages for her this whole week…no response. What kind of customer service does this bank have? Apparently none! Do i need to email the CEO again? Will he just send his cronies to contact people who complain to quiet them down for a little while before they start slacking? This is so frustrating!
