    Mr Moyihan you people unfairly took our home away. when I found out the payments were behind on my sons home I immediately moved in and tried to help I made phone call after phone call faxed everything you guys wanted from w2′s to bank records including my own which all items were faxed several different times I recieved nothing but a run around noone contacted me i have all phone records to prove that. Then one day i came home to find a sherriff sale notice we tried to stop it we were toold that they would call us with confirmation is was cancelled which didn’t happen never recieved any calls from anyone from B of A on the morning of the sale a half hour before it was to happen I was told to western union $13,000 and they would cancel there was no time I was at work my son was at work . Imoved a handicapped daughter and 5 year old grandson in there with me and you people raked us over never was this under review it just all sat idle till we were swooped down upon and kicked in the rear. Court records were checked by a local attorney and nothing was delivered before the sherriff sale papers to the house it stated the home was vacant undeliverable which is a lie. it also stated B of A bought the house( like so many others the bank aquired from what I’ve read everywhere).I don’t anything for free I want our home back with our combined income we make 82,000 a year thats not including my daughters 1300.00 a month she gets, you see the problem here is we never got a chance we were pushed to the side and burn’t. It was said a fedex package was sent to the home who signed for it? and how could it supposedly the house was vacant. we were keeping the grass cut till a month ago we were over there and checked around looked in the window the fridge and stove were missing brand new appliances from when the home was purchased in 2007 the handle on the under the cabinet microwave was broken off, we looked in garage window we had a double in the box in there the box was off and the glass doors kicked in glass was all over the place. the clincher was when we noticed the access door undeer the deck was open we checked under the deck and the 2 new sump pumps we put in in august were gone that was it we haven’t been back it’s disheartening to know your home is vandalized by the whatever people you use to “winterize” our house. i have pictures of every room in the house the condition it was in my sister and I cleaned it from top to bottom in hopes you would hear us that this was unfair and give us our home and a chance. But its much easier to watch people who try squirm and suffer. and please don’t have these advocates call us we return a call and never hear another word from them until we recieved aletter that said call back within 5 days or your out of luck, guess what called back within 5 days no reponse i take it we’re out of liuck I would appreciate the call come you since you are CEO and “your here to help the American people”. or write me temp address is

    It is very interesting to note that people from diverse places and background have the same experience and say the same story again and again about BOFA, which of course would sound like a ‘broken record’ to our esteemed BOFA Loan Officer! So, what does it say about BOFA??? It has done the same thing again and again to the majority!

    Every bank that offers the HAMP gets the money from the govt., and has nothing to do with TARP! Every house that is defaulted will result in a loss to the bank! So, is there no incentive to BOFA? Has BOFA not learnt the lesson yet?

    I bought the house when I had a very good job and I could easily afford it. Then came the unemployment that lasted ten months and now under-employment with a 40% reduced salary! So, does this Loan Officer know anything about the state of this country since Nov 2008?

    I applied for a Loan Modification last July (2009) when I was unemployed and that was rejected the very next day they sent me a package to apply on the March 19th 2010! They never even informed me, they never even looked at the application that I sent on March 30th! They do not even have a record of the receipt of that package, when I have a proof their signature! Since then, after many complaints and many requests, they have called me last week and have asked me to send the paper work again. However, I am hesitating because while I satisfy all the federal requirements, I probably would not meet the BOFA specific new requirement that they have started harping about: “If you have enough money in the bank to meet all the expenses for the next three months, you will be denied!” This is why people, who still can afford to pay their mortgage, walk out and ruin their credits. For, BOFA is not interested in caring for the people who struggle to pay mortgage, but are up to date in their payment. BOFA only supports people who couldn’t afford to buy the house in the first place and have no money to last three months! So, finally, it is the same irresponsible people will get all the help and will have the continued privilege of having a house and not us, who bought the house that we could afford, but due to the job loss and unemployment/under-employment have difficulty paying for the house, but have some money for the rainy season!

    I am not going to address every point that BOFA employee has raised here, for I have already wasted enough time haggling with them on the phone, being tossed from one department to another in a circle without any outcome. What I suspect from that experience is, they get some kind of orientation or training to forward the customer to another department, any department, in a “hot-potato- routing” style! Sometimes, they even say, “we do not have your account/loan with us!” as they have told me many a times! Shows how chaotic their organization is!

    WELL SAID JOHN YOU KNOW YOUR STUFF!!!!!!!!!!!!!!!!! no fair chances were ever given to most of us, the process is strung along and and screweded around with till they forclose ask me they threw out a handicapped women and a 5 year old child when their brother and mother make 82,000 a year and can afford the house they lived in just needed a little help but got the shaft. They supposedly support MS well thats a joke my daughter has Ms and they thought nothing of displacing her and her child. wise up your support of money to the MS society isn’t all there is sure it makes B of A look good but how would they like everyone to hear and see the young old sick and HANDICAPPED they displaced, I BET NOT1 well as I said

    In response to the supposed employee of BOA. First, of all if you had any integrity you would not have post your comments all. Second, if you were here to make a contribution then you have failed. I realized that if your thinking is the consensus of how others think at BOA then you simply have confirmed something for me. Bottom line you really really don’t care. Coming here to belittle others plights is small minded and shameful. In your attempt to make yourself look good you have shared with us what you position is about saving people homes.

    I have a well documented story to share. Soon to post. I am here to see this through. Many agencies and local legal aide have shared that this is an ongoing experience for many home owner. Due to the market crashes forced by the banks in the first place many people lost jobs had to take pay cuts in order to keep their positions, etc.

    Many home owner are upset because we believed the banks would come to our aid in the time of need and they did not. They have provided lots of excuses.

    As I look over the landscape of the past two years it is evident that the banking system is out of control.

    I just have to say this about having the account number on all documents. THAT IS A BUNCH OF BULL. When we all applied for our loans we sent in all kinds of paperwork without an account number. Nothing was lost then. we weren’t sent through revolving doors and foreign call centers. Our paper was processed, filed and neatly available to get the mortgage through.

    Bank of America can make up all the excuses they want but it boils down to the fact that they are doing a piss poor job of helping customers. I have been down a long,stressful, and depressing road with Bank of America. For the most part I had no problem paying my morgage then about a year and a half ago we ran into some problems. In Feb of ’09 I recieved my first modification papers for my first mortgage (I have two mortgages). I had them notorized and sent them back only to be informed a month later that they recieved them a day late and had to make up another modification. So I resent all the required paperwork in and waited for the new paperwork to be sent to me. It never came even after many frustrating phone calls of being told they were still “in the process” of sending them. In June of ’09 I started to recieve papers from their attorneys (Florida Default Law Group) and shorlty after, court papers basically saying they wanted to go to court and forclose.Even after recieving these papers, when I would call B of A**es, they kept on giving me the run around telling me that they will not forclose on a home when their is a modification in process. Well let me tell you folks something that is a straight up LIE! In October of ’09 they modified our second morgage without any problems. Surely we would see our modification papers for our first morgage come shortly after, no, instead we got court papers in November that we had a court date on Dec 23rd (two days before Christmas)about forclosure preceedings. Well the judge was very nice but was honest and told us that it was out of his hands and he was simply a mediator between us and B of A attorneys (whom were on the phone via conference call). The attorneys had no idea that BoA had modified my second morgage or that I was promised a modification for my first (No suprise there). He convinced them to extend my sale date till March of ’10 in hopes that BoA would get their crap together and send me my modification. Another shocking part of this story is that a week later I recieved the modification papers for the first morgage. Hmmm coincidence? I do not know. I immediatly had the papers notorized and sent them back. My first “new” payment was due in Febuary. I found it interesting that when I called Bank of Liars in Febuary, that they still did not have any record of said modification papers that had already been sent. They told me to mail in the payment with a certified check, which I did, and that it would take some time to update the records and post the modification papers into their system. Then I recieved papers that my forclosure sale date in March had been canceled. Great, everything seemed to be working out and I continued to make my payments, then in May everything changed. I recieved papers from the attorneys (the same wonderful attorneys that I had delt with before) saying my forclosure sale date had been rescheduled. I immediatly called BoA who told me not to worry that no forclosure date had been set and becasue the attorneys paper work had no date on it there was nothing to worry about. Well again, they lied to me. I recieved papers directly from the court itself soon after this time with a sale date for June 2nd. I was in shock and very confused becasue I lived up to the terms of the contract so why doesn’t Bank of Nitwits have to? So again the vicious cycle of phone calls and lies began again. I was told to contact the attorneys which I did. and their CSR informed me that BoA needed to tell them to stop the forclosre. I called BoA and was on the phone for almost two hours being transferred around until a representative told me that he would contact the attourneys and tell them to stop. Again another lie, I called a few days later and it never happened. During this time I was told their was no record of my modification and what I was making was trial payments. No where in my paperwork was any mention of this being a trial and even if it was why was this happening? I talked to other BoA reps who told me that no one had closed out my modification or coded it correctly and that was creating a problem. I was told a notification would be sent to the proper persons to fix it. Again nothing happened. My soon to be husband would call and be told a different story as well. Lie after lie, nothing excuses this type of behavior. The sale date was canceled on the same day as the court date only to be rescheduled again on July 21. This time it was sold back to BoA despite all the phone calls,payments, and letter I wrote to the judge back in June. I would like to tell the BoA rep who responded to you John that no reason in the world can excuse what they have done to us and everyone else they have decieved. It sounds like a broken record because of all the people they have screwed over. I have done my research and this is not the only site like this against BoA. Concidence, hardly. The gig is up BoA I am contacting a lawyer and the the state attorneys office, the media, state reps, everyone I can. From what I have been reading alot of people are doing this I encourage evryone to do the same.

    Well, here is my recent update. After they called me and told me that I might qualify, I was informed that eventhough my home related expenses are about 34% of my salary and I meet all the federal requirements, I was told that “I can afford to pay the mortgage” (what a relief!) and I need to reduce my other expenses! The representative, who was supposed to take care of my case, continued saying that my investor (Lehman Brothers, it seems)would deny my case as they generally do with the cases where home expenses is below 37%.

    Another criterion, which actually is against the Federal requirement (if you have read the Affidavit form), is considering having the emergency fund to meet next three months’ expenses as a reason for denial! In fact, the form says not to include that as a savings at all. But, that is what BOFA’s prime criterion is!

    He also told that he would forward my application (if I apply) to the default prevention agency and they would start the default process! I never understood this. Did the Federal requirement for Home Affordability Plan ask us to go on default to qualify for modification? No! Then, why is BOFA misinterpreting the Federal requirements for eligibility and, support the people who could buy the house but do not have any (emergency) money to run the next three months?

    Why do I have to go through the BOFA orchestrated default process if all I am asking for is help to reduce my payment? If I have to go through the default process, why would I even ask BOFA?

    I told the BOFA agent that my time was precious for me to spend any more time on the application and wait forever (they won’t even inform me when they deny) and then fight. I’d rather default if and when I reach that stage.

    This Iraqi returned veteran cum BOFA employee seems to have been in Iraq when we all lost our jobs and started struggling. One big question though: Has he understood the Federal requirements and the discrepancies with the BOFA’s implementation, if they call it as that?
